The City Council of Salt Lake City, Utah, met in Formal Session on
Tuesday, March 20, 2018 in Room 315, Council Chambers, City County
Building, 451 South State .

PUBLIC HEARINGS
#1 . 7 :24 :45 PM Accept public comment about a Public Benefits
Analysis and consider adopting a resolution authorizing a lease fee
waiver for The Road Home and Shelter the Homeless, Inc. Under the
proposal, lease fees would be waived for a portion of City-owned right-
of-way located at approximately 224 South 500 West that the Road Home
intends to fence in and use as a common area for its temporary residents.

Douglas Cotant asked if the Road Home was a place for homeless
people and if it was being sold to someone else . Councilmember Mendenhall
asked Staff to meet with Mr. Cotant to address his concerns .
Councilmember Johnston moved and Councilmember Luke seconded to
close the public hearing and adopt Resolution 12 of 2018 waiving lease
fees for the area at about 224 South 500 West Street, which motion
carried, all members present voted aye .

Rocky Mountain High-intensity Drug Trafficking Area (HIDTA) requesting
funding for one year of salary and benefits for an existing K9

Councilmember Johnston moved and Councilmember Luke seconded to
close the public hearing and defer action to a future Consent Agenda,
which motion carried, all members present voted aye .

#3 . 7 :27 : 15 PM Accept public comment regarding the Mayor' s funding
recommendations and an appropriations resolution adopting the One-Year
Annual Action Plan for 2018-19. These include Community Development Block
Grant (CDBG) funding, HOME Investment Partnership Program funding,
Emergency Solutions Grant (ESG) funding, Housing Opportunities for
Persons with AIDS (HOPWA) funding, for Fiscal Year 2018-2019 and
approving an Interlocal Cooperation Agreement between Salt Lake City and

Debra Lucero Sivels spoke about homeless issues (being homeless
since 2010) . She said she had worked with many service providers but
remained homeless because non-profit housing was not available due to
her criminal background. She expressed concern that program funding was
not being used appropriately.
Councilmember Mendenhall took a moment of personal privilege to
reflect on increasing needs while federal funding continued to decline.
Councilmember Luke moved and Councilmember Rogers seconded to close
the public hearing and defer action to a future meeting, which motion
carried, all members present voted aye .

#4 . 8:13: 09 PM Accept public comment on new revenue options under
consideration, including a potential sales tax increase for Salt Lake
City' s current funding and project needs . View Attachment
Councilmember Mendenhall read a statement about the City' s interest
in obtaining public input on funding options needed to meet critical
City needs such as : street maintenance, affordable housing, transit
service, and public safety. She said additional funding would be used to
maintain the City' s high quality of life and improve air quality. She
said two options which stood out to City leaders were 1) increasing the
City' s portion of sales tax, and 2) asking voters to consider approving
a General Obligation Bond (GO Bond) to fund road improvements . She said
another public hearing would be held April 3, 2018 . She said the Council
could potentially take action on the sales tax option later in April,
but additional public engagement on the GO Bond would continue throughout
the summer. She encouraged the public to provide feedback by attending
meetings/workshops or through written comments .

Councilmember Wharton moved and Councilmember Johnston seconded to
close the public hearing and refer the item to the April 3, 2018 public
hearing, which motion carried, all members present voted aye.

POTENTIAL ACTION ITEMS
#1 . 8: 15:51 PM Adopting an ordinance amending Section 9 . 08 . 010 , Salt
Lake City Code, to adjust the definition of recyclable items . The
proposal would:
• Remove plastic bags from the list of acceptable recyclable items
for the City's curbside recycling program;
• Allow the Sustainability Department to change the list of acceptable
recyclable items as needed based on technology and secondary
markets, rather than going through an ordinance change; and
• Change the definition of "Bulky Waste" to only include trees,
branches and stumps that are larger than 8 inches in diameter.
Trees, large branches and stumps that are smaller than 8" in
diameter will be managed through the "Green Waste Collection

adopt Ordinance 5 of 2018 amending Section 9. 08 . 010, definitions, of the
Salt Lake City Code, which motion carried, all members present voted
aye .

#2 . 8: 16:35 PM Adopting an ordinance that would rezone properties
at 419, 422 , 423, and 430 South 1100 West Street from R-1/5, 000 Single-
Family Residential District to I-Institutional District pursuant to
Petition No. PLNPCM2017-00447 . The parcels are owned by Neighborhood
House, a local nonprofit organization. The proposed changes would rezone
the parcels to the same zoning as adjacent parcels, and would allow
Neighborhood House to expand its daycare services on the site by
demolishing two current buildings and constructing one larger facility.
Although the applicant has requested that the property be rezoned to (-
Institutional District, consideration may be given to rezoning the
property to another zoning district with similar characteristics.

adopt Ordinance 6 of 2018 amending the zoning of properties located at

#3 . 8 : 17 :20 PM Adopting an ordinance closing and vacating a portion
of 1100 West Street located between Goshen Street and the Jordan River
and between 400 and 500 South streets pursuant to Petition No .
PLNSUB2017-00320 . The portion of street exists on paper only, and is not
utilized for transportation purposes or to access other properties. Under
the proposal, the City would donate the . 25 acre property to the abutting
property owner, Neighborhood House, a local nonprofit. (Petitioner:

to Neighborhood House, Inc. , a Utah Nonprofit Corporation, which motion
carried, all members present voted aye .

#5 . 8 : 18 :24 PM Adopting an ordinance amending various sections of
Title 21A, Zoning Code, pertaining to planned development regulations
pursuant to Petition No . PLNPCM2016-00600 . A planned development is an
approval process that allows the Planning Commission to modify zoning
standards to create a better development project than what would be
allowed under strict zoning regulations . The amendment is intended to:
• Ensure that planned developments are meeting a Citywide planning
objective;
• Ensure that project designs are compatible with adjacent
development; and
• Clarify zoning regulations .
Related provisions of Title 21A, Zoning, may also be amended as

Historic Preservation Overlay District pursuant to Petition No.
PLNPCM2009-00014 . The ordinance would:
• Clarify language to make the demolition and economic hardship
process more transparent;
• Clarify the documentation required for an application for new
construction to be considered complete;
• Revise the standards for new construction in a local historic
district so that they are more user friendly; and
• Align the standards for new construction to the city's adopted
design guidelines.
• Clarify the importance of the design guidelines in designing and
reviewing proposed projects. (Petitioner: Mayor Jackie

Councilmember Johnston moved and Councilmember Wharton seconded to
adopt Ordinance 9 of 2018 amending Section 21A.34 . 020, Salt Lake City

members present voted aye .
Councilmember Johnston said, for clarification, the ordinance for
the petition was merged with another petition (Standards for New
Construction in Local Historic Districts (PLNPCM2016-00905) . This was
done in order to prevent text collisions between the two amendments,
because they involved substantial amendments to the Historic
Preservation Overlay District (21A. 34 . 020) , and were being processed at
the same time .

Resolution 14 of 2018 authorizing a loan for $500,000 from the Salt Lake
City' s Housing Trust Fund to Denver Partners, LLC, for the Denver Street
Apartments located at approximately 770 South Denver Street, which motion
carried, all members present voted aye, except Councilmember Johnston,
who was recused.

#2 . 8:25:48 PM Consider a request from a property owner who plans
to develop property at approximately 545 and 555 West 500 North pursuant
to Petition No. PLNPCM2011-00203 . In 2012, the property owner requested
and was granted a rezone of the properties on condition that the adjacent
private street (Tuttle Court) be dedicated to the City. The property
owner is now requesting that the condition be removed. The City has
previously granted the property owner three extensions to satisfy the
conditions of the ordinance due to difficulties the property owner has
experienced in obtaining financing to move forward with the project.

approve Resolution 15 of 2018 extending the time period for satisfying
conditions set forth in Ordinance 18 of 2012 by six (6) months to give

Councilmember Luke moved and Councilmember Wharton seconded to
approve the Consent Agenda, which motion carried, all members present
voted aye .
#1. Setting the date of Tuesday, April 3, 2018 at 7 : 00 p.m. to
accept public comment and consider adopting an ordinance amending the
zoning map pertaining to the parcel located at approximately 505 North
Morton Drive to rezone the parcel from R-1/5, 000 Single-Family
Residential District to PL Public Lands District pursuant to Petition
No. PLNPCM2017-00429 . Meadowlark Elementary School intends to use this
parcel to expand and reconfigure the existing entrance on the east side
of the school 's site and administrators have requested the rezone in
order to keep zoning consistent with the rest of the school's site.
Expanding the school entrance is a part of a larger project to rebuild
the school building. Although the applicant has requested that the
property be rezoned to the Public Lands District, consideration may be
given to rezoning the property to another zoning district with similar
