WORK SESSION
TUESDAY, MARCH 8 , 2005
The City Council of Salt Lake City, Utah, met in a Work Session on
Tuesday, March 8, 2005, at 5 : 30 p.m. in Room 326, City Council Office,
City County Building, 451 South State Street.
In Attendance : Council Members Carlton Christensen, Van Turner, Eric
Jergensen, Nancy Saxton, Jill Remington Love, Dave Buhler and Dale
Lambert.

Councilmember Lambert presided at and conducted the meeting.
The meeting was called to order at 5 : 35 p .m.
AGENDA ITEMS
#1 . 5 : 35 : 54 PM INTERVIEW BARBARA TOOMER PRIOR TO HER APPOINTMENT TO
THE TRANSPORTATION ADVISORY BOARD .
Councilmember Lambert said Ms . Toomer' s name would be forwarded to
the Consent Agenda for approval .
#2 . 5 : 39 : 40 PM RECEIVE A BRIEFING REGARDING LIBRARY SYSTEM AT THE
REQUEST OF THE LIBRARY DIRECTOR. View Attachments
Nancy Tessman and staff briefed the Council from the attached
handout .
#3 . 7 : 39 : 46 PM RECEIVE A BRIEFING REGARDING PRELIMINARY FINDINGS OF
A GROUND TRANSPORTATION INDUSTRY STUDY COMMISSIONED BY THE CITY COUNCIL.

Ray Mundy briefed the Council from a power point presentation and
the attached handout . Councilmember Lambert said a Council subcommittee
had been formed and the Administration had been involved in discussions .

He asked the subcommittee to come back with additional recommendations .
Councilmember Christensen said problems in the current ordinance needed
to be corrected within the next month or so. He said in a year the
Council could look at a radical change which would involve discussion and
refinement. Councilmember Lambert asked Mr. Mundy if there were short
term refinements that could be done to improve the present system. Mr.
Mundy said he would outline some tactical issues in a letter to the
Council . All Council Members were in favor of having the subcommittee
work with the Administration and make a recommendation.

#5 . 6 : 35 : 47 PM HOLD A DISCUSSION REGARDING LEGISLATIVE ISSUES . View

Lynn Pace briefed the Council from the attached handout . He said
Senate Bill 211, Salt Palace funding, the net effect of the bill
redirected the City' s innkeeper' s tax of 1% out of the City' s General
Fund to the Salt Palace from July 1, 2005 until the end of 2015 . He said
the bill authorized the County to impose an additional 1 . 25% transient
room tax for a six year period and in the last four years it would drop
to 1% .
Mr. Pace said Senate Bill 184, dealing with the Redevelopment Agency
(RDA) , would cut back what was viewed as excesses of RDA' s . He said the
bill eliminated extensions and expansion of areas, prohibited use of RDA
funds for sports arenas or stadiums and put a one-year moratorium on any
RDA project involving retail not initiated prior to February 15, 2005 .
He said the bill also eliminated the use of eminent domain.
Mr. Pace said House Bill 256 dealing with the authority for extra
territorial use for eminent domain became contested because of concern
about how public utilities would be affected. He said the bill allowed
cities to condemn property outside their borders if it was necessary for
public purpose inside their borders . He said the streamline sales tax
issue had essentially died. He said adopting a State-wide sales tax
structure meant a tax increase for someone . He said the amount of
revenue raised by tire recycling was not enough to cover the cost of
relocation by the recycling facility.
Mr. Pace said the Airport Police 20-Year Retirement proposal passed.
He said Land Use Management Re-Codification passed. He said automated
traffic enforcement failed but got more interest and support than

expected. He said the bill would have faired better if it had been
limited to intersection red light enforcement . He said both GRAMA bills
passed.
#6 . (TENTATIVE) THE COUNCIL WILL CONSIDER A MOTION TO ENTER INTO
EXECUTIVE SESSION, IN KEEPING WITH UTAH CODE, TO DISCUSS LABOR
NEGOTIATIONS PURSUANT TO UTAH CODE ANNOTATED § § 52-4-4 AND 520405
(1) (a) (ii) .

#7 . 9 : 10 : 35 PM THE COUNCIL WILL CONSIDER A MOTION TO ENTER INTO
EXECUTIVE SESSION FOR THE PURPOSE OF STRATEGY SESSIONS TO DISCUSS THE
PURCHASE, EXCHANGE, OR LEASE OF REAL PROPERTY WHEN PUBLIC DISCUSSION OF
THE TRANSACTION WOULD DISCLOSE THE APPRAISAL OR ESTIMATED VALUE OF THE
PROPERTY UNDER CONSIDERATION RO PREVENT TE PUBLIC BODY FROM COMPLETING
THE TRANSACTION ON THE BEST POSSIBLE TERMS, AND TO DISCUSS PENDING OR
REASONABLY IMMINENT LITIGATION PURSUANT TO UTAH CODE ANNOTATED § § 552-4-
4, 52-4-5 (1) (a) (iii) AND 52-4-5 (1) (a) (iv) , AND ATTORNEY-CLIENT MATTERS
THAT ARE PRIVILEGED PURSUANT TO UTAH CODE ANNOTATED § 78-24-8.
Councilmember Saxton moved and Councilmember Jergensen seconded to
enter into Executive Session, which motion carried, all members voted
aye .
