TUESDAY, MAY 19, 2020
The City Council of Salt Lake City, Utah, met in Formal Session on
Tuesday, May 19, 2020 in an electronic meeting pursuant to Salt Lake
City Emergency Proclamation No. 2 of 2020 (2) (b) .
The following Council Members participated in the meeting:

Councilmember Wharton presided at and conducted the meeting.
The meeting was called to order at 7 : 16 p.m.

seconded to approve the Work Session minutes of Tuesday, March 3, 2020
and Tuesday, April 7, 2020 as well as the Formal meeting minutes of
Tuesday, April 7, 2020, which motion carried, all members voted aye (roll

#4 . 7:26:46 PM The Council will consider adopting a joint ceremonial
resolution with Mayor Mendenhall designating Salt Lake City as a Utah
HERitage City as part of the Better Days 2020 events honoring the 150th
anniversary of Utah women being the first in the nation to vote under an

#1 . 8:02 :56 PM Continue to accept public comment and consider
adopting an ordinance that would rezone a parcel at approximately 1172
East Chandler Drive from Open Space District (OS) to Foothills
Residential District (FR-3/12,000) pursuant to Petition No . PLNPCM2019-
00795 . The intent of the rezone is to match the zoning of the property
to the east, which is under the same ownership, to allow residential
accessory uses on the property after the two lots are combined.
Consideration may be given to rezoning the property to another zoning
district with similar characteristics. View Attachment
Councilmember Rogers moved and Councilmember Johnston seconded to
close the public hearing and adopt Ordinance 12 of 2020 rezoning the
property at 1172 East Chandler Drive to FR-3/12 ,000 , which motion
carried, all members voted aye (roll call) .

#2 . 8:04 :20 PM Accept public comment and consider adopting an
ordinance that would amend the zoning of property located at 504 South
900 East Street and amending the Central Community Master Plan Future
Land Use Map pursuant to Petition No . PLNPCM2018-00839 and Petition No .
PLNPCM2018-00898 . The proposal would rezone the property from Moderate
Density Multi-Family Residential District (RMF-35) to Residential/Mixed
Use (R-MU-35) and a Master Plan Amendment from Medium Density Residential
to Medium Residential/Mixed Use. The intent of the proposal is to build
a mixed-use development. No site plan has been submitted at this time.
Although the applicant has requested that the property be rezoned to
Residential/Mixed Use (R-MU-35) , consideration may be given to rezoning
the property to another zoning district with similar characteristics.

7 :38:10 PM Ian Kaplan spoke about the proposal/ordinance needing to
be voted on a second time because two clauses in the development
agreement had to be removed due to enforceability issues .

Councilmember Fowler moved and Councilmember Rogers seconded to
close the public hearing and adopt Ordinance 13 of 2020 rezoning the
property at 504 South 900 East to R-MU-35 subject to the applicant
entering into a development agreement with the City limiting ground floor
commercial space to 1,000 square feet, which motion carried, all members
voted aye (roll call) .

appropriating necessary funds to implement, for Fiscal Year 2020-21, the
provisions of the Memorandum of Understanding (MOU) between Salt Lake

Municipal Employees (AFSCME) Local 1004, representing eligible

7 :31:50 PM George Chapman spoke about funding mobile caught-cam
trailers which were desperately needed. He said a lot of Community
Councils wanted them and suggested including a request in the next grant
application. He spoke further regarding funding police overtime,
implementing Park Rangers, and working on the backlog of "Cold Cases" .
He said additional detectives/victim advocates were needed to help keep
rapists off the streets (process kits/update databases) . He also
expressed concern about not having full police staffing and seeing more
officers leaving every month.

would facilitate the uniform regulation of Enterprise Funds payments in

8:07 :40 PM Councilmember Fowler moved and Councilmember Rogers
seconded to close the public hearings and refer Items 3 through 13 to a
public hearing on June 2, 2020, which motion carried, all members voted
aye (roll call) .

COMMENTS TO THE CITY COUNCIL 8:08:31 PM
7 :33:13 PM George Chapman said basic rules needed to be adopted before
implementing more street projects (get input/recommendations from local
Community Councils for appropriate streets) . He spoke further about not
discouraging businesses with "local traffic only" signs, avoiding
congestion/pollution by forcing traffic/bikers, etc. to merge into a
single lane, including bicycle amenities on all bridges including the
300 North pedestrian bridge, and not rezoning the Cleveland Court project
to Form-based UM1 (action would encourage similar requests from other
developers) .
7 :36:21 PM Devin O'Donnell/Martha Castillo asked about obtaining
information about regulations for constructing powerline/utilities on
City streets and what the timeline/delay was for completing the 300 North
bridge project . Councilmember Wharton asked Staff to work with Mr.
O' Donnell and Ms . Castillo to address their questions/concerns .
7:39:12 PM Peter Corroon spoke in favor of the Cleveland Court project
he was developing. Comments included building seven units instead of
five, approval being recommended by Staff/Planning Commission/Community
Council, design creating interaction with Court Yard, current zoning
allowing 35-foot height (proposed project being smaller) , density
concerns (high density properties being located nearby) , and
affordability goals (project changed to provide more affordable units) .
7 :42:50 PM Ryan McMullen spoke in opposition of the Cleveland Court
proposal . Comments included ongoing opposition from surrounding
residents, confusion about project (condominiums or affordable housing) ,
residents wanting to clean up/develop area but concerned density and
setbacks were too extreme, open space/parking issues, and project not
being compatible with existing single-family neighborhood.
7 :44:51 PM Jon Lewis said the flyer he received about joining the
meeting did not include a password and suggested including that in the
next invitation.
QUESTIONS TO THE MAYOR FROM THE CITY COUNCIL 8:08:35 PM

POTENTIAL ACTION ITEMS
#1 . 8:09:07 PM Adopting an ordinance amending the Central Community
Master Plan Future Land Use Map and the zoning map pertaining to a
property at 1430 South 400 East pursuant to Petition No . PLNPCM2019-

00189 and Petition No. PLNPCM2019-00190 . The rezone and amendments would
allow the applicant to build a seven-unit development. The proposal would
change the Central Community Master Plan Future Land Use Map from Low
Density Residential to Medium Density Residential and rezone the property
from RMF-35 (Moderate Density Multi-Family Residential District) to FB-
UN1 (Form Based Urban Neighborhood District) . Although the applicant has
requested that the property be rezoned to the FB-UN1 district,
consideration may be given to rezoning the property to another zoning
district with similar characteristics. View Attachment
Councilmember Johnston moved and Councilmember Valdemoros seconded
to adopt Ordinance 14 of 2020, amending the Central Community Master
Plan to medium density residential and rezoning the property at 1430
South 400 East to FBUN 1 , subject to the applicant and Administration
entering into a development agreement as outlined in the May 19, 2020
staff report:
1 . The architectural plans ("Plans") previously submitted to the
Planning Commission (which reflect a total of seven (7) units and
eight (8) on-site parking spaces) will be revised so that the two
pedestrian entries facing 400 East shall have entry features such
as a porch or stoop with canopy;
2 . A minimum of eight (8) on-site parking spaces will be provided
in the Development;
3 . The Plans will be revised so that the units facing Cleveland
Avenue shall have primary pedestrian entrances facing the street;
4 . Developer must obtain subdivision approval to split the lot into
two in order to comply with the standards of the proposed zoning
district; and
5 . The Salt Lake City Planning Division shall have final approval
authority over the Plans, which shall comply with the conditions of
approval described above, which motion carried, all members voted
aye, except Council Members Dugan, Fowler, and Wharton, who voted
nay (roll call) .

UNFINISHED BUSINESS
#1 . 8:11 :32 PM Adopting a resolution approving the 2019 Salt Lake
County Multi-Jurisdiction Hazard Mitigation Plan, which includes
information such as demographics, a hazard profile, and identified
necessary/potential mitigation projects to minimize damage and loss of
life. Required every five years by the Federal FEMA, these updates are
critical and required for an entity to be eligible for pre-disaster
mitigation funds and post-disaster assistance. View Attachment

#2 . 8:13:05 PM Adopting a resolution approving a Housing Trust Fund
loan modification request from North 4th LLC and Project Open 2 LLC for
a mixed-income, mixed-use development located at 529 West 400 North. The
project would consist of 95 units, 74 of which would be affordable for
households at or below 50o Area Median Income (AMI) . The original City
loan to North 4th LLC was for acquisition of the land parcel . The
modification request would remove North 4th LLC from the loan because
the land has been transferred to Project Open 2 LLC. View Attachment
Councilmember Rogers moved and Councilmember Fowler seconded to
adopt Resolution 13 of 2020, authorizing the loan modification request
for a mixed-income housing project at 529 West 400 North Street, which
motion carried, all members voted aye (roll call) .

#3. 8:14:05 PM Adopting an ordinance that would memorialize a list
of reporting requirements including updates or reports the Council has
requested from the Administration, items the Council is entitled to
receive based on State or City Code, or information items that are
routinely shared, relating to the Community and Neighborhoods
Department. The goal of gathering all the reporting information into one
easy-to-reference location is to enhance transparency and add clarity to
the process of sharing information needed by the Council to fulfill its

adopt Ordinance 15 of 2020 , requiring information reports be provided to
the City Council pertaining to Community and Neighborhoods Department,

CONSENT 8 :16:4 8 PM
Councilmember Rogers moved and Councilmember Fowler seconded to
approve the Consent Agenda, which motion carried, all members voted aye
(roll call) .
#1 . Setting the date of Tuesday, June 9, 2020 at 7 : 00 p.m. to
accept public comment about ordinance amendments to regulate and monitor
the City' s storm sewer system. The storm sewer carries rainwater and
melted snow through gutters and drains to an underground system that
flows to nearby rivers, canals, or creeks . Sometimes pollutants in runoff
may enter the storm sewer system and may impact downstream rivers and
lakes. While the City has adopted ordinances to protect water quality,
the proposed amendments more effectively meet changing federal and State
regulations to ensure stormwater quality standards. The amendments also
deal with the City 's enforcement of the standards. View Attachment

#2 . Setting the date of Tuesday, June 2, 2020 at 7 : 00 p.m. to
accept public comment and consider adopting an ordinance that would amend
the final budget of Salt Lake City, including the employment staffing
document, for Fiscal Year 2019-20 . Budget amendments happen several times
each year to reflect adjustments to the City's budgets, including
proposed project additions and modifications. The proposed amendment
includes $2 million to repair damage to City-owned buildings caused by
the 5. 7 earthquake series and $1 . 5 million from the Volkswagen diesel
emissions settlement to replace 11 of the City's diesel trucks, among
