The City Council of Salt Lake City, Utah, met on Tuesday, May 2, 2017 at
7 : 02 p .m. in Room 315, Council Chambers, City County Building, 451 South
State .
The following Council Members were present :

7 :36:55 PM Note: Items 1-4 will be heard as one public hearing item.
#1 . Accept public comment and consider an ordinance closing a
portion of Hayes Avenue between the Jordan River and 1100 West Street
pursuant to Petition No. PLNPCM2015-00764 . The portion of Hayes Avenue
is City-owned property and is completely surrounded by Salt Lake City
Open Space land. If the Street is closed, the property will be protected
from future development Parks and Open Space (Petitioner- Salt Lake City

#2 . Accept public comment and consider adopting an ordinance closing
and vacating a portion of unnamed, City-owned alley adjacent to and
bisecting property located at 1528 West North Temple, near Cornell Street
pursuant to Petition No. PLNPCM2015-00941 . The alley closure would allow
properties adjacent to the alley to be combined into a larger parcel and
developed. If the ordinance is adopted, the alley would be sold for fair
market value, or traded for similarly valued land along the northern
edge of the property that is owned by the City. The exchange would allow
for the enlargement of an existing storm water retention basin owned by
Public Utilities (Petitioner: Power Station Investments) . View

#3 . Accept public comment and consider adopting an ordinance that
would close to the public a mid-block, city-owned alley located west of
900 West between and parallel to Duluth Avenue (approximately 1550 North)
and 1500 North pursuant to Petition No. PLNPCM2013-00196 . The alley would
be sold at fair market value to the adjacent property owner and provide
improved access between land parcels for the property owner (Petitioner

#4 . Accept public comment and consider adopting an ordinance closing
and vacating a City-owned alley situated between approximately 1411 South
and High Avenue at approximately 1550 West pursuant to Petition No.
PLNPCM2015-00056 . The alley is 15 feet wide, 250 feet long and is
platted, but fences have been built across the alley blocking it from
use. If the proposal is adopted, the alley would be vacated and the
property would be split evenly between property owners on each side of
the alley (Petitioner-Hans Ehrbar) . View Attachments

Kathryn Albany, Hans Ehrbar, Vicky Wason, and Mary English spoke in
support of the Hayes Avenue Street Closure between the Jordan River and
1100 West.
Councilmember Adams moved and Councilmember Johnston seconded to
close the public hearing and adopt:
• Ordinance 14 of 2017 closing Hayes Avenue between the Jordan River
and 1100 West.
• Ordinance 15 of 2017 closing the alley West of 900 West between
Duluth Avenue (1550 North) and 1500 North.
• Ordinance 16 of 2017 closing the alley approximately at 1528 West
North Temple.
• Ordinance 17 of 2017 closing the alley between approximately 1411
South and High Avenue at approximately 1550 West, which motion
carried, all members present voted aye .
#5 . 7:43:51 PM Accept public comment and consider adopting an
ordinance amending the zoning map pertaining to a parcel located at
approximately 695 North John Glenn Road to rezone the parcel from
Agricultural (AG) to Light Manufacturing (M-1) and to remove the parcel
from the Lowland Conservancy Overlay District (LC) pursuant to Petition
No. PLNPCM2017-00063 . The changes would allow the site to be developed
into light manufacturing development. The City 's Northwest Quadrant
Master Plan supports the change in zoning from AG to M-1 and the property
is designated for light Industrial uses. Public Utilities has reviewed
this proposal and is supportive of removing the property from the overlay
district as there are no ponds or other bodies of water on the property
in question, the area is not located in the floodplain and there have
been no wetland areas discovered in the area. Although the applicant has
requested that the property be rezoned to Light Manufacturing (M-1) , the
Council may consider rezoning the properties to a different zoning
district with similar characteristics (Petitioner: Seefried Development

close the public hearing and adopt Ordinance 18 of 2017 amending the
zoning map pertaining to a parcel located at approximately 695 North
John Glenn Road from AG to M-1 and to remove the parcel from the Lowland
Conservancy Overlay District, which motion carried, all members present
voted aye .

#6 . 7:43:13 PM Accept public comment and consider adopting a
resolution authorizing the establishment of a Community Land Trust in

the Salt Lake City Division of Housing and Neighborhood Development. A
study of the model is required by state code as the City plans to
appropriate funds (by offering a nominal, below market long-term lease
rate) for affordable housing. The study identifies the benefits the City
will receive, the purpose for the appropriation and whether the
appropriation is "necessary and appropriate" to accomplish the City's

#7 . 7 :43:51 PM Accept public comment for a grant application with
Bureau of Medical Services and Preparedness requesting funding to
purchase a monitor defibrillator which will replace an obsolete

close the public hearing for Grant Application Item 7 and defer action
to a future meeting, which motion carried, all members present voted
aye .

POTENTIAL ACTION ITEMS
#1 . 7 :44 :31 PM Adopting an ordinance amending the Final Budget of
Salt Lake City, including the employment staffing document for Fiscal
Year 2016-17 . Budget amendments happen several times each year to reflect
adjustments to the City's budgets, including proposed project additions
and modifications. The amendment includes funding for design,
engineering and cost estimates to renovate the old Fire Station No. 14
(1560 S. Industrial Road) into a fire training center; land acquisition,
design and program assessment to construct a police precinct in Sugar
House; additional building stone repair for the City & County Building;
and purchase of land for the Jordan River Trail Bridge project, among

Councilmember Adams moved and Councilmember Mendenhall seconded to
adopt Ordinance 19 of 2017 approving:
• $500,000 in police impact fees for Item A-4 : Sugar House Police
Precinct.

• The Capital Improvement Program (CIP) Comprehensive Review
Legislative Intent
The Council requests the Administration conduct a comprehensive
review of all CIP cost centers and report results by the end of the
2017 calendar year. The review should look at project statuses,
fund' s available for re-appropriation in closed, inactive and old
costs centers, and project debt load over future years, which motion
carried, all members present voted aye .

COMMENTS TO THE CITY COUNCIL 7 :45:12 PM
Damon Harris and Jacob Jenson spoke regarding lack of City
involvement against police brutality and improving the Police Civilian
Review Board.
Patrick Bieker expressed concern regarding the Mayor' s lack of
action concerning Pete King. He stated the Southwest Carpenters would be
present at the City' s upcoming budget public hearings until their issue
was addressed.
Douglas Cotant expressed concern regarding funding cuts from the
Federal Government .
Bernard Hart addressed community concerns regarding
current/potential homeless campers and potential issues related to drug
use/addiction expected with the proposed homeless shelter at 131 East
700 South.
UNFINISHED BUSINESS
#1 . 7 :54 :08 PM Adopting an ordinance amending Section 21A. 44 . 050 .B
of the Salt Lake City Code pursuant to Petition No. PLNPCM2015-00148 to
modify regulations pertaining to electric vehicle parking requirements
for certain development activity and changing requirements for electric
vehicle parking stalls (Petitioner - former Mayor Ralph Becker) . View

Councilmember Johnston moved to adopt the section of the proposed
ordinance that applies to Salt Lake City Code 21A. 44 . 050 .B. 2, titled
Electric Vehicle Parking, only to future multi-family residential
buildings with more than 5, 000 square feet in floor area and the future
expansion of existing multi-family residential buildings by more than
5, 000 square feet of existing floor area.

Councilmember Johnston further moved that the City Council continue
to consider and gather public input on the proposed amended standards to
21A. 44 . 050 .B. 2 that were presented at the Council' s April 4, 2017, work
session.
The proposed revisions included:
• Requiring at least 20 percent of the minimum required parking spaces
to have conduit to accommodate wiring for the future use of a
minimum of 208 Volt (Level 2) electric vehicle charging equipment.
• Requiring "sufficient electrical capacity" for the future use of a
minimum of 208 Volt (Level 2) electrical vehicle charging equipment.
• Defining "sufficient electrical capacity" as having "electrical
panel (s) and transformer capacity to accommodate the future use of
a minimum of 208 Volt (Level 2) electric vehicle charging
equipment. "
• Repealing requirements to locate electric vehicle charging spaces
in the same parking lot as the principal building use and locating
electric vehicle charging spaces as close to a primary building
entrance as possible.
The motion failed for lack of a second.
Councilmember Mendenhall commented she recognized the current
ordinance needed some adjustments and there were some financial realities
for development which were worth addressing. She said she was adamant
throughout discussions, she believed the weakening of installation of
electric vehicle charging and the capacity for it was contrary to the
sustainability efforts of the City. Councilmember Mendenhall stated she
was not in support of the proposed text amendment and was willing to
bring it back for discussion in a work session to discuss the changes .
Councilmember Adams commented her concern was the extended amount
of time and work already spent on this amendment . She said with
affordable housing being a priority of the City, she was concerned this
would make it more difficult to get affordable housing because it was an
expensive component. She said electric cars were expensive and in places
where there was affordable housing the stalls would go unused.
Councilmember Adams indicated the need to revisit the amendment and
figure out a way for it to benefit affordable housing.
Ms . Gust-Jenson explained there was a miscommunication that Staff
believed the Council had interest in moving ahead on the housing piece
of the text amendment.
Councilmember Mendenhall moved and Councilmember Adams seconded to
table the electric vehicle parking stalls text amendment.

Councilmember Johnston said he was glad to continue discussion
because this was urgent and important and he wanted to ensure it was
pursued as quickly and effectively as possible .

#2 . 8 :01:37 PM Adopting a resolution adopting the Tentative Budgets
of Salt Lake City, Utah, including the tentative budget of the Library
Fund, for Fiscal Year 2017-18 .
Councilmember Mendenhall moved and Councilmember Adams seconded to
adopt Resolution 11 of 2017 adopting the Tentative Budgets of Salt Lake
City, Utah, including the tentative budget of the Library Fund, for
Fiscal Year 2017-2018, which motion carried, all members present voted
aye .

#3 . 8:02:23 PM Confirming the dates of Tuesday, May 16, 2017 , Tuesday,
May 23, 2017 , and Tuesday, June 6, 2017, at 7 : 00 p.m. to accept public
comment regarding an ordinance adopting the final budget and the
employment staffing document for Salt Lake City, Utah and related
ordinances for Fiscal Year 2017-18 .

confirm the public hearing dates of Tuesday, May 16, 2017, Tuesday, May

aye .

#1 . Setting the date of Tuesday, May 23, 2017 at 7 : 00 p.m. to accept
public comment regarding an ordinance amending the zoning map pertaining
one parcel located at 1978 S West Temple to rezone a portion of that
parcel from RMF-35 Residential Multi-Family to CG General Commercial,
and amending the Central Community Master Plan Future Land Use Map
pursuant to Petition Nos . PLNPCM2016-00935 and PLNPCM2016-00936 . The
proposed changes would allow Okland Construction, which owns the
property, to expand the existing office building and parking lot.
Although the applicant has requested that the properties be zoned to CG
General Commercial, the Council may consider rezoning the property to
another zoning district with similar characteristics (Petitioner -
Okland Construction) .

#2 . Setting the date of Tuesday, May 23, 2017 at 7 : 00 p.m. to accept
public comment and consider adopting an ordinance amending the zoning of
six parcels located at 527-559 East 2100 South Street from Community
Business District (CB) to Residential/Mixed Use District (R-MU-35) , and
amending the Central Community Master Plan Future Land Use Map pursuant
to Petition No . PLNPCM2016-0080 . The proposed changes would allow the
parcels to be developed as a multi-unit, mixed use structure with height
and density greater than what is currently found on site. Although the
applicant has requested that the properties be zoned to R-MU-35
Residential/Mixed Use District, the Council may consider rezoning the
properties to a different zoning district with similar characteristics

#3 . Setting the date of Tuesday, May 23, 2017 at 7 : 00 p.m. , to
accept public comment and consider adopting an ordinance amending the
zoning map for property located at 350 East 800 South Street from Low
Density Multi-Family Residential District (RMF-30) to Neighborhood
Commercial District (CN) , and amending the Central Community Master Plan
Future Land Use Map pursuant to Petition Nos . PLNPCM2016-00659 and
PLNPCM2016-00660 . The property has historically been used for commercial
uses, and was considered a non-conforming use. The last business license
issued for the property dates back to 2009, so the property is considered
to have abandoned its non-conforming use. The intent of the proposed
rezone is to re-establish a commercial use without being restricted by
a nonconforming classification. Although the applicant has requested
that the property be zoned Neighborhood Commercial District, the Council
may consider rezoning the property to a different zoning district with
