05/20/2003 - Minutes PROCEEDINGS OF THE CITY COUNCIL OF SALT LAKE CITY, UTAH TUESDAY, MAY 20 , 2003 The City Council of Salt Lake City, Utah, met in Regular Session on Tuesday, May 20, 2003 at 7:00 p.m. in Room 315, City Council Chambers, City County Building, 451 South State. The following Council Members were present: Carlton Christensen Van Turner Eric Jergensen Jill Remington Love Nancy Saxton Dave Buhler The following Councilmember was absent: Dale Lambert Mayor Ross C. "Rocky" Anderson; Edwin Rutan, City Attorney; Michael Sears, Council Budget and Policy Analyst; and Beverly Jones, Deputy City Recorder, were present. Councilmember Christensen presided at and Councilmember Saxton conducted the meeting. #1. The Council led the Pledge of Allegiance. #2. Councilmember Buhler moved and Councilmember Turner seconded to approve the minutes of the Salt Lake City Council meeting held May 8, 2003, which motion carried, all members present voted aye. (M 03-1) PUBLIC HEARINGS #1. RE: Accept public comment on Items A thru P and Item #2 and consider adopting an ordinance adopting the final budget, excluding the budget for the Library Fund which is separately adopted, and the Employment Staffing Document of Salt Lake City for Fiscal Year 2003-2004. (B 03-1) a) Accept public comment and consider adopting an ordinance appropriating necessary funds to implement for Fiscal Year 2003-2004 the provisions of the Memorandum of Understanding between Salt Lake City Corporation and Local 1004 of the American Federation of State, County and Municipal Employees (AFSCME) representing the 100 Series City employees, dated on or about July 1, 2002. (0 02-14) b) Accept public comment and consider adopting an ordinance appropriating necessary funds to implement for Fiscal Year 2003-2004 the provisions of the Memorandum of Understanding between Salt Lake City Corporation and Local 1004 of the American Federation of State, County and Municipal Employees (AFSCME) representing the 200 Series City employees, dated on or about July 1, 2002. (0 02-15) c) Accept public comment and consider adopting an ordinance appropriating necessary funds to implement for Fiscal Year 2003-2004 the provisions of the Memorandum of Understanding between Salt Lake City Corporation and Local 1645 of the International Association of Firefighters representing the 400 Series City employees, dated on or about July 1, 2002. (0 01-10) e) Accept public comment and consider adopting an ordinance approving the Compensation Plan for 600 Series and 300 Series employees. (0 03-12) f) Accept public comment and consider adopting an ordinance approving the Compensation Plan for 800 Series employees. (B 03-3) 1) Accept public comment and consider adopting the rate of tax levy upon all real and personal property within Salt Lake City made taxable by law for Fiscal Year 2003-2004. (B 03-6) m) Accept public comment and consider adopting an ordinance enacting Section 14.32.425 of the Salt Lake City Code, relating to telecommunication right-of-way permits, and establishing annual fees therefore. (0 03-17) n) Accept public comment and consider adopting an ordinance amending Section 15.16.031 and 15.16.035, Salt Lake City Code, relating to golf course green fees and group reservations. (0 99-36) o) Accept public comment and consider adopting an ordinance amending Section 12.56.170, Salt Lake City Code, relating to parking meter rates. (0 99-11) p) Accept public comment and consider adopting an ordinance amending Title 15 of 03 - 2 PROCEEDINGS OF THE CITY COUNCIL OF SALT LAKE CITY, UTAH TUESDAY, MAY 20, 2003 the Salt Lake City Code, relating to parks and recreation fees. (0 97-14) ACTION: Councilmember Jergensen moved and Councilmember Turner seconded to close the public hearing, which motion carried, all members present voted aye. Councilmember Christensen moved and Councilmember Buhler seconded to refer to a future Council meeting for consideration, which motion carried, all members present voted aye. DISCUSSION: Jerold Oldroyd said he was an attorney representing AT&T, Qwest, Comcast, Sierra Pacific, X-Cell and Touch America telecommunication companies. He urged the Council to meet with the industry to discuss their concerns. He said the proposed ordinance would have a detrimental impact on the industry. He said the proposed ordinance imposed 1) a gross revenue tax on revenue which might not even be generated in Salt Lake City or Utah, 2) proposed sales tax on equipment which might not be located in Utah, and 3) imposed a linear foot charge to access rights-of-way which would impact carriers that did not have a legal right to impact or utilize the rights-of-way. Aaron Syrett, Utah Film Commission, spoke about the proposed parking meter ordinance. He said the current ordinance required $50 per day to bag a meter. He said the proposed ordinance would change that amount to $10. He said he supported that amount. Marshall Moore spoke about the proposed parking meter ordinance. He said he worked in Utah as a location manager in the motion picture and television industry. He said one of his responsibilities was to secure parking for required support vehicles. He said when he returned to work last June he was surprised to learn the parking fee had increased from $10 per meter to $50 per meter per day. He said that increase had significantly affected their budget. Jeff Fox said he was concerned about the proposed telecommunication ordinance. He said high prices were charged on telecommunication rights-of-way. (B 03-1) #2. (B 03-2) QUESTIONS TO THE MAYOR FROM THE CITY COUNCIL Councilmember Turner asked when the new Westside police station would be completed. Mayor Anderson said he did not know the estimated time, but everything was on schedule. He said the station would be finished this summer. COMMENTS TO THE CITY COUNCIL Lonnie Pursifull spoke about the Gay Pride banners promoting homosexuality. Travis Bird said he did not want gay parades held in the City. Jan Bartlett said last week the Council discussed A-frame signs. He said he felt this was a non-ordinance because currently sandwich sign ordinances were not being enforced. Cindy Cromer said there were revisions authorizing a Land Use Appeals Board. She said the Board reviewed decisions of the Historic Landmarks Commission and the Planning Commission regarding conditional uses and subdivisions. She addressed the frustration and costs associated with the appeals. Douglas Cotant, Darla Ball, Dorothy Lane, Kenneth Wulle, Dan Smith, and Bill Tibbitts spoke against Utah Transit Authority's (UTA) proposal to raise fares from $1.25 to $1.50. CONSENT AGENDA ACTION: Councilmember Buhler moved and Councilmember Turner seconded to adopt the Consent Agenda, which motion carried, all members present voted aye. #1. RE: Setting the date of June 10, 2003 at 7:00 p.m. to accept public comment and consider adopting a resolution approving the lease rate provisions of a lease agreement between Salt Lake City Corporation and the Kostopulos Dream Foundation/Camp Kostopolus, Inc. , relating to approximately 15 acres of real property situated in Emigration Canyon. (Watershed) (C 03-288) #2. RE: Adopting Ordinance 27 of 2003 confirming the modified and equalized assessment rolls and levying an assessment against certain properties in the Salt Lake City, Utah Special Improvement District No. 101016, for the purpose of paying the costs of constructing improvements on certain streets in said City, including the replacement of all, or portions of deteriorated driveway approaches, CRITCHFIELD curb, gutter and sidewalks, the installation of sod, topsoil, sidewalk ramps; the removal of illegal driveways; and the installation of new curb, gutter and sidewalk street improvements where none previously existed and other miscellaneous work which is necessary to complete the above improvements; reaffirming the establishment and providing for the funding of a Special Improvement Guaranty fund; establishing the effective date of the ordinance; and related matters.
