10/13/2009 - Minutes PROCEEDINGS OF THE CITY COUNCIL OF SALT LAKE CITY, UTAH TUESDAY, OCTOBER 13, 2009 The City Council of Salt Lake City, Utah, met in Regular Session on Tuesday, October 13, 2009 at 7 : 00 p.m. in Room 315, City Council Chambers, City County Building, 451 South State . The following Council Members were present: Carlton Christensen JT Martin Eric Jergensen Jill Remington Love Soren Simonsen Luke Garrott The following Councilmember was absent: Van Turner Cindy Gust-Jenson, Executive Council Director; Edwin Rutan, City Attorney; David Everitt, Mayor' s Chief of Staff; and Scott Crandall, Deputy City Recorder; were present. Councilmember Christensen presided at and Councilmember Martin conducted the meeting. OPENING CEREMONY #1 . 7:05:40 PM The Council led the Pledge of Allegiance . #2 . 7:06:26 PM Councilmember Simonsen moved and Councilmember Garrott seconded to approve the minutes of the Salt Lake City Council meeting held October 6, 2009, which motion carried, all members present voted aye, except Councilmember Jergensen, who was absent for the vote . (M 09-1) PUBLIC HEARINGS #1. RE: 7:08:03 PM Accept public comment and consider adopting an ordinance amending certain sections of Title 21A Zoning, Salt Lake City Code, to provide additional clarity and consistency with existing City land use regulations regarding notice and appeals pursuant to Petition No. PLNPCM2009-00106 . View Attachments The following spoke or submitted written comments about the proposal : Steve Alder, Esther Hunter and Jim Jenkin. Comments included removing community councils from the approval process, limiting input, develop community partnerships, lack of public notice, community council representation and improving communication. (P 09-15) QUESTIONS TO THE MAYOR FROM THE CITY COUNCIL 7:24:32 PM Councilmember Martin asked about Mr. Everitt' s trip to Florida to accept an award on behalf of the City. Mr. Everitt said the Out and Equal Organization which advocates on lesbian, gay, bisexual and transgender workplace issues honored Salt Lake City with a significant achievement award. He said these awards had been issued over the past six or seven years and Salt Lake City was the first government entity to be a recipient. COMMENTS TO THE CITY COUNCIL 7:26:11 PM 09 - 134 PROCEEDINGS OF THE CITY COUNCIL OF SALT LAKE CITY, UTAH TUESDAY, OCTOBER 13, 2009 Amir Cornell spoke concerning options for sidewalk replacement in Sugar House and Proposition No. 1 . The Council asked Mr. Cornell to work with the Engineering Division to address sidewalk issues . Deb Dolph, Jeff Judge and Karen Guthrie spoke or submitted written comments in favor of the Parley' s Off-Leash Dog Park. Adam Guymon spoke concerning paper bins and dirt blocking access to the crosswalk button at the northeast corner of North Temple and 300 West. He said he had other concerns including building restrictions which made it difficult to receive satellite services . The Council asked City staff to work with Mr. Guymon to address his concerns . Aaron Brhemmer, Mindy Simpson, Jose Garcia, Shyanne Samuel, Jesus Ramos and Travis Bird spoke or submitted written comments in opposition of transferring the Sorenson Multi Cultural Center to Salt Lake County. Councilmember Love said for clarification, the Council was still waiting to receive a proposal/recommendation regarding the Sorenson Center. She said when the Council received a proposal, the public would be given adequate time to provide comments/suggestions before a decision was made . Annette Hansen, Amy Spendlove and Benjamin Rivkind spoke or submitted written comments in support of the proposal to allow chickens and beehives in residential areas . UNFINISHED BUSINESS #1 . RE: 7:58:59 PM Adopting an ordinance (The "2009 Assessment Ordinance") approving the assessment list and levying an annual assessment upon property in Salt Lake City, Utah Lighting District No. 2, known as L02 ("District L02") ; establishing the effective date of the 2009 Assessment Ordinance; providing for a procedure to contest an assessment; and related matters . RE: 8:02:31 PM Adopting a resolution authorizing the issuance and confirming the sale of up to $7 , 000 , 000 aggregate principal amount of Water and Sewer Revenue Bonds, Series 2009 of the City; authorizing the execution and delivery of certain documents relating to such bonds; and providing for related matters . View Attachments Jim Lewis, Public Utilities Finance Administrator, said the proposed resolution allowed the City to sell bonds worth $6 . 3 million to the State of Utah virtually interest free . He said this would result in a savings of approximately $150, 000 per year or roughly $3 million over twenty years . He said the amount was lower than originally anticipated because the actual bid price came in 24% below the engineers estimate . Councilmember Jergensen moved and Councilmember Simonsen seconded to adopt Resolution 56 of 2009, which motion carried, all members present voted aye . RE: Setting the date of Thursday, November 5, 2009 at 7 : 00 p.m. to accept public comment regarding the conclusions of a study performed under Utah Code Section 10-8-2 (3) , and making findings regarding value and public benefit, with respect to a donation agreement between the City and the Salt Lake City Bicycle Collective relating to unclaimed bicycles.
