10/14/2008 - Minutes PROCEEDINGS OF THE CITY COUNCIL OF SALT LAKE CITY, UTAH TUESDAY, OCTOBER 14, 2008 The City Council of Salt Lake City, Utah, met in Regular Session on Tuesday, October 14, 2008 at 7 : 00 p.m. in Room 315, City Council Chambers, City County Building, 451 South State . The following Council Members were present: Carlton Christensen JT Martin Van Turner Jill Remington Love Soren Simonsen Luke Garrott The following Councilmember was absent: Eric Jergensen Cindy Gust-Jenson, Executive Council Director; Edwin Rutan, City Attorney; David Everitt, Mayor' s Chief of Staff; and Scott Crandall, Deputy City Recorder; were present. Councilmember Love presided at and conducted the meeting. OPENING CEREMONY #1 . 7:04:14 PM The Council led the Pledge of Allegiance . #2 . 7:04:40 PM Councilmember Turner moved and Councilmember Christensen seconded to approve the minutes of the Salt Lake City Council meeting held October 7 , 2008, which motion carried, all members present voted aye . (M 08-3) PUBLIC HEARINGS #1 . RE: 7:04:54 PM Accept public comment and consider adopting ordinances rezoning property located at approximately 1812 South West Temple Street from Single-Family Residential (R-1/5000) zoning classification to Residential Multi-Family (RMF-45) zoning classification, amending the Salt Lake City Zoning Map and amending the Central Community Master Plan pursuant to Petition Nos . 400-08-20 and 400-08-21 (Requested by Salt Lake City Housing Authority) . View Attachments The following spoke or submitted written comments in opposition of the proposal : Harley Sisson, Mike Hardie, Ann Jimenez, Gary Gabrielson, Joe Nelson, Gordon Strickland and Julie Borchert. Comments included increased traffic, decreased property values, over- development, parking problems, no high-density developments, need for single family homes and open space, limited ingress/egress, increased crime, guarantee property will remain senior housing and increased garbage pick-up. 08 - 125 PROCEEDINGS OF THE CITY COUNCIL OF SALT LAKE CITY, UTAH TUESDAY, OCTOBER 14, 2008 Bill Nighswonger spoke in favor of the proposal . He said the development had 95 units with 104 parking spaces . He said the Housing Authority had a 99-year commitment for senior housing on the property. Jessica Berrett submitted a hearing card in favor of the proposal . Councilmember Simonsen moved and Councilmember Turner seconded to close the public hearing, which motion carried, all members present voted aye . 7:19:09 PM Council Members asked questions and discussed various aspects of the proposal with the developer and City staff to address issues involving traffic, parking, zoning standards, how to ensure the project would remain senior housing, tax credits, adding conditions to ordinance and development agreement, impact of delaying project, extent of public process/input/notification, eligibility requirements for senior housing, neighborhood concerns, incorporating design elements to enhance neighborhood compatibility, preserving Stanley F. Taylor home, mitigate impact on surrounding residents and 1700 South ingress/egress . Councilmember Simonsen moved and Councilmember Turner seconded to adopt Ordinance 79 of 2008 , rezoning property located at 1812 South West Temple from Single-Family Residential R-1/5,000 to Moderate/High Density Multi-Family Residential RMF-45 and amend the Central Community Master Plan and 1) establish as a condition of the rezoning that a development agreement be executed requiring that the Stanley F. Taylor home on this property be preserved in accordance with the National and Local Historic standards and guidelines, 2) further require that the Housing Authority submit an application and initiate the process to list the Stanley F. Taylor home formally on both the National Historic Register and the Salt Lake City Register of Cultural Resources, 3) that the development agreement include a provision limiting the occupancy to senior housing as presented by the applicant, and 4) the applicant would use their best efforts to establish an access from the property to 1700 South, and further moved to include a Legislative Intent that would further develop the design to include possible walk-up entries to ground floor units on the units facing the driveway or street within the project to further promote street access and activity, which motion carried, all members present voted aye . RE: 8:10:22 PM Accept public comment and consider adopting an ordinance amending Salt Lake City Ordinance 64 of 2008 which adopted the final budget of Salt Lake City, Utah, for the Fiscal Year beginning July 1, 2008 and ending June 30, 2009 (Budget Amendment No . 1) . View Attachments 08 - 126 PROCEEDINGS OF THE CITY COUNCIL OF SALT LAKE CITY, UTAH TUESDAY, OCTOBER 14, 2008 Councilmember Christensen moved and Councilmember Simonsen seconded to continue the public hearing to a future date, which motion carried, all members present voted aye . Councilmember Simonsen moved and Councilmember Martin seconded to adopt Ordinance 80 of 2008 , amending the Fiscal Year 2008-2009 budget as proposed by the Administration, with the exception of the following changes : 1) reduce the funding in Item I-1 for Human Resource/Compensation Audit from $85,000 to $52 ,000, which will fund only Phase One of the audit. Additionally, the $52 ,000 will be split between the General Fund in the amount of $34 ,700; the Airport Fund in the amount of $9,100; the Public Utilities Funds in the amount of $5,800; and the Internal Service Funds in the amount of $2 ,400 and Phase Two of the audit will be placed on hold until a future date and 2) exclude Item A-4, which would be considered separately, which motion carried, all members present voted aye . Councilmember Simonsen moved and Councilmember Christensen seconded to adopt Ordinance 80 of 2008, approving Item A-4 , relating to the Public Service Maintenance "Fleet" Facility construction, which motion carried, all members present voted aye, except Councilmember Martin, who voted nay. (B 08-9) COMMENTS TO THE CITY COUNCIL 8:24:20 PM Scott Maruri spoke concerning potential savings by having all garbage cans moved to one side of the street to reduce the number of trips required for pick-up . Thomas Rodgers submitted written comments and spoke concerning the need to have mobile homes inspected for possible defects relating to carbon monoxide poisoning. UNFINISHED BUSINESS #1 . RE: 8:33:11 PM Adopting an ordinance amending Section 12 .56.205, Salt Lake City Code, pertaining to parking meters - no charge for alternative fuel, fuel efficient and low polluting vehicles . View Attachments Councilmember Simonsen moved and Councilmember Garrott seconded to adopt Ordinance 81 of 2008, amending Section 12 . 56 .205 pertaining to free metered parking for alternative fuel, fuel efficient and low polluting vehicles and further moved to adopt a Legislative Intent that the Administration continue to pursue providing more parking spaces for 08 - 127 PROCEEDINGS OF THE CITY COUNCIL OF SALT LAKE CITY, UTAH TUESDAY, OCTOBER 14, 2008 scooters and motorcycles with two or three wheels, and that free parking for those vehicles be allowed based on the best available emission and fuel efficiency standards available for two or three wheeled motorcycles, which motion carried, all members present voted aye . RE: 8:34:03 PM Adopting an ordinance amending Section 12 .56. 170, Salt Lake City Code, relating to parking meter rates - to waive fees at parking meters from November 27, 2008 through January 1, 2009 to allow for two-hour free parking. RE: Adopting Ordinance 83 of 2008 (The "2008 Assessment Ordinance") approving the assessment list and levying an annual assessment upon property in Salt Lake City, Utah Lighting District No. 2, known as L02 ("District L02") ; establishing the effective date of the 2008 Assessment Ordinance; providing for a procedure to contest an assessment; and related matters .
