TUESDAY, OCTOBER 21 , 2014
The City Council of Salt Lake City, Utah, met in Regular Session
on Tuesday, October 21, 2014 at 7 : 30 p.m. in Room 315, City Council
Chambers, City County Building, 451 South State.
The following Council Members were present:
James Rogers Luke Garrott Kyle LaMalfa
Erin Mendenhall Lisa Adams Charlie Luke
Stan Penfold
Cindy Gust-Jenson, Executive Council Director; Jill Remington
Love, Mayor' s Deputy Chief of Staff; Margaret Plane, City Attorney;
Candee Allred, Assistant City Recorder; and Beverly Jones, Deputy City
Recorder; were present.
Councilmember Luke presided at and Councilmember Adams conducted
the meeting.

Mendenhall seconded to approve the minutes of the following Salt Lake
City Council meetings , which motion carried, all members voted aye
except Councilmember Garrott who was absent for the vote .

PUBLIC HEARINGS
#1 . RE : 7 : 37 : 52 PM Accept public comment and consider adopting an
ordinance amending various provisions of Salt Lake City Code
concerning the Consolidated Fee Schedule pursuant to Petition No.
PLNPCM2014-00016 . The proposal would clarify vague, missing, or non-
standardized language in code that authorizes fee collection,
particularly related to zoning regulations. The proposal also
clarifies that fees are not required for petitions from the Mayor,
City Council, or Planning Commission, or for historic preservation
applications, including new local historic and character conservation

Councilmember Garrott moved and Councilmember LaMalfa seconded to
close the public hearing and adopt Ordinance 54 of 2014, which motion
carried, all members voted aye . (See file 0 11-9)

COMMENTS TO THE CITY COUNCIL 7 :40 : 04 PM (Comments are taken on any
item not scheduled for a public hearing, as well as on any other City
business. Comments are limited to two minutes)
Oscar Ross, Jr. spoke about police brutality. Patsy Rose spoke
about training police officers on how to handle dogs . She said there
needed to be hands-on training and a desire to do better. Ryan
Peltekian said he felt the Police Civilian Review Board was biased.
Merle French said a comment had been made that the Justice For Geist
Group was overreacting about deadly force . She said they were serious
about the changes that needed to be made with the police force.
Susan Barretta spoke about police protocol . She said transparency
was needed. Sean Kendall thanked the Council for the briefing with
Police Chief Chris Burbank. He said hands-on animal encounter training
by a certified animal expert was the only direction to move forward to
adequately provide safety for the animal and for the officer.
Kevin Page read a letter written by his daughter about holding
police officers accountable for their actions . Doug Vernon spoke about
the Police Civilian Review Board and the exoneration of the police
officer who shot Geist . Catrina Melton said there was a video of an
officer calling a dog to him and shooting the dog. She said there
needed to be penalties .
Julie Page did not wish to speak but submitted a hearing card on
holding police officers accountable .
Polly Hart said she took her dog to Parley' s Nature Park. She
said the fences were not acceptable and park access consisted of a
narrow corridor from one end to the other, no shade, and two stream
accesses . She said the management plan called for soft natural
barriers, education, and some temporary fencing.
UNFINISHED BUSINESS
#1 . RE: 8 : 00 :28 PM Adopting a resolution which includes the
remaining Capital Improvement Program (CIP) allocations for Fiscal
Year 2014-15 . Capital improvements involve the construction purchase,
or renovation of buildings, parks, streets, or other physical

structures. Generally, projects have a useful life of five or more
years and cost $50, 000 or more. View Attachments
Councilmember Luke moved and Councilmember Garrott seconded to
approve the Fiscal Year 2014-2015 Capital Improvement Program Budget
contingent on the following three items; 1) approximately 1500 square
feet of the proposed Sugar House station being designed to house a
police function with the policy goal of increasing police presence in
the neighborhood; 2) utilize impact fees to supplement the McClelland
Trail project and allocate the remaining $107 ,400 of available bond
funds for one or a combination of the following projects contingent on
approval of bond counsel - a) purchase real property that would help
secure the future of the Trans Valley Corridor project, b) improve the
conditions upon the 9 Line Trail through irrigation, lighting,
landscaping, and/or other bond-eligible projects as discussed in the
9-Line Master Plan, and 3) design and construct a Gateway to the 9-
Line under the I-15 overpass also as discussed in the 9-Line Master
Plan; and further move that the Council approve the funding contingent
on the Administration not extending the protected bike lanes on 300
South either onto 1100 East or beyond 1100 East, which motion carried,
all members voted aye . (Note: This item was approved by a motion only,
not by a resolution as indicated in the agenda language)

Councilmember LaMalfa moved and Councilmember Luke seconded to
adopt the Consent Agenda, which motion carried, all members voted aye .
#1 . RE: Setting the date of Tuesday, November 18, 2014 at 7 : 00
p.m. to accept public comment and consider adopting an ordinance
amending the Zoning Map to establish the Yalecrest-Harvard Park Local
Historic District for properties located on the north and south sides
of Harvard Avenue between 1700 and 1800 East pursuant to Petition No .

#2 . RE: Setting the date of Tuesday, November 18, 2014 at 7 : 00
p.m. to accept public comment and consider adopting an ordinance
amending City zoning regulations for Nonconforming Uses and
Noncomplying Structures and related sections of Salt Lake City Code
pursuant to Petition No . PLNPCMN2009-00167 . The amendments will limit
expansion of nonconforming uses by addressing compatibility concerns
regarding enlargement and intensification of nonconforming uses and
noncomplying structure. The proposed amendments include: View
