TUESDAY, SEPTEMBER 17 , 2002
The City Council of Salt Lake City, Utah, met in Regular Session on Tuesday, September
17, 2002 at 7:00 p.m. in Room 315, City Council Chambers, City County Building, 451
South State.
The following Council Members were present:
Carlton Christensen Dale Lambert Eric Jergensen
Jill Remington Love Dave Buhler Nancy Saxton
Van Turner
Rocky Fluhart, Chief Administrative Officer; Steven Allred, Acting City Attorney;
Cindy Gust-Jenson, Executive Council Director; and Pam Johnson, Deputy City Recorder
were present.
Councilmember Buhler presided at and Councilmember Love conducted the meeting.
#1. The Council led the Pledge of Allegiance.
#2. Councilmember Jergensen moved and Councilmember Saxton seconded to approve the
minutes of the Salt Lake City Council meeting held September 10, 2002, which motion
carried, all members voted aye.

QUESTIONS TO THE MAYOR
Councilmember Lambert asked the administration to respond to Mr. Clara, Ms. Gonzales
and Mr. Smedley' s concerns with the Union Pacific Passenger Intermodal Center. D.J.
Baxter, the Mayor's Senior Advisor, said the current Environmental Assessment primarily
looked at two issues. He said the first was the Intermodal's location and the second
was how the Hub would impact the neighborhood. He said if a re-evaluation concluded
the Intermodal Hub should be located elsewhere, it would not change the operation of
freight trains on 900 South. He said commuter and freight trains ran on separate lines
so the Hub location made no difference. He said many issues were being looked at to
help keep the impact on the neighborhood minimal.
COMMENTS TO THE CITY COUNCIL
Michael Clara, Janette Gonzales and Mark Smedley spoke in reference to Environmental
Assessment for Passenger Intermodal Center. They said the public had not been given
enough information to make an informed decision.
Gail Milliken, Salt Lake City, thanked the Council for addressing ADA access ramps and
sidewalk repair. She said the downtown police substation was unmanned during weekdays.
Robert Joseph and Bruce Oliver requested the City Council investigate personal
employment issues.
Joy Gingrich, Chayo Gallegos, Kevin Gingrich, Haley McCauley, Kevin Urien, Crystal
Gage-Urien and Aaron McCauley spoke in favor of relocating the Taco Vending Carts
downtown in the Central Business District
Ray Agutter, Heber Rodriguez, Jaime Rosas, Jamie Castillo, Javier Sanchez, Maria
Gonzolez, Israel Henandez, Silvio Hernandez, Juan Gomez, John Guyen, Julie Swaner, and
Anastacio Castillo spoke in favor of allowing Taco Vending Carts to remain in their
current locations.

Ryan Gallegos, Patricia Samul, Gail Milliken and Paula Keirnan submitted comments cards
on the Vending Cart issues, but did not speak.
Brent Hardy, Rob Sivulka, Mark Van Gorden, Kurt Van Gorden and Cindy Van Gorden, spoke
in reference to distributing religious materials in Downtown Salt Lake City.
Gail Milliken submitted a comment card on this issue, but did not speak.
PUBLIC HEARINGS
#1. RE: Accept public comment and consider adopting an ordinance amending Salt Lake
City Ordinance 32 of 2001 which approved, ratified and finalized the Biennial Budget
of Salt Lake City, Utah, including the Employment Staffing Document, for the Fiscal
Years beginning July 1, 2001 and ending June 30, 2002 and beginning July 1, 2002 and
ending June 30, 2003.
ACTION: Councilmember Saxton moved and Councilmember Jergensen seconded to close the
hearing, which motion carried, all members voted aye.
Councilmember Jergensen moved and Councilmember Turner seconded to adopt Ordinance 60
of 2002, amending the fiscal year 2002-2003 budget as proposed with the exception of
Initiative No. 15 (which will be considered in a separate motion) and $318, 932 in
Initiative No. 27. The Council will continue consideration of the $318, 932 request
for the 200 East cross walk until a later time, but as part of Budget Amendment No. 9,
which motion carried, all members voted aye.
Councilmember Buhler moved to go back to Budget Amendment No. 9, Item No. 15 and
Councilmember Lambert recused himself from the vote and left the room.
Councilmember Buhler moved and Councilmember Saxton seconded to adopt Item No. 15 in
the budget amendment, which motion carried, all members voted aye, except for
Councilmember Lambert who was recused.
DISCUSSION: Councilmember Saxton said she would vote in favor of the ordinance, even
though she wanted the Library block monies phased in rather than the entire amount
given all at once.

#2. RE: Accept public comment and consider adopting a resolution amending Salt Lake
City Resolution 37 of 2001 which adopted the Biennial Budget of the Municipal Building
Authority of Salt Lake City, Utah, for the Fiscal Years beginning July 1, 2001 and
ending June 30, 2002 and beginning July 1, 2002 and ending June 30, 2003. View

ACTION: Councilmember Saxton moved and Councilmember Jergensen seconded to recess as
the City Council and convene as the Municipal Building Authority, which motion carried,
all members voted aye.
Councilmember Saxton moved and Councilmember Lambert seconded to close the hearing,
which motion carried, all members voted aye.
Councilmember Christensen moved and Councilmember Lambert seconded to adopt Resolution
48 of 2002, which motion carried, all members voted aye.
Councilmember Saxton moved and Councilmember Christensen seconded to adjourn as the
Municipal Building Authority, and reconvene as City Council, which motion carried, all

#3. RE: Accept public comment and consider adopting an ordinance amending Section
8.04.500, Salt Lake City Code, pertaining to violation - penalty; amending Section
8.04.510, Salt Lake City Code, pertaining to issuance of citations - notice of
violations; and amending Appendix A to Chapter 8.04, Salt Lake City Code, regarding
Salt Lake City Animal Services permits and fees.
ACTION: Councilmember Saxton moved and Councilmember Buhler seconded to close the
hearing, which motion carried, all members voted aye.
Councilmember Christensen moved and Councilmember Saxton seconded to adopt Ordinance
61 of 2002, which motion carried, all members voted aye.
DISCUSSION: Gail Milliken, Salt Lake City, asked what the requirements of ownership
were and how many animals could one household have. She asked if licenses could be
withheld if numerous complaints had been called in due to excessive barking.
Councilmember Love referred Ms. Milliken to Jan Aramaki of Council Staff to follow-up
with her concerns. Councilmember Christensen said many of the issues Ms. Milliken had
questioned were addressed in prior ordinances. Councilmember Saxton said she wanted to
see pet adoption and licensing streamlined to encourage more pet placements in good
homes.

#4. RE: Adopting a resolution authorizing the approval of an interlocal cooperation
agreement between Salt Lake City Corporation and Utah Department of Transportation for
construction of a pedestrian safety project consisting of installing pedestrian access
ADA ramps and replacing defective sidewalk on 700 East between 900 South and 1700
South.
ACTION: Councilmember Buhler moved and Councilmember Jergensen seconded to adopt
Resolution 51 of 2002, which motion carried, all members voted aye.

#5. RE: Adopting a resolution authorizing the approval of an interlocal cooperation
agreement between Salt Lake City Corporation and Utah Department of Transportation for
construction and maintenance of the sidewalk on the west side of Redwood Road between
400 South and Indiana Avenue.
ACTION: Councilmember Buhler moved and Councilmember Jergensen seconded to adopt
Resolution 52 of 2002, which motion carried, all members voted aye.

collaborative effort between the City and the Salt Lake Area Chapter of the American
Red Cross to explore the possibility of joint planning, construction and cohabitation
