09/17/2019 - Formal Meeting - Minutes MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, SEPTEMBER 17 , 2019 The City Council of Salt Lake City, Utah, met in Formal Session on Tuesday, September 17, 2019 in Room 315, Council Chambers, City County Building, 451 South State . The following Council Members were present : Andrew Johnston James Rogers Amy Fowler Charlie Luke Chris Wharton Analia Valdemoros The following Councilmember was absent : Erin Mendenhall Cindy Gust-Jenson, Council Executive Director; Lynn Pace, Acting City Attorney; David Litvack, Mayor' s Deputy Chief of Staff; and Kory Solorio, Assistant City Recorder were present . Councilmember Luke presided at and Councilmember Fowler conducted the meeting. The meeting was called to order at 7 : 01 p .m. OPENING CEREMONY #1 . 7 :01:44 PM The Pledge of Allegiance #2 . 7 :02 :00 PM Welcome and Review of Standards of Conduct #3 . 7 :03:48 PM Councilmember Luke moved and Councilmember Rogers seconded to approve the formal meeting minutes of Tuesday, August 27 , 2019 and Tuesday, September 3, 2019, which motion carried, all members present voted aye . View Minutes (M 19-3) PUBLIC HEARINGS #1 7 :04 :13 PM Block 67 North Community Reinvestment Area Plan and Interlocal Agreement with the Redevelopment Agency of Salt Lake City on two related items and consider: 1 . Adopting an ordinance that would authorize approval of the Block 67 North Community Reinvestment Area (CRA) Plan; and 2 . Adopting a resolution that would approve an interlocal agreement between Salt Lake City Corporation and the Redevelopment Agency of Salt Lake City (RDA) to use a portion of tax increment for this project area. 19 - 1 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, SEPTEMBER 17 , 2019 These actions would authorize the RDA to receive 75% of the City's portion of tax increment for the Block 67 North CRA during a period of 20 years. View Attachments Brent Koga (hearing card only) submitted written comments stating he was pleased with the City and the RDA for trying to ensure that Japantown was not completely overrun by development . He also emphasized frustration with the loss of public use (street parking) for private development with public money. Councilmember Luke moved and Councilmember Rogers seconded to close the public hearing on: a) The Block 67 North Community Reinvestment Area (CRA) Project Area Plan, and b) The Interlocal Agreement between Salt Lake City Corporation and the Redevelopment Agency of Salt Lake City authorizing use of a portion of tax increment for the Block 67 North CRA, which motion carried, all members present voted aye . (T 19-2) #2 . 7 :05:29 PM Adopting an ordinance for the first amendment to the final budget of Salt Lake City, including the employment staffing document, for Fiscal Year 2019-20 . Budget amendments happen several times each year to reflect adjustments to the City's budgets, including proposed project additions and modifications. The proposed amendment includes funding for a contract to improve school crossing guard staffing, and increasing funding to add art elements to capital projects, among other changes. Councilmember Luke moved and Councilmember Rogers seconded to close the public hearing and refer the item to a future date for action, which motion carried, all members present voted aye . (B 19-9) COMMENTS TO THE CITY COUNCIL 7 :06:08 PM Jeff Silvestrini, Millcreek Mayor, spoke to the resolution being considered for adoption between Millcreek and Salt Lake City authorizing a proposed Boundary Adjustment and Interlocal Agreement . He expressed his thanks to the Council Members who helped work out the resolution. He said he believed it was for the benefit of both cities and he looked forward to a long relationship of cooperation with the City. UNFINISHED BUSINESS #1 . 7 :07 :27 PM Authorizing an interlocal agreement between Salt Lake City Corporation and Millcreek regarding boundary adjustments . The 19 - 2 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, SEPTEMBER 17 , 2019 proposal involves adjusting the cities' boundaries in an area bordered by 1300 East Street and Highland Drive, and Miller Avenue and Woodland Avenue, with land moving from Salt Lake City's jurisdiction to the City of Millcreek. The proposal would also move a roundabout to Millcreek's jurisdiction at approximately 2300 East Street and 2700 South Street. Salt Lake City would receive an agreed-upon amount of tax revenue in exchange for the boundary adjustment. The proposal is the result of a collaborative process involving elected officials from both cities over the past several months. View Attachments Councilmember Luke thanked Millcreek Mayor Silvestrini and Councilmember Marchant for their work on the proposal . He said it showed what could happen when two cities worked together. He said he believed the relationship that developed during the process would last throughout the current positions of the Salt Lake City and Millcreek Council and Mayors and would stretch to future elected officials as well . Councilmember Fowler also thanked Millcreek Mayor Silvestrini and Councilmember Marchant for attending the meeting. She said it had been a learning process for everyone over the last nine months . She said she believed it could certainly be used as an example for other cities in working out their own issues with one another. She thanked everyone for all the hard work that was put into the proposal . Councilmember Luke moved and Councilmember Rogers seconded to adopt Resolution 25 of 2019 which motion carried, all members present voted aye . (R 19-11) #2 . 7:10:00 PM Authorizing approval of five interlocal cooperation agreements between Salt Lake City Corporation and Salt Lake County providing for the transfer of County transportation funds on reimbursement basis for certain transportation projects within Salt Lake County and Salt Lake City. These projects include the planning, design, and/or construction of: • Life on State improvements between 600 South Street and 900 South Street on State Street. • Sugar House greater area circulation study and transit alternatives analysis. • 200 South Street transit corridor and multi-modal transit hub between 600 West Street and 900 East Street. • North Temple multi-modal bus hub near North Temple Street and Redwood Road. • 900 South Street multi-use, urban trail from 600 West Street to Lincoln Street. View Attachments 19 - 3 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, SEPTEMBER 17, 2019 Councilmember Fowler acknowledged the hard work done under the leadership of Jennifer McGrath, Community and Neighborhoods Acting Director, along with Transportation for the quick turnaround in getting the grants to Salt Lake County and ensuring they were received. She said one of the grants included Millcreek and Holladay Cities and was an opportunity to look at increasing public transportation (between all three cities) . She said she was excited for the opportunity to increase public transportation in the City. Councilmember Wharton moved and Councilmember Luke seconded to adopt Resolution 26 of 2019 authorizing approval of five Interlocal Cooperation Agreements between Salt Lake City and Salt Lake County providing for the transfer of County transportation funds on a reimbursement basis for certain transportation projects within Salt Lake County and Salt Lake City, which motion carried, all members present voted aye . (R 19-12) CONSENT 7:11:55 PM Councilmember Luke moved and Councilmember Wharton seconded to approve the Consent Agenda, which motion carried, all members present voted aye . #1. Setting the date of Tuesday, November 19, 2019 at 7 :00 p.m. to accept public comment regarding a proposed ordinance adjusting Salt Lake City' s common boundary with Millcreek. Salt Lake City and Millcreek have proposed to modify the incorporated boundaries of each city in order to remove parcels of property from Salt Lake City and incorporate them into Millcreek. The cities will consider a resolution indicating the municipal legislative bodies' respective intents to adjust a boundary that the municipalities have in common, and to thereby transfer from Salt Lake City jurisdictional territory to Millcreek jurisdictional territory certain parcels, together with adjacent portions of the right-of-way, located at 3135 South Richmond Street, 1350 East Miller Avenue, 1354 East Miller Avenue, 3142 South Highland Drive, 3144 South Highland Drive, 1345 East Woodland Avenue, 1337 East Woodland Avenue and 1311 East Woodland Avenue, as well as Utah Department of Transportation property that encompasses but is not limited to a roundabout situated at approximately 2300 East and 2700 South. The properties to be transferred to Millcreek's jurisdictional territory, including but not limited to the parcels identified above, are more fully identified on the proposed Final City Plats that are currently being prepared. The properties to be transferred are also identified in "Draft renderings of interlocal adjustment areas" to this agenda item. The request has been made so that the properties in question can be developed and maintained in accordance with Millcreek's vision for its city center and the roundabout separately 19 - 4 MINUTES OF THE SALT LAKE CITY COUNCIL TUESDAY, SEPTEMBER 17 , 2019 as a gateway to Millcreek. The Salt Lake City Council will adjust the above-referenced boundaries unless, at or before the public hearing, a written protest to the adjustment is filed by a property owner described in Utah Code Subsections 10-2-419 (3) (d) or 10-2-419 (4) (d) . The areas subject to the boundary adjustment will, because of the boundary adjustment, be automatically annexed to a local district providing fire protection, paramedic, and emergency services or a local district providing law enforcement service as set forth in Utah Code Section 17B- 1-416. The areas subject to the boundary adjustment will, because of the boundary adjustment, be automatically withdrawn from Salt Lake City- provided fire protection, paramedic, emergency services and law enforcement services, as set forth in Utah Code Section 17B-1-502. Setting the date of Tuesday, October 8, 2019 at 7 : 00 p.m. to accept public comment and consider adopting an ordinance that would authorize temporarily closing a portion of 2100 South Street between approximately SR-201 and 7200 West Street. Modified access to area businesses will be maintained during the closure. The reason for the temporary closure is repeated illegally dumped tires and other debris in the area. Sensitive wetlands in the area have also been degraded by the illegal activity. The temporary closure would allow municipal and community organizations to draft plans for enforcement and clean up for the area. View Attachments (0 19-12) #3 .
