TUESDAY, SEPTEMBER 3, 2019
The City Council of Salt Lake City, Utah, met in Formal Session on
Tuesday, September 3, 2019 in Room 315, Council Chambers, City County
Building, 451 South State .
The following Council Members were present :
Amy Fowler Charlie Luke Analia Valdemoros
Chris Wharton Erin Mendenhall Andrew Johnston
The following Councilmember was absent :
James Rogers
Jennifer Bruno, Council Executive Deputy Director; Lynn Pace,
Acting City Attorney; and Scott Crandall, Deputy City Recorder; were
present .
Councilmember Luke presided at and Councilmember Fowler conducted
the meeting.
The meeting was called to order at 7 : 03 p .m.
OPENING CEREMONY

#3 . 7 :06:05 PM Councilmember Mendenhall moved and Councilmember Luke
seconded to approve the Work Session meeting minutes of Tuesday, July
16, 2019; and Tuesday, August 6, 2019 as well as the Formal meeting
minutes of Tuesday, August 20 , 2019; and the Special Formal meeting
minutes of Tuesday, August 20, 2019, which motion carried, all members

POTENTIAL ACTION ITEMS :
#1 . 7 :05:33 PM Adopting an ordinance that would amend the zoning of
a portion of property located at 650 East South Temple Street from
Institutional District (I) to Residential/Office District (RO) and
amending the Central Community Master Plan Future Land Use Map from
Institutional to Residential/Office Mixed-use pursuant to Petition No .
PLNPCM2019-00230 and Petition No . PLNPCM2019-00231 . The intent of the
proposal is to allow more flexibility to develop a future multi-family
residential, office or mixed-use development. No site plan has been
submitted at this time. Although the applicant has requested that the

property be rezoned to Residential/Office District (RO) , consideration
may be given to rezoning the property to another zoning district with
similar characteristics. View Attachments
Councilmember Luke moved and Councilmember Valdemoros seconded to
adopt Ordinance 43 of 2019, amending the Central Community Master Plan
zoning map for the Masonic Temple located at 650 East South Temple, which
motion carried, all members present voted aye .

#2 . 7 :06:36 PM Adopting an ordinance that would amend various
sections of Title 21A of Salt Lake City Code pertaining to the D-2
Downtown Support District design standards pursuant to Petition No .
PLNPCM2018-00118 . The proposal would add design standards for new
construction and allow projecting signs in the D-2 Downtown Support
District, among other changes. If adopted, the proposed design standards
would implement some recommendations of the Downtown Master Plan, which
the City Council adopted in May 2016. Other related provisions of Title
21A may be amended as part of this petition (Petitioner: Mayor Jackie

Councilmember Valdemoros moved and Councilmember Wharton seconded
to adopt Ordinance 44 of 2019, amending the Salt Lake City Code
pertaining to design standards in the D-2 zoning district and further
moved that the Council adopt the following legislative intent and action:
• It is the intent of the Council that the Administration continue its
work to prepare an ordinance that would define the term "affordable
housing" more precisely and that would create a City-wide overlay zone
pertaining to affordable housing.
• That the Council adopt a legislative action initiating a review of
fencing requirements in downtown zoning districts, including possible
changes to fencing standards in the front yards and side yards along
public rights-of-way, which motion carried, all members present voted
aye .

#3 . 7 :07 :58 PM Adopting an ordinance that would amend the table of
permitted and conditional uses for Transit Station Area Districts in
Section 21A.33 . 035 to add "Restaurant with drive-through facility" as a
conditional use pursuant to Petition No . PLNPCM2018-00575 . The proposal
would amend the text of the Transit Station Area Mixed-Use Economic
Center Transitional (TSA-MUEC-T) district to allow drive-through windows
for restaurants as a conditional use with additional criteria . Currently,
drive-throughs are only allowed for financial institutions in the TSA-
MUEC-T district. Other related provisions of Title 21A may be amended as

Councilmember Johnston moved and Councilmember Luke seconded to
adopt Ordinance 45 of 2019, amending the Table of Permitted and
Conditional Uses for the TSA-MUEC T zoning district to add "Restaurant
with drive-through facility" as a conditional use and include qualifying
provisions for the use, which motion carried, all members present voted
aye, except Councilmember Mendenhall, who voted nay.

#4 . 7:08:52 PM Adopting an ordinance that would amend the zoning map
pertaining to two (2) parcels located at approximately 868 East 2700
South Street and 2716 South 900 East Street to rezone those parcels from
Single Family Residential District (R-1/7 , 000) to Single Family
Residential District (R-1/5,000) pursuant to Petition No. PLNPCM2016-
00577 . The changes would allow the developer to create five, single-
family residential units from the two properties. Although the applicant
has requested that the property be rezoned to R-1/5, 000 (Single Family
Residential District) , consideration may be given to rezoning the
property to another zoning district with similar characteristics (27th
Street Cottages) . View Attachments
Councilmember Luke moved and Councilmember Valdemoros seconded to
adopt Ordinance 46 of 2019, rezoning two parcels located at 868 East
2700 South and 2716 South 900 East to R-1/5, 000, which motion carried,
all members present voted aye .

QUESTIONS TO THE MAYOR FROM THE CITY COUNCIL 7:09:48 PM

COMMENTS TO THE CITY COUNCIL 7:10:16 PM
Denise Taylor expressed concerns about the increasing number of e-
scooters in downtown which were extremely threatening/dangerous to
pedestrians . She said they were impacting walkability and should never
be allowed on sidewalks . She said something needed to be done to provide
a safe environment for pedestrians . Councilmember Wharton asked Staff to
meet with Ms . Taylor to address her concerns .
UNFINISHED BUSINESS
#1 . 7:13:26 PM Adopting a resolution that would authorize approval
of an interlocal cooperation agreement between Salt Lake City Corporation
and Salt Lake County providing for Salt Lake County to provide animal
control services within Salt Lake City. The existing interlocal agreement
with the County initially had an expiration date of June 30, 2019,

however in June the Council adopted a 90-day extension to continue
services through September 30, 2019. If approved, the new contract with
the County would provide animal control services through June 20, 2022.

to adopt Resolution 24 of 2019, which motion carried, all members present
voted aye .

#2 . 7:14:44 PM Adopting an ordinance that would authorize release
of funds from Funding Our Future revenues holding account. The Council
appropriated $1, 775, 000 to the Fiscal Year 2020 Budget Holding Account
to fund housing programming proposed in the Mayor's Recommended Budget.
These funds are expected to be generated by the Funding Our Future (sales
tax increment) revenues, and were placed in the holding account until
the Council approved a process to distribute these funds. View

adopt Ordinance 47 of 2019, authorizing release of $1,775,000 for housing
programming from the Funding Our Future (Sales Tax) revenues holding
account, which motion carried, all members present voted aye.

CONSENT 7:15:25 PM
Councilmember Luke moved and Councilmember Wharton seconded to
approve the Consent Agenda, which motion carried, all members present
voted aye .
#1 . Setting the date of Tuesday, September 17 , 2019 at 7 : 00 p.m.
to accept public comment and consider adopting an ordinance for the first
amendment to the final budget of Salt Lake City, including the employment
staffing document, for Fiscal Year 2019-20 . Budget amendments happen
several times each year to reflect adjustments to the City's budgets,
including proposed project additions and modifications. The proposed
amendment includes funding for a contract to improve school crossing
guard staffing, among other changes. (Budget Amendment No. 1) View

#2 . Setting the date of Tuesday, October 15 , 2019 at 7 : 00 p.m. to
accept public comment and consider a request to close a City-owned alley
located at approximately 1000 South between 800 West and Jeremy Street
(850 W) pursuant to Petition No . PLNPCM2018-00666 . The alley is
referenced as Mead Avenue but the City recognizes it as an alley rather

than a street. The applicant's reason for the request includes a concern
about crime in the area, and the request received the necessary support
of abutting property owners. However, the Planning Commission forwarded
