09/30/2008 - Minutes PROCEEDINGS OF THE CITY COUNCIL OF SALT LAKE CITY, UTAH TUESDAY, SEPTEMBER 30 , 2008 The City Council of Salt Lake City, Utah, met in Regular Session on Tuesday, September 30, 2008 at 7 : 00 p.m. in Room 315, City Council Chambers, City County Building, 451 South State . The following Council Members were present: Carlton Christensen Van Turner Eric Jergensen Jill Remington Love JT Martin Luke Garrott Soren Simonsen Cindy Gust-Jenson, Executive Council Director; Edwin Rutan, City Attorney; Mayor Ralph Becker; David Everitt, Mayor' s Chief of Staff; and Christine Meeker, City Recorder; were present. Councilmember Love presided at and Councilmember Turner conducted the meeting. OPENING CEREMONY #1 . 6 : 59 : 46 PM The Council led the Pledge of Allegiance. #2 . 7 : 00 : 12 PM Councilmember Simonsen moved and Councilmember Christensen seconded to approve the minutes of the Salt Lake City Council meeting held September 9, 2008, which motion carried, all members voted aye . (M 08-3) PUBLIC HEARINGS #1 . 6 : 59 : 15 PM RE : Accept public comment and consider adopting an ordinance rezoning a portion of property located at 431 South 300 East and amending the Zoning Map pursuant to Petition No. 400-08-06 . (Wyndham Resort Development) See Attachments P 08-13 This item was tabled. #2 . 7 : 01 : 28 PM RE: Accept public comment and consider adopting an ordinance amending the text of Section 21A. 46. 070 of the Salt Lake City Code pertaining to Temporary Signs, and enacting Section 21A. 46 . 180 of the Salt Lake Code, pertaining to Construction Impact Mitigation Signs pursuant to Petition No. 400-08-16 . See Attachments Councilmember Jergensen moved and Councilmember Christensen seconded to close the public hearing, which motion carried, all members voted aye . 08 - 55 PROCEEDINGS OF THE CITY COUNCIL OF SALT LAKE CITY, UTAH TUESDAY, SEPTEMBER 30 , 2008 Councilmember Christensen moved and Councilmember Simonsen seconded that the City Council adopt Ordinance 77 of 2008, amending the text of Section 21A. 46 . 070 of the Salt Lake City Code, pertaining to temporary signs, and enacting Section 21A. 46 . 180 of the Salt Lake City Code pertaining to construction impact mitigation signs pursuant to Petition No. 400-08-16 with the following amendments : That the following definition be added to Section 21A. 46 . 180 Paragraph C: "Construction Impact Area" means a specific location designated by the Mayor or the Mayor' s designee likely to be impacted by temporary construction activities that are anticipated to occur for a period greater than six (6) months and which activities will likely disrupt pedestrian and/or vehicular traffic in such a manner to negatively affect nearby business activities . A Construction Impact Area designation shall be effective for no longer than eighteen (18) months, unless extended by the Mayor or Mayor' s designee for good cause . That the words "City Council and" be omitted from Paragraph D of Section 21 . 46 . 180 and replace with the words "or Mayor' s designee" so the paragraph reads : Approval of Construction Impact Areas : In order to encourage and promote business identity during periods of construction activity, the Mayor or Mayor' s designee may recognize via a public meeting, business areas that are impacted by construction activity. That the word "implementing" be inserted into Section 21 . 46 . 180 Paragraph F so the first sentence of the paragraph reads : Construction Impact Area Mitigation signs are subject to the following minimum standards in addition to any administrative implementing guidelines developed for a specific Construction Impact Area: That the language of Paragraph H of Section 21 . 46 . 180 be revised to read: Effect on Overlay Districts : Construction impact area mitigation signs are not subject to the requirements and standards of overlay districts established in Section 21A. 34 of this title, which motion carried, all members voted aye . (0 08-21) 7 : 04 : 15 PM COMMENTS TO THE MAYOR 08 - 56 PROCEEDINGS OF THE CITY COUNCIL OF SALT LAKE CITY, UTAH TUESDAY, SEPTEMBER 30 , 2008 Councilmember Simonsen thanked the Mayor for the opportunity to review other cities transit. Councilmember Turner said it was a new era of cooperation with the Council and the Mayor. 7 : 06 : 07 PM COMMENTS TO THE CITY COUNCIL Jim Garside spoke regarding the economic meltdown. Eric Kiltz spoke regarding panhandlers in Salt Lake City. Cindy Cromer spoke regarding short comings of the Transit zone . UNFINISHED BUSINESS #1 . 7 : 12 : 46 PM RE: Adopting a resolution relating to Capital Improvement Program allocations for Fiscal Year 2008-2009 . See Attachments Councilmember Love moved and Councilmember Jergensen seconded to adopt Resolution 41 of 2008, which motion carried, all members voted aye . Councilmember Love requested that the Administration look for options for closing the budget short fall and come back to the Council . (B 08-8) #2 . RE: Adopting an ordinance confirming the modified and equalized assessment lists and levying an assessment against certain properties in the "Salt Lake City, Sidewalk Replacement Special Improvement District 2005/2006, 2006/2007, FY Job No. 102136 (the "District") , for the propose of paying a portion of the costs of the installation of concrete sidewalks, driveway aprons, curb, gutter and asphalt tie-ins, appurtenances and all other miscellaneous work necessary to complete the improvements in a proper workmanlike manner (collectively, the "Improvements") ; establishing the effective date of the ordinance; and related matters . RE: Setting the date of November 6, 2008 at 7 : 00 p.m. to accept public comment and consider adopting an ordinance rezoning a portion of property located at 51 North Tommy Thompson Drive and 08 - 57 PROCEEDINGS OF THE CITY COUNCIL OF SALT LAKE CITY, UTAH TUESDAY, SEPTEMBER 30, 2008 amending the zoning map pursuant to Petition No 400-08-01 (Sunquest Development, Gordon Jacobsen) . RE: Setting the date of October 14, 2008 at 7 : 00 p.m. to accept public comment and consider adopting an ordinance amending Salt Lake City Ordinance 64 of 2008 which adopted the final budget of Salt Lake City, Utah, for the Fiscal Year beginning July 1, 2008 and ending June 30, 2009 .
