Ordinance: Homeless Resource Center Text Amendment The Council will accept public comment and consider adopting an ordinance that would establish a process for approving future Homeless Resource Centers (HRCs) in the City and modify existing standards for homeless resource centers and homeless shelters. The Council may amend other related chapters and sections of Title 21A Zoning as part of this proposal. This petition was initiated by the City Council through Ordinance 15B of 2022. Petition No.: PLNPCM2022-01068 The proposal includes: •A Homeless Resource Center Overlay Zoning District; •Modifications to city ordinance 21A.36.350 Standards for Homeless Resource Centers; •Provisions for temporary/seasonal homeless resource centers that incorporate recent changes to Utah Code; •Modifications to city ordinance 21A.50 to include additional considerations when mapping the HRC overlay and other related changes; and •Updated defined terms. Paul Webster, Brigette Weier, Michelle Flynn, Adair Kovac, Carl Moore, Rocky Anderson, Nigel Swaby, Shawn McMillen, Janet Hemming, Barbara Elmer, Kseniya Kniazelva, Robert Danielson, Luke Mendez, Josh Storey, Audrey Evans, Nataya Hamilton, Amy Hawkins gave public comment on this amendment including the following: MINUTES OF THE SALT LAKE CITY COUNCIL Tuesday, April 4, 2023 2 •Concern for firearms collected by the shelter staff making the HRC more dangerous. •Concern for number of available beds and shelter space in the HRC. •Massive need to increase shelters and beds. •Urged the Council to pass the original version of the ordinance by Planning Commission.  •Encouraged the Council to look at case management to create safe spaces for all citizens.   •Review timeframe for the amendment. •Concern about where the HRCs are located and recourses needed from the community to support the shelter. •Urged the Council to review the amendment with more time to ensure the code was followed.  •Proposed the idea of a 12-step program with a sanctioned camp. •Need more mental health recourses for the homeless in and out of HRCs.  •State concern over lack of safety and services the shelters provide.  •Urged the Council to look into the administration running the shelters to ensure they are following the code.  •Need for community involvement to help one another and create a safer space to help people get back on their feet.  •Urged the Council and Mayor to look at the duties and obligations of the city and to work together to help the citizens. •Need for more volunteers. •Urged the Council to give funding to other recourse centers that actually help the homeless.  •Create a tracking system for HRC neighborhood and safety complaints can be used to measure the success of a facility.  Motion: Moved by Council Member Puy, seconded by Council Member Fowler to close the public hearing and defer action to a future Council meeting. Ordinance: Rezone and Master Plan Amendment at 865 South 500 East The Council will continue to accept public comment and consider adopting an ordinance MINUTES OF THE SALT LAKE CITY COUNCIL Tuesday, April 4, 2023 3 that would amend the zoning of property at 865 South 500 East Street from RMF-30 (Low Density Multi-Family Residential District) to CN (Neighborhood Commercial District), this would also amend the Central Community Master Plan Future Land Use Map. The intent of the rezone request is to allow for the conversion of the existing single- family dwelling on the property to a commercial use. Consideration may be given to rezoning the property to another zoning district with similar characteristics. The property is located within Council District 5. Petitioner: Rick Service, Petition No.: PLNPCM2022- 00301 & PLNPCM2022-00302   Brian Fullmer provided a brief introduction to the proposal of the Master Plan Amendment.  Cindy Cromer expressed concern over the Master Plan Amendment, public noticing requirements and ADU issues.  Motion: Moved by Council Member Dugan, seconded by Council Member Puy to close the public hearing and defer action to a future Council meeting.. Grant Application: Marathon Petroleum Community Investment Grant The Council will accept public comment for a grant application request from the Fire Department to the Marathon Petroleum. If awarded, the grant would fund improvements to the Training Tower by adding a gas system and monitor so that Firefighters can train for gas-related and hazardous incidents.   Mary Beth Thompson gave a brief overview of the Marathon Petroleum Community Investment Grant Application. AYE: Ana Valdemoros, Victoria Petro, Daniel Dugan, Amy Fowler, Chris Wharton, Alejandro Puy, Darin Mano Final Result: 7 – 0 Pass C.POTENTIAL ACTION ITEMS:   1. Ordinance: Electric Vehicle Readiness Off-Street Parking Stalls Amendment The Council will consider adopting an ordinance that would amend and update City code MINUTES OF THE SALT LAKE CITY COUNCIL Tuesday, April 4, 2023 4 requirements for parking on some new construction projects. New multi-family housing projects like condos and apartments would be required to add electrical capacity on twenty percent of their off-street parking stalls. The electrical capacity would allow the future addition of electric vehicle charging stations at the stalls constructed for them. The proposal would amend the City’s land use code 21A.44.040. The requirement would also apply to major reconstructions of qualifying properties in multi-family zones. AYE: Ana Valdemoros, Victoria Petro, Daniel Dugan, Amy Fowler, Chris Wharton, Alejandro Puy, Darin Mano Final Result: 7 – 0 Pass 2. Ordinance: Accessory Dwelling Unit (ADU) Text Amendment The Council will consider adopting an ordinance that would amend various sections of the Title 21A of the Salt Lake City Code pertaining to Accessory Dwelling Unit (ADU) regulations. The proposed code revisions would eliminate the conditional use requirement for detached ADUs in single-family residential zones. They would also aim to lower zoning barriers to construction of ADUs in general. The proposed changes would seek to strike a better balance between encouraging construction of ADUs and mitigating impacts to neighboring properties. Petition No.: PLNPCM2022-000475 For more information on this item visit www.tinyurl.com/ADUTextAmendment     FYI – Project Timeline: (subject to change per Chair direction or Council discussion) Briefing - Tuesday, January 17, 2023; Tuesday, February 7, 2023; and Tuesday, March 7, 2023 Set Public Hearing Date - Tuesday, January 17, 2023 and Tuesday, March 7, 2023 Hold hearing to accept public comment - Tuesday, February 7, 2023 and Tuesday, March 21, 2023 at 7 p.m. MINUTES OF THE SALT LAKE CITY COUNCIL Tuesday, April 4, 2023 5 TENTATIVE Council Action - Tuesday, April 4, 2023    Staff Recommendation - Refer to motion sheet(s).   Motion: Moved by Council Member Valdemoros, seconded by Council Member Puy to adopt Ordinance 17 of 2023, and include the following conditions: •Remove conditional use requirements for ADUs •Establish the maximum size of a detached ADU is 1,000 square feet •Adversely affected parties have right of enforcement for violating terms of an ADU restrictive covenant •Adopt the ordinance as proposed, retaining the owner occupancy requirement for properties with ADUs •The minimum corner side yard setback is 20% of the lot width, or 10 feet whichever is less •Provide a minimum of one off-street parking space for Accessory Dwelling Unit (ADU) residents, with the following exceptions: ◦If the property is within ½ mile of a designated bicycle lane or path ◦If the property is within ¼ mile of transit ◦If sufficient space for on-street parking is available in front of the primary residence Further move that the Council adopt the following legislative intents: •It is the intent of the Council to revisit this requirement in three years. In the interim, data will be collected and reviewed regarding numbers •of ADUs constructed during this three-year period, barriers to their construction, and impacts to neighborhoods •It is the intent of the Council to provide $1 million in one-time funding to provide financial support for ADU construction •It is the intent of the Council to fund 2 additional Civil Enforcement employees for ADU enforcement AYE: Ana Valdemoros, Victoria Petro, Daniel Dugan, Amy Fowler, Chris Wharton, Alejandro Puy, Darin Mano Final Result: 7 – 0 Pass Council Members discussed the following items regarding ADU: •Needs for ADU. •Concern on placement. •Impacts on current homeowners. •Expressed appreciation for the process and discussion. •Revaluate the impacts after 5 years. •Homeownership of the citizens of SLC. •Has opened up other discussions in other areas. This motion was amended on May 23, 2023, to clarify the exceptions MINUTES OF THE SALT LAKE CITY COUNCIL Tuesday, April 4, 2023 6 relating to off-street parking D.COMMENTS: 1.Questions to the Mayor from the City Council.   Council Members reminded the public how to find information regarding the flooding preparation being conducted by the City and how the residence can obtain recourses.  2.Comments to the City Council. (Comments are taken on any item not scheduled for a public hearing, as well as on any other City business. Comments are limited to two minutes.)     Council Member Petro reviewed the rules of decorum. Oakley Hill, Melissa Tyszko, Jakey Siolo, Maile Arvin, Dee Platero, Mark Roia, Deanna Taylor, Lionel Trepanier, Adair Kovac, Jack Bellows, Joan Gregory spoke in support of the Og-Woi Gardens including the following: •Urged the lifting of the May 1, 2023 deadline. •Talked about the history and current importance of the Og-Woi Gardens. •Acknowledge what the gardens do to help the community. •Provides food forest for the community. •Urged Council to invest in the communities and this garden. •Urged Council to support the project and urged the community project to be funded. •Expressed how the project was in line with the City master plan for community involvement, education, and growth.   E.NEW BUSINESS: NONE.
