Public Utilities Advisory Committee
Minutes
October 27, 2oi6
The Public Utilities Advisory Committee meeting was held at 7:3o am on October 27, 2o16
at the Department of Public Utilities, 1530 South West Temple, Salt Lake City, UT 84115.
Committee members present were Roger Player, Ted Boyer, Kent Moore, Lynn
Hemingway, Ted Wilson, Sydney Fonnesbeck and Colleen Kuhn. Salt Lake City Public
Utilities employees present were Laura Briefer, Greg Archuleta, Kurt Spjute, Tom Ward,
and Janine Calfo. Also in attendance were Rusty Vetter, SLC Attorney's Office; Lehua
Weaver and Cindy Gust-Jensen, City Council Staff; Tom Godfrey, Mike DeVries and Art
Hunter, MWDSLS.

We still need to recruit two more members to the Committee.
Approve Minutes of September 22, 2oi6 Meeting
Committee member Ted Boyer moved and Committee member Roger Player seconded
the motion to approve the minutes of the October 22, 2015, meeting as submitted. All
members present voted aye. As a full quorum is present,the minutes were also approved
from September as well.
Financial Report by Kurt Spjute
Kurt Spjute presented a PowerPoint of the financial report. With the high temperatures,
there wasn't as much water usage as the temperatures would have suggested. There is a
Sewage Bond review that is coming up with the Mayor's office.
Contracts are still under negotiation for the prison relocation. Development of budgets
and budget impacts will take place in January 2017.
There is a new Engineering Staging/Satellite Office located at 500 South and 19oo West.
This will be a staging area for consultants to manage upcoming sewer projects.
Charges for September is about $2 Million higher. Accounts Receivable delinquency is
very low.
We have anticipated on doing bond issues every other year. The next bond issue may be
a little higher.

Storm Water Permit — Jesse Stewart
Jesse Stewart made a PowerPoint presentation on the Storm Water Program. There are
maintenance and quality crews to maintain for flooding and quality. He explained the
origins of storm water and how it is treated. Storm water is separate from waste water.
Storm water is regulated by the Department of Water Quality and authorized by the
Federal and State clean water act and operates under a Municipal Separate Storm Sewer
System (MS4) permit.
Sydney Fonnesbeck mentioned an incident that happened a couple of years ago that
involved some severe pollution that was entering the City Creek System. Salt Lake City
Public Utilities is now regulating all of the storm water drains. There are several
interdepartmental training and education programs that are going on. If there are any
new incidents, residents can call Public Utilities to mitigate.
There are several minimum control measures that are in place to ensure that there are no
discharges into the storm water system. There are weekly, quarterly and annual audits
that take place.
Jesse outlined the many different ways that storm water is monitored and managed
throughout Salt Lake City. The annual summary includes 51 best management practices
and all of the ways that the pipes and gutters are cleaned.
The 2016 audit was led by the EPA and the Department of Water Quality. The department
received a"good job" overall. There were a few things that were noted to work on for the
next year in regard to post-construction permitting, illicit discharges and standard
operating procedures for Operations and Maintenance of Municipal Facilities.
Upcoming Meeting Schedule - Laura Briefer
The next meeting will be December 8th at noon. The venue will be at the Tracey Aviary
at Liberty Park.
Permit Appeal — Rusty Vetter
Permit Appeal, City Ordinance 21A.34.130: RCO Riparian Corridor Overlay District.
Laura explained the PUAC's role in the appeal process. The decision that is being
appealed is that of a Public Utilities issued permit for a treehouse in zone A in the riparian
corridor.
Brad Stewart spoke about specifics of the ordinance and of this particular case. There was
a map displayed that showed the area involved. Rusty mentioned the burden of proof N
information involved in the decision. This appeal is to review the director's original
decision on the permit that was issued for a treehouse in the riparian corridor. a

The permit was issued as a"deck"permit. Brad outlined the language that is listed in the
permit in regard to the riparian rule.
Mr. Berceau showed some slides of his property. He owns the property to the middle of
the creek. He also has a petition that has been signed by three other property owners who
would like to see the permit repealed. Mr. Berceau feels that the treehouse is a safety
hazard, as the treehouse platform is at a height of 20 feet, not at to feet.
The property lines are currently in dispute, as the creek bed has moved due to erosion.
There were stakes that plotted the property that had been removed when Mr. Hatch had
his property surveyed. According to Mr. Hatch's survey,the treehouse is located on Hatch
property.
Ted Wilson asked Mr. Berceau how he uses the backyard property. It is a multi-tiered
property that has a pool and deck. Mr. Berceau is upset because the treehouse is in his
direct line of site and that he feels that it lowers his property value. He pays extra taxes
for his view.
Ted Wilson asked Mr. Berceau if he had made any other communication between himself
and Mr. Hatch (who built the treehouse). Mr. Berceau indicated that he had not had any
communication with Mr. Hatch. He did not speak to Mr. Hatch to indicate that he had
an issue with the structure.
Sydney Fonnesbeck asked if the treehouse violates the riparian code. Brad informed her
that the structure does not violate the code.
Ted Boyer pointed out that there are two issues that are relevant: 1) Is the treehouse the
same as a deck? 2) Does the treehouse impair the use of the land?
Colleen Kuhn pointed out that another issue may be the high water level,because part of
the ordinance that any structure that is built should not impede the high water level.
When the water is flowing at its highest, are the stairs to the platform in the water? The
stairs could be in the path of the water and may pose an obstruction to the water flow.
Tom Ward pointed out that the City has a flood plain ordinance that is governed by FEMA
and prohibition is of structure that are directly in the channel of the flow.
Mr. Hatch presented his side of the issue. He admits that he started to build the structure,
unaware that it required a permit. The structure is built well and sturdy. They wanted to
make the structure so that it would NOT impact the neighbors.
Mr. Hatch had a survey done that shows that the treehouse is built on his property.
Sydney asked if there was a building permit required. It was determined that a building
permit was not required. M

Mr. Hatch did not go to his neighbors to get their input before construction. He feels that
this structure should be classified as a deck.
Roger Player asked if the foliage is thicker during the spring and the summer. Mr. Hatch
stated that, in the fall, everyone can see into everyone's backyards.
Ted Wilson asked if the "view" is really an issue with the permit. Rusty reminded the
Committee that this review is only in regard to the permit requirements. Ted asked for a
discussion with regard to "right" as opposed to "permitted use".
Is it the right of the property owner to build in the riparian area? Laura indicated that the
process would have been the same for permitting, even if Mr. Hatch had discussed the
structure with his neighbors.
Ted Wilson moved that the Committee should sustain/uphold the permit, based on the
fact that the structure does not violate the permit parameters. Colleen Kuhn seconded
the motion. Motion passed unanimously.
