This meeting will not have an anchor location at the City and County Building. Appeals
Hearing Officer, Staff, and Appellant will connect remotely. A public hearing will not be
held.

1. POSTPONED - Continuance of Variance Request at Approximately 871 W 400 N – This
case is a continuation and was originally heard before the Appeals Hearing Office on June
19, 2025. Tim Fotu, the property owner, is requesting a Variance from Ordinance
21A.24.060.E which establishes the minimum corner side yard setback to construct a single-
family residential home on a narrow lot. He is also requesting a variance from 21A.24.060.F
which establishes that the surface coverage of all principal and accessory buildings shall not
exceed forty percent (40%) of the lot area. The property is located within Council District 2,
