HomeMy WebLinkAboutG 20210012 - 10 of 2020; Related to Proclamation 9: Nighttime Curfew1 SALT LAKE CITY EMERGENCY PROCLAMATION No. 10 of 2020 PROCLAMATION EXERCISING EMERGENCY POWERS – LOCAL EMERGENCY FOR CIVIL UNREST Under Utah Code Sections 53-2a-208(1)(a) and 53-2a-209(1) and Salt Lake City Code Chapter 22.03, on June 1, 2020, the Mayor of Salt Lake City declared a local emergency due to civil unrest, as described below. On May 25, 2020, George Perry Floyd died while in the custody of the Minneapolis Police Department. In the aftermath of Mr. Floyd’s death, on May 30, 2020, a civil disturbance occurred within Salt Lake City, with resulting significant and extensive damage to people and/or property, including damage to public buildings and the burning of a police vehicle in the city street. On May 30, 2020, as a result of the civil disturbance in Salt Lake City, the Mayor exercised her emergency authority to declare a local emergency and exercised her emergency powers to declare a curfew within the boundaries of Salt Lake City, which began on May 30, 2020 at 8 p.m. and extended until 6 a.m. on June 1, 2020. While the Mayor is committed to protecting the safety of individuals and property, she also reaffirms the First Amendment rights of all people to peaceably assemble and protest. Nonviolent assembly and protest are the pillars of democracy and are always welcome in Salt Lake City. In the aftermath of Mr. Floyd’s death and the resulting civil unrest and disorder over the weekend of May 29 - May 31, 2020, law enforcement personnel, residents, and visitors have been and remain at risk of significant injury and death, as well as significant destruction to public and private property and the potential for further civil unrest or disorder for the foreseeable future to such an extent that extraordinary measures must be taken to preserve order necessary to protect the public health, safety, and welfare, especially during the time periods where much of this could occur under cover of darkness. Pursuant to Utah Code Section 53-2a-208(3) and City Code 22.03.010, the Salt Lake City Mayor exercises the following emergency powers to quell the local emergency: 1. Declaration of Nighttime Curfew. A nighttime curfew is imposed in all public places within the geographical boundaries of Salt Lake City, including streets and rights-of-way, during the following times: a. From 8:00 p.m. on Monday, June 1, 2020, until 6:00 a.m. on Tuesday, June, 2, 2020; and b. From 8:00 p.m. on Tuesday, June 2, 2020, until 6:00 a.m. on Wednesday, June 3, 2020; and c. From 8:00 p.m. on Wednesday, June 3, 2020, until 6:00 a.m. on Thursday, June 4, 2020; and d. From 8:00 p.m. on Thursday, June 4, 2020, until 6:00 a.m. on Friday, June 5, 2020; and e. From 8:00 p.m. on Friday, June 5, 2020, until 6:00 a.m. on Saturday, June 6, 2020; and f. From 8:00 p.m. on Saturday, June 6, 2020, until 6:00 a.m. on Sunday, June 7, 2020; and g. From 8:00 p.m. on Sunday, June 7, 2020, until 6:00 a.m. on Monday, June 8, 2020. h. During the hours of curfew, all persons are prohibited from using, standing, sitting, traveling or being present on any public street or in any public place, with the following exceptions: i. All law enforcement, fire paramedics or other medical personnel, Utah National Guard, as well as any other emergency response personnel authorized by Salt Lake City, and credentialed members of the media. ii. Any person traveling directly to and from any of the following: 1. Work; June 1, 2020 2 2. Attending religious services; 3. Obtaining food; 4. Caring for a family member, friend or animal; 5. The Salt Lake City International Airport; 6. Patronizing a private business, including, but not limited to retail merchants and restaurants; 7. Seeking medical care, 8. Fleeing dangerous circumstances. iii. Any person who is experiencing homelessness. iv. Any person to whom permission by authorized Salt Lake City officials is specifically granted. i. The Mayor of Salt Lake City shall designate any additional personnel that are exempt from the curfew pursuant to Paragraph 3(a)-(g) above. j. For purposes of this emergency proclamation, “travel” includes, without limitation, travel on foot, bicycle, skateboard, scooter, motorcycle, automobile, or public transit, or any other mode of transporting a person from one location to another. k. For purposes of this emergency proclamation, “public place” means any place, whether on privately or publicly owned property, accessible to the general public, including but not limited to public streets and roads, alleys, highways, driveways, sidewalks, parks, vacant lots, and unsupervised property. For purposes of this emergency proclamation, “public place” does not include the Salt Lake City International Airport. 2. Penalty for Violation. Pursuant to SLC Code 22.03.080, the penalty for violating this emergency proclamation or any order or directive given by police, fire, or other emergency services personnel pursuant to this emergency proclamation is a class B misdemeanor, which carries with it a risk of a fine of up to $1,000.00 and/or a term of imprisonment of up to 6 months. 3. Term. This proclamation shall take effect immediately and will be ongoing until 6 a.m. on Monday, June 8, 2020. 4. Assistance. Salt Lake City is authorized to request all assistance available with respect to this local emergency from all federal, state, and local sources and is authorized to activate all applicable mutual aid agreements. 5. Filing and Dissemination. This proclamation will be filed with the Salt Lake City Recorder and will be delivered to the State of Utah and Salt Lake County and will be disseminated to local media.
