HomeMy WebLinkAboutG 20210017 - 2 of 2020; Related to Proclamation 1: Mass Gatherings, Public Meetings, Water Service RECORDED SALT LAKE CITY EMERGENCY PROCLAMATION MAR 1 2 2020 No. 2 of 2020 CITY RECORDER MAYOR'S EXERCISE OF EMERGENCY POWERS RELATED TO SALT LAKE CITY EMERGENCY PROCLAMATION NO. 1 OF 2020 On March 10, 2020, pursuant to her authority under Utah Code Sections 53-2a-208(1)(a) and 53-2a-209(1) and Salt Lake City Code Chapter 22.03, the Mayor of Salt Lake City declared a local emergency due to the global outbreak of COVID-19. Under City Code 22.03.030, while the proclamation of local emergency is in effect, the Mayor of Salt Lake City may exercise certain emergency powers by proclamation. The Mayor of Salt Lake City therefore exercises the following emergency powers, effective immediately and throughout the Term(defined below): 1. Mass Gatherings. a. Definition. "Mass gathering" is any event or convening that brings together 100 or more people in a single room or single space at the same time, such as an auditorium, stadium, arena, large conference room, meeting hall, theater, or any other confined indoor or confined outdoor space. "Mass gathering" does not include normal operations at airports, shopping malls and centers, or other spaces where 100 or more persons may be in transit. It also does not include courts; churches or church performances; libraries; hospitals/medical centers or other health care facilities; treatment centers (both inpatient and outpatient); facilities housing individuals experiencing homelessness; schools or school cafeterias or other child care facilities; typical office environments; retail stores; restaurants; or grocery stores. A "mass gathering" also does not include an establishment where large numbers of people are present, but where it is unusual for them to be within arm's length of one another. i. Proclamation. All private or public mass gatherings are prohibited within Salt Lake City boundaries. 2. Public Meetings. a. Background. Under current City Code 2.060.30(E), while a proclamation of state or local emergency is in effect, the City Council may convene and hold an electronic meeting, so long as at least a quorum of the members of the Council are present at the meeting electronically (eliminating the requirement for City Council members to be physically present at the City Council's anchor location). b. Proclamation. Effective as of the date of this proclamation, City Code 2.06.030(E) applies to all City Boards and Commissions, such that these Boards and Commissions may convene and hold an electronic meeting so long as at least a quorum of the members are present electronically (eliminating the requirement for the members to be physically present at the Board's or Commission's anchor location). c. Compliance with Open Meetings Act. Electronic meetings will comply with all other requirements of the Open Meetings Act to ensure that the City's business continues to be exercised in public and transparently. 3. Water Service. During the Term, water service will not be turned off for failure to pay Salt Lake City Public Utilities bills. 4. Term. This proclamation shall take effect immediately and will be ongoing for as long as Salt Lake City Emergency Proclamation No. 1 of 2020 is in effect, unless this proclamation is amended or rescinded by the Mayor("Term"). 5. Filing and Dissemination. This proclamation will be filed with the Salt Lake City Recorder and will be delivered to the State of Utah and Salt Lake County and will be disseminated to local media.
