MAYOR'S EXERCISE OF EMERGENCY POWERS
RELATED TO CITY RECORDER
SALT LAKE CITY EMERGENCY PROCLAMATION NO. 1 OF 2020
On March 10,2020,pursuant to her authority under Utah Code Sections 53-2a-208(1)(a)and 53-
2a-209(1)and Salt Lake City Code Chapter 22.03,the Mayor of Salt Lake City declared a local
emergency due to the global outbreak of COVID-19.
Under City Code 22.03.030,while the proclamation of local emergency is in effect, the Mayor of
Salt Lake City may exercise certain emergency powers by proclamation,and on March 12 and 23,with
Proclamations No. 2 and No. 4,the Mayor of Salt Lake City exercised emergency powers to address the
local emergency related to the spread of COVID-19 in Salt Lake City(the"COVID-19 Emergency
Proclamations").
On March 27,2020,the Mayor issued Emergency Proclamation No. 5,which enacted Stay at
Home and Business Modifications,among other provisions related to City operations. The Stay at Home
and Business Modifications provision was in support of and commensurate with the Governor's
Coronavirus Directive for Utah dated March 27,2020"and any subsequent related state or local health
department Orders"and was intended to direct all Salt Lake City residents to stay at home or in their
place of residence except for essential travel,as defined in the Governor's March 27`h Directive.
On March 29, 2020, Salt Lake County issued Public Health Order 2020-03,requiring people to
Stay Home, Stay Safe.The intent of Order 2020-03 "is to ensure that the maximum number of people
self-isolate in their homes and places of residence to the maximum extent feasible,while enabling
essential services to continue,and to slow the spread of COVID-19 to the greatest extent possible."
Addendum A accompanies Order 2020-03,which identifies essential healthcare and public health
operations, essential human services, essential governmental functions, and essential businesses and
operations.The residents and businesses of Salt Lake City are now required to abide by all measures
identified in Order 2020-03.
In light of Order 2020-3,the Mayor of Salt Lalce City now desires to(1)repeal in its entirety
Proclamation No. 5 and(2)exercise her emergency powers to enact Proclamation No. 6. To address the
COVID-19 pandemic, Proclamation No. 6 does the following: (1)restricts access to the Salt Lake City
International Airport; (2)closes certain public areas and facilities in City parks and public lands;(3)
promotes social distancing by removing a restriction on take-home vehicles; (4)restricts purchases of
gravesites for burial rights in the Salt Lake City Cemetery to those who require burial during the term of
the declared emergency; (5)more easily facilitates donations to Salt Lake City in response to the COVID-
19 pandemic; and(6)further relaxes parking restrictions to ease the burden on those who are engaging in
self-quarantine or otherwise abiding by the requirements of Order 2020-03.
1. Salt Lake City International Airport Operations. For the duration of this Term,the following
procedures will be in effect at the Salt Lake City International Airport("Airport"):
a. Pedestrian access to the Public Areas of the Airport is restricted to individuals who can
demonstrate they fall within one of the following categories:
1. Ticketed airline passengers;
2. One individual accompanying a ticketed passenger, if the ticketed
passenger needs assistance with arrival or departure;
3. Individuals whose employment requires access to the Public Areas;and
4. Individuals who have been authorized by Airport officials to access the
Public Areas.
b. "Public Areas"consist of all non-sterile areas on Airport property, including without
limitation terminals,public parking lots and garages,Utah Transit Authority(UTA)
facilities,and all connecting sidewalks, corridors,elevators, escalators,pedestrian bridges,
tunnels and walkways.
c. Passenger pickup and drop-off is permitted only at the curbside in the Airport's designated
pickup and drop-off locations and in the Parking Garage,and individuals other than
travelers and those directly assisting them must remain in their vehicles at all times.
2. Parks and Recreation. For the duration of the Term, the following procedures will be in effect
within all Salt Lake City Parks and Public Lands, as defined in Salt Lake City Code Section
15.08.010:
a. The following will be prohibited:
1. All activities and gatherings prohibited under Salt Lake County Public
Health Order 2020-03;
2. The use of all places of public amusement and activity ordered closed under
Order 2020-03;
3. All facility rentals including pavilion, wedding, or other special event
reservations;
4. Concession food and beverage sales or distribution; and
5. Use of any other park or park amenity that the Division of Parks and Public
Lands determines cannot be used safely due to the risk of community spread
of COVID-19.
3. Take Home Vehicles. In order to promote City employees' social distancing through use of a take-
home vehicle rather than coming to the workplace to pick up a vehicle to take to a worksite, Salt Lake
City Code Section 2.54.030(D), which prohibits the use of a city-owned vehicle for take home use if
an employee resides outside of 35 miles from city limits,is hereby suspended for the Term.All City
employees using a take-home vehicle shall adhere to the requirement of Salt Lake City Code Section
2.54.030(B)(5)(and any applicable City department policies)that personal use shall be reasonable
and shall not accumulate excessive miles on the vehicle.An employee who uses a take-home vehicle
'to drive to and from work or utilizing it for reasonable personal use should ensure that the employee's
personal vehicle insurance also covers the City's take-home vehicle during the times that the
employee is commuting to and from work or utilizing it for reasonable personal use.
4. Cemetery Plot Purchases.The Salt Lake City Cemetery has limited gravesites available for sale of
burial rights. The City recognizes that the current COVID-19 crisis may result in a significant
increase in demand for the purchase of burial rights in the cemetery. The City desires to limit the sale
of burial rights in the cemetery to persons who will actually use the burial rights to bury someone in
the cemetery during the term of this proclamation.
As such,effective as of the date of this proclamation and notwithstanding any contrary provision in
the Salt Lake City Code,the City will sell a burial right in the cemetery only to persons who will
actually use the burial right to bury someone in the cemetery during the Term of this Proclamation.
5. Donations to the City. In order to facilitate the prompt and efficient receipt of donations to the City
relating to the COVID-19 pandemic,City Code Chapter 3.60,which governs donations to the City, is
hereby suspended with respect to donations relating to the COVED-19 pandemic. However, for each
donation, City employees must complete the donation tracking form required by the City's Finance
Department.
6. Parking Enforcement and Collection. In order to minimize impact on residents who might be self-
quarantined, all enforcement(including,but not limited to,ticketing,booting and impounding
vehicles)of certain parking ordinances identified below is suspended during the Term of the
emergency, as defined below in paragraph 7.This is in addition to the suspension of parking
ordinances identified in Proclamation No. 4 of 2020.Furthermore,any citations issued under the City
ordinances identified in Proclamations No.4 and No. 6 from March 23,2020 through the Term shall
be dismissed.Enforcement of all other parking ordinances will remain in effect.
During the Term, the City will suspend collections on all parking ordinances still enforced,which
collections will be reinstated upon expiration of the Term.
The parking ordinances that shall not be enforced during the Term are as follows:
a. Parking Meters;Installation and Enforcement(Salt Lake City Code Section 12.56.150)
b. Parking Meters; Overtime Parking Prohibited(Salt Lake City Code Section 12.56.190)
c. Time Limited Parking on Certain Streets(Salt Lake City Code Section 12.56.450)
d. Using Streets for Storage(Salt Lake City Code Section 12.56.520)
e. Using Streets for Storage of Motor Homes,Boats, and Trailers(Salt Lake City Code Section
12.56.525)
f. Enforcement of parking prohibitions in residential neighborhoods under Salt Lake City Code
Section 12.56.310(B)with respect to time limitations to allow residents to park in residential
areas without time limitations.Any other enforcement of Salt Lake City Code Section
12.56.310(B)that does not apply to time limitations on parking in residential neighborhoods
may still be enforced.
7. Term. This Proclamation shall take effect on March 29th,2020 at 11:59 p.m. and will be ongoing for
as long as Proclamation No. 1 of 2020 is in effect,unless this Proclamation is amended or rescinded
by the Mayor.
S. Enforcement. Salt Lake City residents are urged to voluntarily comply with this Proclamation and
every effort will be made to educate people to achieve compliance. However,pursuant to Salt Lake
City Code 22.03.080,a person who violates this Proclamation is guilty of a class B misdemeanor
and upon conviction can be punished by a fine not to exceed$1,000 and/or by imprisonment for a
term no longer than 6 months.Nothing in this Proclamation is intended to encourage or allow law
enforcement to transgress individual constitutional rights.
9. Severability.A determination that any provision of this Proclamation is invalid will not affect the
enforceability of any other provision of this Proclamation. Rather,the invalid provision will be
modified to the extent necessary so that it is enforceable.
10. Filing and Dissemination. This proclamation will be filed with the Salt Lake City Recorder and will
be delivered to the State of Utah and Salt Lake County and will be disseminated to local media.
