(An Ordinance Extending the Duration of the Temporary Zoning Regulations Authorizing
Overflow Homeless Shelter Use at Approximately 2333 W. North Temple)
WHEREAS, Section 10-9a-504 of the Utah Code permits a municipality, without prior
consideration and recommendation from the municipality’s planning commission, to enact a
temporary land use regulation for any part or all of a municipality for a period of time not to exceed
six months if the governing body makes a finding of compelling countervailing public interest.
WHEREAS, the Salt Lake City Council (the “City Council”) enacted Ordinance 61 of 2020
published December 23, 2020 (the “Original Ordinance”) adopting a temporary land use ordinance
for the property located at 2333 W. North Temple to allow use as a temporary overnight overflow
shelter to serve the City’s unsheltered population.
WHEREAS, the City Council found that protecting lives from the potentially deadly
consequences of severe winter weather and providing safe, socially distant housing for the City’s
unsheltered population during the pandemic constitutes a compelling, countervailing public
interest sufficient to justify these temporary land use regulations.
WHEREAS, the Original Ordinance is set to expire on April 15, 2021.
WHEREAS, the City desires to extend the duration of the Original Ordinance until June 22,
2021, for a total duration of six months as allowed by Utah Code § 10-9a-504.
WHEREAS, during this pandemic, the City’s unsheltered population continues to grow
due to the affordable housing crisis, economic crisis, and the effects of the pandemic.
WHEREAS, in addition to the overflow shelter authorized by the Original Ordinance,
during the 2020-2021 winter season there has been only one other overflow shelter operating in
Millcreek, Utah, which will close by April 15, 2021.
WHEREAS, the spring season in Salt Lake City brings unpredictable weather patterns,
including snow, rain, and wind that are harmful to the health and safety of the City’s unsheltered
population.

WHEREAS, persons experiencing homelessness have been significantly affected by the
pandemic due to the lack of socially distant housing, and vaccination efforts are ongoing, but
difficult to administer among transient populations.
WHEREAS, the City finds that the continued expansion of its unsheltered population, the
continued effects of the pandemic, the closing of the Millcreek shelter, and spring weather patterns
result in a continuing need for additional shelter beds during the 2021 spring season.
WHEREAS, the Salt Lake City Council finds that protecting lives from the potentially
harmful consequences of unpredictable spring weather and providing safe, socially distant housing
for the City’s unsheltered population during the pandemic constitutes a compelling, countervailing
public interest which justifies a temporary land use regulation.
NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. Finding of Compelling Countervailing Public Interest. Pursuant to Section
10-9a-504 of the Utah Code, the City Council finds that protecting lives from the potentially
harmful consequences of unpredictable spring weather and providing safe, socially distant housing
for the City’s unsheltered population during the pandemic constitutes a compelling, countervailing
public interest sufficient to justify extending the temporary land use regulation for an additional
two months.
SECTION 2. Duration. This temporary zoning ordinance shall remain in effect until
June 22, 2021 unless earlier amended, modified, or repealed.
SECTION 3. Full Force and Effect. The remaining terms and conditions of the Original
Ordinance shall continue to be in full force and effect, as modified by this ordinance.
SECTION 4. Effective Date. This ordinance shall become effective on adoption.
