STATE, o°aTE, SALT LAKE CITY, UTA d 64111i SALT LAKE CITY ORDINANCE No. 1 of 1993 (Scenic Circle Annexation and Zoning and Plat Amendment Approval pursuant to Petitions No. 400-92-18 and 400-92-50) AN ORDINANCE RECOGNIZING THE ADOPTION OF AMENDMENT 14-C TO THE MASTER ANNEXATION POLICY DECLARATIONS; EXTENDING THE LIMITS OF SALT LAKE CITY TO INCLUDE THE SCENIC CIRCLE ANNEXATION, ZONING THE SAME RESIDENTIAL "R-1" WITH THE FOOTHILL "F-1" OVERLAY BY AMENDING THE USE DISTRICT MAP AS ADOPTED BY SECTION 21.14.020 OF THE SALT LAKE CITY CODE; AMENDING THE SALT LAKE CITY COUNCIL DISTRICT BOUNDARY MAP; AND APPROVING THE AMENDMENT OF ARCADIA HEIGHTS PLAT "A" AMENDED SUBDIVISION TO DEDICATE THE EXISTING SCENIC CIRCLE STUB ALL PURSUANT TO PETITIONS NO. 400-92-18 AND 400-92-50. WHEREAS, Petition No. 400-92-18 was filed with the City Recorder of Salt Lake City, together with a plat showing the tract of land to be annexed hereafter to be known as the Scenic Circle Annexation, requesting that the contiguous, irregularly shaped parcel of approximately 4.1848 acres of unincorporated territory lying at approximately 2050 South 2800 East of Salt Lake County be taken within the City limits of Salt Lake City Corporation to extend the City's limits; and WHEREAS, the petition was signed by a majority of the owners of real property and the owners of more than one-third in value of all real property, as shown by the last assessment roles, situated in the tract hereinafter described; and WHEREAS, in order to facilitate the orderly expansion of the City's boundaries, the City has previously adopted a Master Annexation Policy Declaration on June 20, 1979. The proposed annexation lies within Study Area No. 14 of said Declaration and is the specific subject of Amendment 14-C of said Declaration which was approved after favorable Planning Commission review; and WHEREAS, the City Council of Salt Lake City, after examining the petition and having the petition favorably reviewed by the various departments of the City and the Planning Commission, and having accepted the petition by Resolution No. 91 of 1992, and having considered the petition at a publicly advertised hearing held January 5 annexation to be consistent and in keeping with the City's Master Annexation Policy Declaration for Study Area No. 14 and Amendment 14-C, the Council voted by two-thirds or greater vote of its membership, in favor of the annexation; and WHEREAS, no objection or contest to such annexation or amendment has been filed as required by law or is presently pending; and WHEREAS, the City Council also received Petition No. 400-92- 50 requesting the amendment of Arcadia Heights Plat "A" Amended Subdivision to formally dedicate the existing Scenic Circle street stub; and , 1995, and after finding the proposed 2 WHEREAS, the City Council and the Planning Commission have held all appropriate and necessary hearings regarding the amendment and have concluded that the amendment is in the best interest of the City; NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. Area. That the City limits of Salt Lake City be, and the same hereby are, enlarged and extended so as to include the following irregularly shaped approximately 4.1848 acre parcel of land located at approximately 2050 South 2800 East in Salt Lake County, Utah: Beginning at a point North 89°41'10" West 5.000 feet from the Northeast corner of Lot 7 of Arcadia Heights Plat "A" Subdivision, located in the Southwest Quarter of Section 14, Township 1 South, Range 1 East, Salt Lake Base and Meridian, and running thence North 89°41'10" West 643.000 feet; thence North 18°24'07" West 279.795 feet; thence South 89°41'10" East 732.779 feet; thence South 00°18'50" West 265.000 feet to the point of beginning. Contains 4.1848 acres. SECTION 2. Zoning. Be it further ordained and declared that the above Scenic Circle Annexation is hereby zoned Residential "R-1" with the Foothill "F-1" overlay and the Use District Map as adopted by Section 21.14.020 of the Salt Lake City Code relating to the boundaries of use districts shall be, and the same hereby is amended by the addition of the Scenic Circle Annexation zoned Residential "R-1" with the Foothill "F-1" overlay. SECTION 3. City Council Maps. The Salt Lake City Council District Map is hereby amended to include the Scenic Circle 3 Annexation in Council District 6 as specified on such map. SECTION 4. General Jurisdiction. Be it further ordained and declared that the tract of land described above in Section 1 shall henceforth be within the corporate limits of Salt Lake City Corporation. All ordinances, jurisdictions, rules and obligations of, or pertaining to, Salt Lake City are extended over and made applicable and pertinent to this tract of land; and the streets, blocks, alleys and public ways of said tract shall be controlled and governed by the ordinances, rules and regulations of Salt Lake City in that behalf. The monuments of the City Engineer shall henceforth be taken therein as the standards of location and distances of SECTION 5. Conditions Precedent. of this annexation and the publication said land. Prior to the acceptance of this Ordinance, the petitioners shall enter into an Annexation Agreement with the City requiring such terms and conditions as have been recommended by the Planning Commission in a form approved by the City Attorney, which Annexation Agreement is attached hereto and incorporated herein by reference. SECTION 6. Filings and Notice. Upon the passage and publication of this Ordinance, the Recorder of Salt Lake City is hereby directed to file with the County Recorder of Salt Lake County a copy of the approved annexation plan or map, duly certified and acknowledged, together with a certified copy of this Ordinance. The City Recorder is further directed to provide notice to the Utah State Tax Commission pursuant to applicable 4 state law. SECTION 7. Plat Amendment. The proposed amendment to Arcadia Heights Plat "A" Amended Subdivision to formally dedicate the existing Scenic Circle street stub is hereby approved and the Mayor authorized to execute the amended plat. SECTION 8. Publication and Effect. This Ordinance shall take effect upon the date of its first publication. The City Recorder is instructed not to publish this Ordinance until an annexation plat prepared by a registered professional engineer or surveyor at the developer's expense has been submitted to the City meeting all City standards for such a document and has been signed by the Mayor.
