001 of 1997 - AN ORDINANCE CLOSING A STREET KNOWN AS GEMINI ROAD,0 97-1 P 96-449 SALT LAKE CITY ORDINANCE No. 1 of 1997 (Closing a street known as Gemini Road located between Lots 2 and 3 of the Bonneville Center Plat A Subdivision (Industrial) pursuant to Petition No. 400-92-29) AN ORDINANCE CLOSING A STREET KNOWN AS GEMINI ROAD, LOCATED BETWEEN LOTS 2 and 3 OF THE BONNEVILLE CENTER PLAT A SUBDIVISION (INDUSTRIAL) PURSUANT TO PETITION 400-92-29. WHEREAS, the City Council of Salt Lake City, Utah finds after public hearing that the City's interest in the street described below is not necessary for use by the public as a street and that closure of said street will not be adverse to the general public's interest. NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That the street known as Gemini Road located between Lots 2 and 3 of the Bonneville Center Plat A Subdivision (Industrial), which is the subject of Petition No. 400-92-29, and which is more particularly described below, be, and the same hereby is, closed and declared no longer to be needed or available for use as a street. The subject street is called Gemini Road, is platted at 66 feet wide and extends 408.06 feet south of Amelia Earhart Drive, just west of the intersection of Amelia Earhart Drive with 5600 West, in Salt Lake City, Salt Lake County, Utah. 01 CO CD CD 00 SECTION 2. RESERVATIONS AND DISCLAIMERS. The above closure is expressly made SUBJECT TO all City water, sewer and storm sewer rights -of -way and easements, and rights -of -way and easements of all public utilities of any and every kind now located on, under or over the confines of the property hereby closed, and also SUBJECT TO the rights of entry upon said closed property by the City and all public utilities for the purpose of maintaining, altering, repairing, removing or rerouting said facilities. Said closure is also SUBJECT TO any existing rights -of -way or easements of private third parties. Said closure is also SUBJECT TO the following: a) Finalization of the amended plat to recording with the County Recorder; b) Construction of street improvements on Amelia Earhart Drive to eliminate the curb radius for the intersection and replacing it with standard 7-B curb and landscaping installed along the roadway consistent with the surrounding area; c) Compliance with any Salt Lake City departmental recommendations as to street or utility improvement terminations; d) Granting Salt Lake City an avigation easement over the amended plat area; and e) The City retaining title to the property until the City receives compensation (either in cash or other form acceptable to the City) for the property in an amount not less than the fair market value of the property. 2 co cn co C, CD Cal C SECTION 3. TRANSFER OF TITLE. Title to the property will be transferred by quitclaim deed from the City to all abutting property owners on a pro rata basis. SECTION 4. EFFECTIVE DATE. This ordinance shall become effective on the date of its first publication and shall be recorded with the Salt Lake County Recorder.
