WHEREAS, the City Council of Salt Lake City, Utah, finds after public hearing that the City's interest in the public street described below is not necessary for use by the public as a street and that closure of said street will not be adverse to the general public's interest nor divest the City of title to the property without subsequent documents of transfer. NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That a portion of Old North Temple from 2100 West to 2200 West, which is the subject of Petition No. 400-787-90 and which is more particularly described below, be, and the same hereby is, CLOSED and declared no longer to be needed or available for use as a public street, with the title remaining with the City until subsequent sale for market value, as determiend by a City approved appraisal paid for by the purchaser. Said street is situated in the County of Salt Lake, State of Utah, and is more particularly described as follows: Beginning at the intersection of the South line of 2-l1'1 North Temple Street and the Eastearly right of way 91 line of the North Temple Connector, a road incident to the construction of Expressway Project F-034-1(9) by the Utah Department of Transportation (UDOT), said point of beginning being North 89°58'38" East (basis of bearing) (UDOT - South 89°46' East) along the North Temple Street monument line 107.97 feet and South 0°07' West 66.60 feet from a city monument in the intersection of North Temple and 21st West Street (2200 West), said point of beginning also being West 1262.07 feet and North 672.00 feet from the Southeast corner of Section 33, Township 1 North, Range 1 West, �wJ Salt Lake Base and Meridian; running thence North 89°58'38" East 534.51 feet; thence North 0°07' East 50 feet; thence South 89°58'38" West 534.51 feet; thence South 0°07' West 50 feet to the point of beginning. SECTION 2. RESERVATIONS AND DISCLAIMERS. The above closure is expressly made SUBJECT TO all existing rights -of -way and easements of all public utilities of any and every description now located on and under or over the confines of the property and also SUBJECT TO the rights of entry thereon for the purposes of maintaining, altering, repairing, removing or rerouting said utilities, including the City's water and sewer facilities, and all of them. Said closure is also SUBJECT TO any existing rights -of -way or easements of private third parties. SECTION 3. EFFECTIVE DATE.
