(Closing a portion of 1300 South right-of-way
between 2321 and 2337 East
pursuant to Petition No. 400-94-77)
AN ORDINANCE CLOSING A PORTION OF 1300 SOUTH RIGHT-OF-WAY
BETWEEN 2321 AND 2337 EAST, PURSUANT TO PETITION NO. 400-94-77.
WHEREAS, the City Council of Salt Lake City, Utah, finds
after public hearing that the City's interest in the public
street described below is not necessary for use by the public as
a street and that closure of said street will not be adverse to
the general public's interest nor divest the City of title to the
property without subsequent documents of transfer, which shall
include easements to the City and other necessary development
restrictions.
NOW, THEREFORE, be it ordained by the City Council of Salt
Lake City, Utah:
SECTION 1. That a portion of 1300 South right-of-way
between 2321 and 2337 East, which is the subject of Petition No.
400-94-77 and which is more particularly described below, be, and
the same hereby is, CLOSED and declared no longer to be needed or
available for use as a public street, with the title remaining
with the City until subsequent sale for market value:
Said street is more particularly described as follows:
PARCEL "A" (TO BE DEEDED FROM S.L.C. TO MILLER)
A tract of land in the southeast quarter of Section 10,
Township 1 South, Range 1 East, Salt Lake Base and
Meridian, County of Salt Lake, State of Utah, more
particularly described as follows:
Begining at a point north 726.00 feet and north 89
degrees 58 minutes 57 seconds east 290.93 feet from the
south quarter corner of section 10, said point of
beginning also being north 89 degrees 58 minutes 57
seconds east along the monument line (basis of bearing)
151.72 feet and north 33.00 feet from the City Survey
Monument that bears south 89 degrees 58 minutes 57
seconds west 813.23 feet from the City Survey Monument at
the intersection of said 1300 South Street and Wasatch
Drive; thence South 11.00 feet; thence south 89 degrees
58 minutes 57 seconds west 73.97 feet to a point of
curvature; thence westerly along the arc of a 155.00 foot
radius curve to the left through a central angle of 18
degrees 34 minutes 01 second, a distance of 50.23 feet;
thence north 31 degrees 49 minutes 04 seconds west 11.40
feet to a point on the north line of 1300 South Street;
thence easterly along said 1300 South Street and the arc
of a 166.00 foot radius curve to the right through a
central angle of 19 degrees 27 minutes 30 seconds (center
bears south 19 degrees 28 minutes 33 seconds east) a
distance of 56.375 feet to a point of tangency; thence
north 89 degrees 58 minutes 57 seconds east along said
1300 South Street,73.97 feet to the point of beginning.
Contains 0.032 acres.
SECTION 2. RESERVATION AND DISCLAIMERS. The above closure
is expressly made SUBJECT TO all existing rights -of -way and
easements of all public utilities of any and every description
now located on and under or over the confines of the property and
also SUBJECT TO the rights of entry thereon for the purposes of
maintaining, altering, repairing, removing or rerouting said
utilities, including the City's water and sewer facilities, and
all of them. Said closure is also SUBJECT TO any existing
rights -of -way or easements of private third parties. The deed to

the closed portion shall include such development restrictions as
necessary to protect the City's interests.
SECTION 3. EFFECTIVE DATE. This ordinance shall become
effective on the date of its first publication and shall be
thereafter recorded with the Salt Lake County Recorder.
Passed by the City Council of Salt Lake City, Utah, this
