113 of 1994 - Requiring that City police officers, hired after December 15, 1994, as a condition of employment, be0 94-1 0 94-30 SALT LAKE CITY ORDINANCE No. 113 of 1994 (Requiring that City police officers, hired after December 15, 1994, as a condition of employment, be residents of the City within eighteen months after they are hired.) AN ORDINANCE REQUIRING THAT CITY POLICE OFFICERS, HIRED AFTER DECEMBER 15, 1994, AS A CONDITION OF EMPLOYMENT, BE RESIDENTS OF THE CITY WITHIN EIGHTEEN MONTHS AFTER THEY ARE HIRED. PREAMBLE The City finds that it has governmental interests in having its police officers reside within its jurisdiction. These governmental interests include the following: 1. The City has a car -per -officer program based, in part, on the public policy that permitting a police officer to take a City police car home in off -duty hours enhances community safety in the City through increased presence and visibility and by shortening response time in the event of emergencies. The purposes of the car -per -officer program are better served if the police officer lives in the City. 2. The City has an interest in enhancing community safety in the City through increased presence and visibility of police officers in the City. 3. The City has an interest in enhancing community safety through shorter response times by its police officers in the event of emergencies. 4. The City has an interest in promoting, in its police officers, community loyalty. 5. The City interests are better served if its police officers are residents and a part of this community; it makes them able to better understand and identify with the residents and their problems. 6. The City has an interest in enhancing its economy and tax base. 7. The City has a greater interest in having its police officers reside in the City than other classes of employees, among other reasons, because: it improves crime control; the car -per -officer program is more beneficial to the City; it promotes the City's desire to have greater visible police presence in the City; the communications equipment in their vehicles will be available for use in an emergency; and there is a higher probability of a shorter response time for crowd control and other necessary law enforcement during an emergency. 8. The City also finds that there is adequate housing available in the City, so that newly hired police officers can comply with the residency requirement. 9. Newly hired police officers should be provided a reasonable time, after they are hired, to change their residency to the City. The City finds that, considering the advance notice of the residency requirement, eighteen months following a hire date, is a reasonable time for such change. 10. Although the City has an interest in having its police officers reside in the City, it finds that presently it does not 2 desire to dislocate currently employed police officers. Over time, the City's objectives can be achieved, without imposing unexpected or unreasonable burdens on currently employed police officers, by limiting the new residency requirement to police officers hired after December 15, 1994. Be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. PURPOSE. The purpose of this ordinance is to establish, as a condition of employment, the requirement that police officers, hired after December 15, 1994, be residents of the City within eighteen months after the date they are hired as full-time employees of the City and each shall continue to be City residents throughout their employment. SECTION 2. RESIDENCY REQUIREMENT. A. As a condition of employment, police officers hired after December 15, 1994, shall be required to be residents of the City on or before eighteen months following the date they are hired. B. For purposes of this ordinance, persons are residents of the City, if the persons' place of habitation and domicile is permanently and definitely located in the City. Persons are not residents of the City if they: 1. come to the City for temporary purposes and without intending to make the City their permanent domicile; or 2. would otherwise not be eligible to be a registered voter in a City municipal election. 3 C. Residency in the City shall be a continuing condition of employment for police officers hired after December 15, 1994. D. The residency requirement provided in this ordinance shall not affect police officers hired prior to December 15, 1994 or to the promotions or assignments of such exempted police officers within the City Police Department. SECTION 3. NO EFFECT ON OTHER EMPLOYMENT CONDITIONS. The requirements in this ordinance shall not extend or otherwise affect police officers' probationary periods or the at -will status of police officers, during their probationary periods. The requirements in this ordinance shall not affect other conditions of employment imposed on City police officers. SECTION 4. IMPLEMENTATION. All job announcements and other recruitment notices to applicants for police officer positions with the City shall include notices of the residency requirements provided in this ordinance. SECTION 5. EFFECTIVE DATE. The effective date of this ordinance shall be December 15, 1994. Passed by the City Council of Salt Lake City, Utah, this 13 day of December , 19 94 .
