012 of 1997 - AN ORDINANCE VACATING A PORTION OF AN ALLEY RUNNING0 97-1 P 97-9 Affected Sidwell Numbers: 15-02-305-009 15-02-305-010 15-02-305-011 15-02-305-012 SALT LAKE CITY ORDINANCE No. 12 OF 1997 (Vacating a portion of an alley running north/south, located between Concord Avenue and Emery Street and between 300 South Street and Iola Avenue, pursuant to Petition No. 400-96-89) AN ORDINANCE VACATING A PORTION OF AN ALLEY RUNNING NORTH/SOUTH, LOCATED BETWEEN CONCORD AVENUE AND EMERY STREET AND BETWEEN 300 SOUTH STREET AND IOLA AVENUE, PURSUANT TO PETITION 400-96-89. WHEREAS, the City Council of Salt Lake City, Utah finds after public hearing that the City's interest in the alley described below is not necessary for use by the public as an alley and that vacation of said alley will not be adverse to the general public's interest. NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That a portion of the alley running north/south, located between Concord Avenue and Emery Street and between 300 South Street and Iola Avenue, which is the subject of Petition No. 400-96-89, and which is more particularly described below, be, and the same hereby is, vacated and declared no longer to be needed or available for use as an alley. Commencing at the northeast corner of Lot 2; Block 6 of the Golden Park Amended Plat, a subdivision located in the southwest quarter of Section 2, Township 1 South, Range 1 West, Salt Lake Base & Meridian; thence south 157 feet to the southeast corner of Lot 2 of said subdivision; thence east 15 feet to the southwest corner of Lot 1 of said subdivision; thence north 157 feet to the northwest corner of Lot 21 of said subdivision; thence west 15 feet to the point of beginning. SECTION 2. RESERVATIONS AND DISCLAIMERS. The above vacation is expressly made SUBJECT TO all City water, sewer and storm sewer rights -of -way and easements, and rights -of - way and easements of all public utilities of any and every kind now located on, under or over the confines of the property hereby vacated, and also SUBJECT TO the rights of entry upon said vacated property by the City and all public utilities for the purpose of maintaining, altering, repairing, removing or rerouting said facilities. Said vacation is also SUBJECT TO any existing rights -of -way or easements of private third parties. SECTION 3. TRANSFER OF TITLE. Title to the property is hereby transferred from the City to all abutting property owners on a pro rata basis. 2 SECTION 4. EFFECTIVE DATE. This ordinance shall become effective on the date of its first publication and shall be recorded with the Salt Lake County Recorder.
