SALT LAKE CITY ORDINANCE
No. 14 of 1982
(License and Business Regulation)
AN ORDINANCE AMENDING SECTIONS 20-10-6, 20-10-8, 20-10-11 ,
20-16-1 , 20-16-2, 20-16-3 AND 20-16-4 OF THE REVISED ORDINANCES
OF SALT LAKE CITY, UTAH, 1965, AS AMENDED, RELATING TO LICENSE
AND BUSINESS REGULATION.
Be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. That Sections 20-10-6, 20-10-8, 20-10-11, 20-16-
1, 20-16-2, 20-16-3 and 20-16-4 of the Revised Ordinances of Salt
Lake City, Utah, 1965, as amended, relating to license and
business regulation, be, and the same hereby are amended as
follows:
Sec. 20-10-6. Id. Records to be kept. It shall be
unlawful for any pawnbroker to fail to keep a record which shall
be legibly written in ink, in the English language, at the time
of each loan, purchase or receipt of personal property. Said
record shall contain: (1) an accurate account and description of
the goods, articles or things pawned, purchased or received, (2)
the amount of money loaned or advanced thereon, or paid therefor,
(3) the date, the time, both day and hour, of pawning, purchasing
or receiving such goods, articles or things, and (4) the name,
residence and description of the person pawning, selling or
delivering the said goods, articles or things, (5) a certificate
in writing that the person delivering the property has the legal
right to sell such property, and (6) if the value of the property
exceeds $20, the pawnbroker or person receiving said property
shall also require the seller or person delivering the property,
whether known or not, to give a legible print, preferably the
right thumb, at the bottom of the certificate next to his
signature and at least one other positive form and identification
containing a numerical identifier and photograph. No entry made
shall be erased, obliterated or defaced, and the said record, as
well as every article or thing pawned, pledged, sold or
deposited, shall at all reasonable times be open to the
inspection of any police officer, and it shall be unlawful for
any pawnbroker to deliver or to sell or to otherwise dispose of
any of said goods, articles or things for a period of thirty days
from the date of receiving same to any person other than to the
person pawning, pledging, selling or delivering said goods,
articles or things. If requested to do so by a police officer,
all goods, articles or things pawned, pledged, sold or delivered
to said pawnbroker, must be retained and held until released by
the police department or delivered to the police officer to be
placed in evidence if requested.
Sec. 20-10-8. Id. Dealing with proscribed persons. It
shall be unlawful for any pawnbroker to receive any goods,
articles, or things in pawn or pledge from a person who is
intoxicated or known to be an habitual drunkard, a thief or an
insane person, or a person under the age of eighteen years.
Sec. 20-10-11. Id. Connections with other business
prohibited. It shall be unlawful for any pawnbroker to keep or
maintain his pawnbroker business in the same room or rooms with
any other business whatsoever, except that a pawnbroker may also
carry on the business of a secondhand dealer or a secondhand
precious metal and/or precious gem dealer in conjunction with his
business as a pawnbroker. A pawnbroker licensed under the
provisions of this chapter shall be exempt from the licensing
regulations of section 20-16-2 of these revised ordinances
pertaining to secondhand dealer and secondhand precious metal
and/or precious gem dealer, which right shall be included under
the pawnbroker's license. A pawnbroker engaging in the business
of a secondhand dealer or a secondhand precious metal and/or
precious gem dealer shall, however, comply with all other
ordinances pertaining to such business. The partition walls
separating said pawnbroker's business from other places of

business must be of solid material, and all connecting doors or
other openings must be securely closed and locked at all times.
Gratings, lattice or similar open work or contrivance will not be
a sufficient partition under the provisions of this ordinance.
Patrons must enter and take their exit from all pawnbrokers'
places of business through outside doors and entrances.
Sec. 20-16-1. Definitions. For the purpose of this chapter
the following words shall have the meaning as herein defined.
(1) Secondhand dealer. "Secondhand dealer" shall mean any
person who keeps a store, office or place of business for the
purchase, barter or exchange or sale of any secondhand
merchandise of value, or who engages in the business of dealing
in secondhand goods. For the purpose of this chapter, a
"secondhand dealer" shall not be meant to include any person who
deals in the purchase, barter, exchange or sale of used motor
vehicles and trailers, nor a scrap metal processor licensed under
Section 20-16A-4 of these revised ordinances.
(2) Secondhand precious metal and/or precious gem dealer.
"Secondhand precious metal and/or precious gem dealer" shall mean
any person who engages in buying or selling old gold, silver,
platinum, other precious metal, secondhand articles containing
any of such metals, secondhand precious gems or any articles
containing any precious gems.
(3) Junk dealer. "Junk dealer" shall mean any person who
engages in buying or selling old metals (other than precious
metals), glass, rags, rubber, paper or other junk from a fixed
place of business. For the purposes of this chapter, a "junk
dealer" shall not include a scrap metal processor licensed under
Section 20-16A-4 of these revised ordinances.
(4) Junk collector. "Junk collector" shall mean any person
not having a fixed place of business in Salt Lake City who goes
from house to house or place to place gathering, collecting,
buying, selling or otherwise dealing in old rags, papers, metals

or other articles commonly known as junk.
(5) Antique dealer. Antique dealer shall mean any person
engaged in the business of selling old or archaic items which are
indicative of an older culture.
Sec. 20-16-2. License required. It shall be unlawful for
any person to operate as a secondhand dealer, secondhand precious
metal and/or precious gem dealer, junk dealer, junk collector, or
an antique dealer without first obtaining a license to do so.
Sec. 20-16-3. License fee. The license fee for each of the
occupations defined in this chapter shall be as follows:
(1) Secondhand dealer $50.00
(2) Secondhand precious metal dealer $100.00
(3) Antique dealer $50.00
(4) Junk dealer $200.00
(5) Junk collector $50.00
Sec. 20-16-4. Records to be maintained. (1) It shall be
unlawful for any person licensed by this chapter to fail to keep
a substantial and well-bound book, in which he shall enter at the
time of purchase, in the English language:
(a) A true and accurate description of every secondhand
article purchased by him.
(b) The name, age, description and residence of the vendor.
(c) The amount paid.
(d) The date and hour of purchase.
(2) In addition to the requirements of paragraph (1), a
secondhand dealer and a secondhand precious metal and/or precious
gem dealer shall also obtain and keep the following:
(a) A certificate in writing that the person delivering the
property has the legal right to sell such property.
(b) If the value of the property exceeds $20, the
secondhand dealer, secondhand precious metal and/or precious gem
dealer or persons receiving said property shall also require the
seller or person delivering the property, whether known or not,
to give a legible print, preferably the right thumb, at the

SECTION 2. This Ordinance shall take effect 30 days after
its first publication.
