017 of 1999 - Amending Chapter 21A.54.150 of the Salt Lake City Code regarding street width for infill development0 99-1 0 98-7 SALT LAKE CITY ORDINANCE No. 17 of 1999 (Amending Chapter 21A.54.150 of the Salt Lake City Code regarding street width for infill development projects) AN ORDINANCE AMENDING CHAPTER 21A.54.150 OF THE SALT LAKE CITY CODE REGARDING THE REQUIRED STREET WIDTH FOR RESIDENTIAL INFILL DEVELOPMENT PROJECTS, PURSUANT TO PETITION NO. 400-98-51. WHEREAS, the Salt Lake City Zoning Code currently requires a certain minimum street width for all publicly owned streets; and WHEREAS, for infill development projects which are unable to meet that minimum street width requirement, all streets and utilities are required to be privately owned and maintained; and WHEREAS, the City Council of Salt Lake City, Utah, finds after public hearings before its own body and before the Planning Commission that for some residential infill development projects, it may be advantageous to allow a reduced street width in order to both facilitate the development and to provide for public ownership of the streets and utility systems; and WHEREAS, the Salt Lake City Council now wishes to amend the zoning code to allow for a reduced street width in residential infill development projects, as a part of the conditional use process, and finds that such amendments are in the best interest of the City; NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That Section 21 A.54.150.E of the Salt Lake City Code shall be and hereby is amended to read as follows: E. Other standards. 1 . Minimum Area. A planned development proposed for any parcel or tract of land under single ownership or control shall have a minimum net lot area for each zoning district as set forth in Table 21A.54.150. 2. Density limitations. Residential planned developments shall not exceed the density limitation of the zoning district where the planned development is proposed. The calculation of planned development density may include open space that is provided as an amenity to the planned development. Public or private roadways located within or adjacent to a planned development, shall not be included in the planned development area for the purpose of calculating density. 3. Consideration of Reduced Width Public Street Dedication. A residential planned development application may include a request to dedicate the street to Salt Lake City for perpetual use by the public. The request will be reviewed and evaluated individually by appropriate departments, including transportation, engineering, public utilities, public services and fire. Each department reviewer will consider the adequacy of the design and physical improvements proposed by the developer and will make recommendation for approval or describe required changes. A synopsis will be incorporated into the staff report for review and decision by the Planning Commission. Notwithstanding the foregoing, no such street will be accepted as a publicly owned street unless there is a minimum width of 20 feet of pavement with an additional right-of-way as determined by the Planning Commission.
