018 of 1986 - Extending the expiration date of Bill No. 20, 57, 58 of 1984 0 86-1 P 84-35 SALT LAKE CITY ORDINANCE. No . 18 of 1986 (Extending the expiration date of Bills No. 20, 57 and 58 of 1984 ) AN ORDINANCE EXTENDING THE EXPIRATION DATE OF BILLS NO. 20, 57 AND 58 OF 1984, RELATING TO THE CLOSURE OF PUBLIC STREETS AND ALLEYS AND REZONING OF PROPERTY IN THE VICINITY OF NORTH TEMPLE, GARSIDE STREET (1500 WEST) , AND CORNELL STREET (1540 WEST) . RECITALS 1. Bill No. 20 of 1984 passed March 13, 1984, provided for the conditional closure of Sumner Avenue ( 200 North) and a parallel east/west 15' wide alley (175 North) , as both run from 1500 (Garside Street) to 1540 West ( Cornell Street) in Salt Lake City, Utah. Conditions subsequent were required to be completed before an expiration date of March 13, 1985, which has been extended to March 11, 1986, by Bills No. 9 and 68 of 1985 . 2. The petitioner, Chen International , has requested a six month extension of the expiration date, which the Council finds is not unreasonable, to allow compliance. 3. Bills No. 57 and 58 of 1984 were enacted to accommodate the conditional rezoning and closure of portions of public streets in said vicinity (Garside and Cornell) to accommodate the development of a State Office Park project. The original expiration date of said ordinances was extended by Bills No . 66 and 67 of 1985 to March 11, 1986. The Council finds that it is reasonable to extend the expiration date on said Bills for a period not to exceed six months, or to the date of September 11, 1986. THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That the expiration date before which all conditions must be satisfied as contained in Bills No. 20, 57 and 58 of 1984 which were extended to March 11, 1986 , is hereby exended to September 11, 1986. SECTION 2. This ordinance shall become effective as of the date of its first publication . Passed by the City Council of Salt Lake City, Utah, this 4th day of March, 1986. Pursuant to Petition No. 400-109-83, the Council enacted Ordinance No . 20 of 1984, which, inter al ia, closed a portion of Sumner Avenue and provided for sale of the property to the petitioner, Chen International . The ordinance required petitioner to construct curbs, gutters, sidewalks and pay for paving the area. It also required engineering and construction work for covering a canal , including piping . The ordinance had a 12-month condition on completion of the improvements . The conditions were not met in time and the ordinance was extended by Ordinance No. 68 of 1985 and then again byCD Ordinance No . 18 of 1986. �~ 00 This office chose to construe the requirements in Section 2 (4 ) of an alternative performance by posting a corporate surety or cash bond for the improvements to also apply to the canal improvements in Section 2 (3) . The work required pursuant to Ordinance No . 20 of 1984 has now been completed and approved by the City Engineer.
