(Vacating an alley located between Ramona Avenue and
Hollywood Avenue and between 1500 East and 1600 East,
pursuant to Petition No. 400-97-28.)
AN ORDINANCE VACATING AN ALLEY LOCATED BETWEEN RAMONA
AVENUE AND HOLLYWOOD AVENUE AND BETWEEN 1500 EAST AND 1600
EAST, PURSUANT TO PETITION NO. 400-97-28.
WHEREAS, the City Council of Salt Lake City, Utah,
finds after public hearing that the City's interest in the
alley described below is not necessary for use by the public
as an alley and that vacation of said alley will not be
adverse to the general public's interest.
NOW, THEREFORE, be it ordained by the City Council of
Salt Lake City, Utah:
SECTION 1. That an alley located between Ramona Avenue
and Hollywood Avenue and between 1500 East and 1600 East,
which is the subject of Petition No. 400-97-28, and which is
more particularly described below, be, and the same hereby
is, vacated and declared no longer to be needed or available
for use as an alley:
SEE EXHIBIT "A" ATTACHED HERETO
SECTION 2. RESERVATIONS AND DISCLAIMERS. The above
vacation is expressly made subject to all existing rights -
of -ways and easements of all public utilities of any and
every description now located on and under or over the
confines of the property and also subject to the rights of
entry thereon for the purposes of maintaining, altering,
repairing, removing or rerouting said utilities, including
the City's water and sewer facilities. Said vacation is
also subject to any existing rights -of -way or easements of
private third parties.
SECTION 3. TRANSFER OF TITLE. Upon vacation of the
alley, the east -west portion of the alley shall
automatically be transferred to the abutting property owners
located on the north of the alley. As to the north -south
portions of the alley, upon vacation, the alley shall
automatically be divided and transferred to all abutting
property owners on a pro rata basis.
SECTION 4. EFFECTIVE DATE. This ordinance shall
become effective on the date of its first publication and
shall be recorded with the Salt Lake County Recorder.
