An ordinance authorizing amendment of the Meridian Commerce Center Plat 2
subdivision and closing a portion of a public street located at the intersection of Commercial
Way and Meridian Park Road pursuant to Petition Nos.PLNSUB2014-00469 and
PLNPCM2014-00470.
WHEREAS,Utah Code sections 10-9a-608 and 10-9a-609.5 require a municipality's
legislative body to hold a public hearing when a subdivision plat amendment petition proposes to
vacate some or all of a public street;and
WHEREAS,the G&H Investments,LLC and Gloria Rothwell("Applicants")have
applied to amend the Meridian Commerce Center Plat 2 subdivision plat(Petition No.
PLNSUB2014-00469)and to close a portion of public street located at the intersection of
Commercial Way and Meridian Park Road(Petition No.PLNPCM2014-00470)where that street
features a"bulb-out";and
WHEREAS,the Salt Lake City Planning Commission held a public hearing on
September 10,2014 to consider the Applicants'petitions;and
WHEREAS,at its September 10,2014 hearing,the planning commission voted in favor
of forwarding a positive recommendation on said petitions to the Salt Lake City Council;and
WHEREAS,after holding a public hearing on this matter,the Salt Lake City Council
finds that there is good cause to adopt this ordinance authorizing the subdivision amendment and
partial street closure described herein and that neither the public interest nor any person will he
materially injured by the partial street closure.
NOW.THEREFORE.be it ordained by the City Council of Salt Lake City,Utah:
SECTION 1. Authorizing the Subdivision Amendment. That the city council authorizes
the amendment of the Meridian Commerce Center Plat 2 subdivision plat concerning the
proposed vacation of a portion of public streets,as shown in Exhibit"A"hereto("Meridian
Commerce Center Plat 2 Amended"),which is the subject of Petition No.PLNSUB2014-00469.
SECTION 2. Closing and Vacating Street. That a portion of public streets constituting a
"bulb-out"located at the intersection of Commercial Way and Meridian Park Road,which is the
subject of Petition No.PLNPCM2014-00470,and which is more particularly described on
Exhibit"B"attached hereto,hereby is.closed and vacated and declared no longer needed or
available for use as a public right-of-way,subject to the conditions set forth in Section 4 below.
SECTION 3. Reservations and Disclaimers. The above closure and vacation is expressly
made subject to all existing rights-of-way and easements of all public utilities of any and every
description now located on and under or over the confines of the subject street property,and also
subject to the rights of entry thereon for the purposes of maintaining,altering,repairing,
removing or rerouting said utilities,including the city's water and sewer facilities. Said closure
and vacation is also subject to any existing rights-of-way or easements of private third parties.
SECTION 4. Conditions. This street closure and vacation is conditioned upon
compliance with the method of property disposition described in Section 14.52.020,Method of
Disposition,and Chapter 2.58,City-Owned Real Property,of the Salt Lake City('ode,including
fair market value payment for the subject portions of public street to be closed.
SECTION 5. Effective Date. Ibis Ordinance shall become effective on the date of its
first publication and shall be recorded with the Salt Lake County Recorder. The city recorder is
instructed not to publish or record this ordinance until the condition identified above has been
met as certified by the city's planning director and real estate services division.
SECTION 6. Time. If the conditions identified above have not been met within one year
after adoption,this ordinance shall become null and void. The city council may,for good cause
shown,by resolution,extend the time period for satisfying the condition identified above.
SECTION 7. Effective Date. This ordinance shall become effective on the date of its first
publication or posting.
