AN ORDINANCE AMENDING Sections 38-1-5 and 51-5-16 of the
Revised Ordinances of Salt Lake City, Utah, 1965, as amended,
relating to use and landscaping of parking strips.
Be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. That Section 38-1-5 of the Revised Ordinances of
Salt Lake City, Utah, 1965, as amended, relating to specifications
for driveway construction, be, and the same hereby is, amended
to read as follows:
Sec. 38-1-5. Driveway construction.
(1) Permits. No permit shall be granted by the City
Engineer, without the favorable recommendation of the
Transportation Engineer, for any driveway exceeding
thirty feet in width except:
(a) In Industrial "M-1", "M-lA", "M-2" and "M-3"
districts, as set forth in Title 51 of these ordinances,
wherein driveways not exceeding forty (40) feet in
width may be permitted; and
(b) In developed areas where street construction
requires replacement of existing non-conforming
driveways, the City Engineer, upon favorable recommend-
ation from the Transportation Engineer, may allow
replacement of said non-conforming driveways when re-
location of said driveway is not practical and will
adversely affect traffic.
(2) Concrete thickness. No driveway, including sidewalk,
shall be less than six (6) inches thick; provided, however,
that the City Engineer may require that any driveway,
including sidewalk, must be at least eight (8) inches
thick when, in the opinion of the City Engineer, such
driveway and sidewalk will be used for heavy trucks,
vehicles or equipment.
(3) Multiple drives, islands and landscaping. When more
than one driveway is required for any parcel of land, a side-
walk island of at least twelve (12) feet in width shall be
provided and landscaped between such multiple driveways,
except in developed areas where the street construction re-
quires replacement of existing driveways with non-conforming
islands. In such circumstances, the City Engineer, upon the
favorable recommendation of the Transportation Engineer, may
allow the replacement of driveways with non-conforming islands
or separations of less than twelve (12) feet in width, when
relocation of said driveway is not practical and will not
adversely affect traffic. The City Engineer may direct that
areas between such multiple drives that are less than twelve
(12) feet in width, be paved if landscaping is impractical.
(4) Corner lot and violation. In no case shall a permit
be granted for a driveway which will be within ten (10) feet
of the property line where it abuts any street. It shall be
unlawful for any person to drive any vehicle from a driveway
to the abutting street or across a street corner.
(5) Denial for dangerous conditions. where, in the
opinion of the City Engineer, upon recommendation of the
Transportation Engineer, it would be dangerous because of
traffic or because a driveway conflicts with any permanent
improvements or waterway, said director may refuse to
issue the requested driveway permit. Said denial by the
City Engineer shall be final unless the applicant appedls
the matter to the Board of Adjustment. The Board of
Adjustment shall have the authority and discretion to
either affirm the City Engineer's decision or specify
the conditions and location upon which a driveway may
be permitted.
SECTION 2. That Section 51-5-16 of the Revised Ordinances
of Salt Lake City, Utah, 1965, as amended, relating to the use
and landscaping of parking strips, be, and the same hereby is
amended to read as follows:
Sec. 51-5-16. Parking strips. The parking strip or the
area of the street located between the curb line and the
private property line shall be completely landscaped with
vegetation and maintained by the abutting property owner.
Said area shall be kept free of all hard surfacing, includ-
ing stone or aggregate, except for approved driveway and
sidewalk areas, and except as may be specifically authorized
in writing by the Planning Commission, with the approval of
the Mayor. In all use districts where the parking strip or
the area between the curb line and the sidewalk is three (3)
feet or less, the Planning Commission may approve the install-
ation of concrete with tree planter pits spaced no less than
forty (40) feet on center or at least one pit per lot frontage.
SECTION 3. This ordinance shall take effect 30 days after
the date of its first publication.
Passed by the City Council of Salt Lake City, Utah, this
