WHEREAS, the City Council of Salt Lake City, Utah, has held public hearings before its own body and before the Planning Commission, and has taken into consideration citizen testimony, filing and demographic details of the area, the long-range general plans of the City, and any local master plan as part of its deliberations. Pursuant to these deliberations, the City Council has concluded that the proposed change of zoning for the properties located at the northwest corner of 300 South and Montgomery Street is appropriate for the development of the community in that area. NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That properties located at the northwest corner of 300 South and Montgomery Street, which are more particularly described on Exhibit " A" attached hereto, shall be and hereby are rezoned from R-1-5000 to SR-3. SECTION 2. Amendment of Zoning Map. The Salt Lake City Zoning Map, as adopted to the Salt Lake City Code, relating to the fixing of boundaries in zoning districts, shall be, and hereby is amended consistent with the rezoning identified above. SECTION 3. Conditions. This rezoning is subject to the following conditions: 1. Development of the property according to the site plan submitted to the City; 2. Creation of a homeowners' association to assure the long-term maintenance of the berm along the north property line; 3. Vacation of the relevant portion of the Irving Park Addition Subdivision by the Salt Lake City Council; 4. Submission and approval of a subdivision plat pursuant to Salt Lake City's subdivision ordinance, and consistent with the concept plan submitted to the City; 5. Approval by the Salt Lake City Planning Director of the final plans for the sound attenuation berm, including 2 plans for its long-term maintenance, as part of the administrative consideration of the subdivision; 6. Approval by the Salt Lake City Planning Director of the final design for a small portion of the development to be common open space; and 7. Preliminary approval of the subdivision consistent with the approval received from the local community council and the concept plan submitted to the City. SECTION 4. Effective Date. This ordinance shall become effective on the date of its first publication and shall be recorded with the Salt Lake County Recorder. The City Recorder is instructed not to record or publish this ordinance until the conditions identified above have been met, or until the property owner(s) have entered into a binding development agreement, as certified by the Salt Lake City Planning Director. If the conditions identified above have not been met, or if a satisfactory development agreement has not been executed, within one year from the date of this ordinance, the City Recorder is instructed not to record or publish this ordinance which shall become null, void and have no effect. 3 Passed by the City Council of Salt Lake City, Utah, this 1€th day of March , 1999.
