(Closing 700 South Street Between Blocks 11 and 14,
Plat C from approximately 700-775 West)
WHEREAS, Petition No. 21 of 1982, submitted by the L.D.S
Church, as amended, requests the vacation of two parcels,
including: (1) a 17 foot alley running east/west at
approximately 675 South from 725-775 West; and (2) 700 South
Street from approximately 775 West, east to I-15, which separates
the petitioner's properties within Blocks 11 and 14, Plat C, Salt
Lake City Survey; and
WHEREAS, a review of said petition indicates that vacation
would be contrary to the policy of the City, but in lieu thereof,
that closure would be appropriate, based upon findings that
portions of said streets are no longer necessary for use as
public streets, avenues, or alleys, but should be closed, with
the public interest being retained for anticipated transfer of
fair market value to abutting property owners, based on certain
conditions and reservations;
THEREFORE, be it ordained by the City Council of Salt Lake
City, Utah:
SECTION 1. That the following described two parcels of land
located in or between Blocks 11 and 14, of Plat "C", Salt Lake
City Survey of Salt Lake County, Utah are more particularly
described below, be, and the same are hereby closed and declared
no longer to be needed or available for use as a public street,
avenue, alley or pedestrian ways, but that the public's interest
therein shall be reserved for a contemplated transfer for the
fair market value of the property.
Parcel No 1 700 South Street from a point 165
feet East of 800 West Street, East to UDOT's I-15
right-of-way (700-775 West) in Salt Lake City:
Beginning at the southwest corner of Lot 39, Block
1, Kimballs Subdivision as recorded in the Office
of the Salt Lake County Recorder, bearing base
being Arapahoe Avenue monument line North
89*57133" East, and running thence East along the
south line of said Block 1 to a point that is 18.5
feet East of the Southeast corner of Lot 50 of
said Block 1, Kimballs Subdivision; thence
Southeasterly along the west right-of-way line of
State highway to a point that is on the North line
of Lot 8, Block 11, Plat C, Salt Lake City Survey;
thence West along the North line of Block 11 to a
point that is 12.44 feet West of the Northwest
corner of Lot 6, Block 11, Plat C. Salt Lake City
Survey; thence North 132.91 feet to the point of
beginning. Contains 44,790.67 square feet or
1.028 acres.
Parcel 2: 17 foot east/west alley at approxi-
mately 675 South from approximately 725-775 West
in Salt Lake City.
Beginning at the Southwest corner of Lot 26, Block
1, Kimballs Subdivision as recorded in the office
of the Salt Lake County Recorder, bearing base
being Arapahoe Avenue monument line North
89°57'33" East, and running thence East along the
lot line 191 feet more or less to the west right-
of-way line of the State highway; thence
Southeasterly along said right-of-way to a point
that is 6.5 feet West of the Northeast corner of
Lot 46, Block 1, Kimballs Subdivision; thence West
along the lot line 193.5 feet to the Northwest
corner of Lot 39, Block 1, Kimballs Subdivision;
thence North 17.0 feet to the point of begin-
ning. Contains approximately 3,264 square feet or
0.075 acres.
Said closures are expressly made subject to a
reservation to all existing rights-of-ways and
easements of all public utilities of any and every
description, now located on, in, under or over the
confines of the above described property and also
subject to the reservation of rights of entry
t ereon for the purpose of obtaining, altering,
replacing, removing, repairing, or rerouting said
utilities and all of them. It is expressly noted
that there are existing water mains, fire
hydrants, sewer systems, etc., and may be
others. A utility easement is also believed to
exist along the right of way line of UDOT's
Interstate I-15. These connections and systems
are hereby reserved and must be preserved as part
of said utility easements.
SECTION 2. This ordinance, after the date of its first
publication, shall not become effective until recorded with the
Recorder of Salt Lake County. However, the City Recorder of Salt
Lake City is instructed that she shall not proceed with such
recording until the Mayor of Salt Lake City, based on the
recommendations of the City Engineer and the City Attorney verify
that the fair market value and cost of appraisal have been
received, together with an executed agreement assuring satis-
faction of the following conditions subsequent, are completed

prior to issuance of building permits:
(1) The site design must provide access to the UDOT
easement somewhere on 700 South
(2) The petitioner must provide a drainage plan of the
entire site, including all of 700 South between Blocks
11 and 14 of Plat "C". Said plan must be engineered
and comply with standard specifications to obtain the
City Engineer's approval prior to permit issuance.
(3) That before building permits are issued, petitioner
shall prepare and submit street plans for the entire
site including all of 700 South between said blocks
(both private and public). Said plans shall design
the proposed public way improvements. After review,
the City Engineer shall be entitled to designate
existing or needed street related improvements that
may require replacement or construction along the
length of said streets between blocks as part of
petitioner's project.
Upon verification, Mayor may transfer the property and
record this ordinance concurrently with the transfer documents.
However, if the foregoing conditions are not completed
within twelve (12) months from date of passage, this ordinance
shall be null, void and of no effect; and no recording shall
thereafter be allowed.
Passed by the City Council of Salt Lake City this 16th day
of March, 1982.
