SALT LAKE CITY ORDINANCE
No. 22 OF 1997
(Terminating temporary moratorium prohibiting the issuance
of building permits within the Capitol Hill Area)
AN ORDINANCE TERMINATING THE TEMPORARY MORATORIUM
ENACTED AS ORDINANCE NO. 92 OF 1996, PROHIBITING THE
ISSUANCE OF BUILDING PERMITS FOR CERTAIN SPECIFIED
DEVELOPMENTS WITHIN CERTAIN DESCRIBED BLOCKS IN THE CAPITOL
HILL AREA.
WHEREAS, on or about December 10, 1996, the Salt Lake
City Council enacted Ordinance No. 92 of 1996, providing a
temporary moratorium prohibiting the issuance of building
permits for certain specified developments within certain
described blocks in the Capitol Hill Area; and
WHEREAS, in response to the enactment of that temporary
moratorium, the developer of certain property in the Capitol
Hill Area filed suit against Salt Lake City; and
WHEREAS, the Salt Lake City administration has now
negotiated a proposed agreement with the developer by which
the litigation initiated by the developer would be
dismissed; and
WHEREAS, one of the essential terms of that agreement
is the withdrawal of that temporary moratorium; and
WHEREAS, after a public hearing, the City Council finds
that an agreement is in the best interests of the City.
NOW, THEREFORE, be it ordained by the City Council of
Salt Lake City, Utah:
SECTION 1. That the temporary moratorium enacted as
Ordinance No. 92 of 1996, shall be and hereby is terminated.
SECTION 2. EFFECTIVE DATE. This ordinance shall
become effective upon the filing of the documents necessary
to obtain a dismissal of the developer's lawsuit against the
City with prejudice.
