(VACATING AN INTERIOR 500' PORTION
OF A 12' EAST/WEST ALLEY FROM
1400-1500 EAST STREET, SITUATED
BETWEEN HOLLYWOOD AND RAMONA AVENUES)
WHEREAS, Petition No. 602 of 1981, submitted by Alexander M.
Hendricks III, et al., requested the vacation of a 12' east/west
alley located between Hollywood and Ramona Avenues running from
1400 to 1500 East Street; and
WHEREAS, a review of said petition indicates that vacation
of a 500' interior portion thereof would be consistent with the
policy of the City and that vacation would be appropriate, based
upon the findings that said portion of said alley is no longer
necessary for use as a public street, avenue or alley, but should
be vacated;
Therefore, be it ordained by the City Council of Salt Lake
City, Utah;
SECTION 1. That a 500' portion of the interior of a 12'
east/west alley which runs from 1400 to 1500 East Street between
Ramona and Hollywood Avenues in Block 3, Westminster Heights
Plat "A" Subdivision in Salt Lake City, Utah, more particularly
described below, be, and the same hereby is, CLOSED, VACATED, AND
DECLARED no longer to be needed for use as a public street,
avenue, alley or pedestrian way, pursuant to the conditions set
forther herein. However, it is not the intention of this ordinance
to vacate, or in any way close the remaining portions of said
alley to deprive access off of 1400 and 1500 East Streets for the
remnant of the alley not vacated by this ordinance.
Commencing at the Southwest corner, Lot 3, Block 3,
WESTMINSTER HEIGHTS, PLAT "A", SUBDIVISION, being a
part of the Five Acre Plat "C", Big Field Survey;
thence West 500 feet, more or less, along the North
line of a 12' alley to the Southwest corner of Lot
23, said block and subdivision; thence South 12 feet
to the Northwest corner of Lot 36, said block; thence
East along the South line of said alley 500 feet,
more or less, to the Northeast corner of Lot 55, said
block; thence North 12 feet to the point of beginning.
Said VACATION is expressly made SUBJECT TO all existing
rights-of-ways and easements of all public utilities
of any and every description now located on, in, under
or over the confines of the above-described property;
and also SUBJECT TO the rights of entry thereon for
the purpose of obtaining, altering, repairing,
replacing, removing, or rerouting said utilities and
all of them. It is expressly noted that there are
existing overhead utilities located within said
property included with such reservation.
Said VACATION is also SUBJECT TO any existing rights-
of-ways or easements of private third parties.
SECTION 2. This ordinance shall be effective thirty (30)
days from the date of its publication.
Passed by the City Council of Salt Lake City, Utah, this
6th day of April 1982.
