023 of 1997 - AN ORDINANCE REZONING PROPERTY LOCATED AT THE NORTHEAST0 97-1 P 97-16 Affects Sidwell No.: 16-29-230-007 SALT LAKE CITY ORDINANCE No. 23 of 1997 (Rezoning property located at the Northeast corner of Richmond Street and Zenith Avenue pursuant to Petition No. 400-97-3.) AN ORDINANCE REZONING PROPERTY LOCATED AT THE NORTHEAST CORNER OF RICHMOND STREET AND ZENITH AVENUE FROM MEDIUM DENSITY RESIDENTIAL (RMS-30) TO COMMERCIAL BUSINESS (CB), PURSUANT TO PETITION NO. 400-97-3. WHEREAS, the City Council of Salt Lake City, Utah, has held public hearings before its own body and before the Planning Commission, and has taken into consideration citizen testimony, filing and demographic details of the area, the long range general plans of the City, and any local master plan as part of its deliberations. Pursuant to these deliberations, the City Council has concluded that the proposed change of zoning for the property located at the northeast corner of Richmond Street and Zenith Avenue is appropriate for the development of the community in that area, subject to the conditions set forth herein. NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That that the property located at the northeast corner of Richmond Street and Zenith Avenue, at 1249 East Zenith Avenue, which is more particularly described below, shall be and hereby is rezoned from Medium Density Residential (RMF-30) to Commercial Business (CB). This real property is more particularly described as follows: Commencing North 89°59'58" East 458.25 feet and North 0°04'23" East 31.5 feet from the Southwest corner of Lot 12, Block 27, Ten Acre Plat "A", Big Field Survey, and running thence North 89°59'58" East 64 feet; and running thence North 158 feet; thence West 68 feet; thence South 1°32'00" West 158.1 feet to the point of beginning. SECTION 2. AMENDMENT OF ZONING MAP. The Salt Lake City Zoning Map, as adopted by the Salt Lake City Code, relating to the fixing of boundaries and zoning districts, shall be, and hereby is amended consistent with the rezoning identified above. SECTION 3. CONDITIONS. This rezoning is subject to the following conditions: 1. That the principal building maintain a hip or gable roof; 2. No access drive to Richmond Street shall N) cn be provided; UD 2 �.D 3. That final landscape plans be approved by the Planning Director. Those landscape plans include street trees and intensified landscaping on the front and corner side yards; 4. That the site access sidewalk be extended to Zenith Avenue to provide pedestrian access; and 5. That the Planning Director shall have discretion to impose additional conditions to reduce parking to a level that is consistent with the usage of the building but also preserving as much green space as possible. SECTION 4. EFFECTIVE DATE. This ordinance shall become effective on the date of its first publication and shall be recorded with the Salt Lake County Recorder. The City Recorder is instructed not to record or publish this ordinance until the conditions identified above have been met, as certified by the Salt Lake City Planning Director. If the conditions identified above have not been met within one year from the date of this ordinance, the City Recorder is instructed not to record or publish this ordinance, which shall become null, void and have no effect. 3 Passed by the City Council of Salt Lake City, Utah, this 20th day of May , 1997.
