Rezoning of properties. The properties located at 728, 732, 752, and 766 North Redwood Road, which are more particularly identified on Exhibit "A" attached hereto, shall be and hereby are rezoned from Single Family Residential (R-l/5,000) to Community Business (CB). SECTION 2. Amending zoning map. The Salt Lake City zoning map, as adopted by the Salt Lake City Code, relating to the fixing of boundaries and zoning districts, shall be and hereby is amended consistent with the rezoning identified above. SECTION 3. Conditions. This rezoning is conditioned upon the following: a. Combination of the lots located at 728, 732, 752, and 766 North Redwood Road into one legal description, as certified by the City's Planning Director; b. Execution and recording of an avigation easement acceptable to the City Airport and Planning Division; c. Demolition of the housing may not occur until a building permit has been issued by the City; and d. Prior to issuance of a building peiluit for demolition of the housing referenced above, the petitioner herein shall donate a housing mitigation fee in the amount of $ 74,956 _ [to be deteiiuined by the City Council] payable to the Housing Trust Fund. SECTION 4. Effective Date. This ordinance shall become effective on the date of its first publication and shall be recorded with the Salt Lake County Recorder. The City Recorder is instructed not to publish or record this ordinance until the conditions identified above have been met, as certified by the Salt Lake City Planning Director. SECTION 5. Time. If the conditions identified above have not been met within one year after adoption, this ordinance shall become null and void. The City Council may, for good cause shown, by resolution, extend the time period for satisfying the conditions identified above.
