(Rezoning property subject to certain
conditions located at 2117-2165 South Green
Street pursuant to Petition No. 400-892-91)
AN ORDINANCE AMENDING SECTION 21.14.020 OF THE SALT LAKE
CITY CODE RELATING TO ZONING AND FIXING OF BOUNDARIES OF USE
DISTRICTS PURSUANT TO PETITION NO. 400-893-91.
WHEREAS, in response to the rezoning petition initiated by
DEE'S INCORPORATED, No. 400-893-91, the City Council of Salt Lake
City, Utah has held public hearings before its own body and
before the Planning Commission, and has taken into consideration
citizen testimony, filing and demographic details of the area and
the Master Plan as part of its deliberation. Pursuant to these
deliberations, the Council has concluded that the proposed change
of zoning for the property located at 2117-2165 South Green
Street is appropriatefor the development of the community in
that area; and
WHEREAS, the rezoning contemplated by this petition will
involve the demolition of necessary housing stock which the
petitioner has voluntarily agreed to compensate the City for by
the payment of $4,000 for each of the four houses to the City's
Housing Trust Fund.
THEREFORE, the City Council of Salt Lake City, Utah hereby
adopts the following amendments to the Use District provisions of
Title 21.
Be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. That the Use District Map, as adopted by Section
21.14.020 of the Salt Lake City Code, relating to the fixing of
boundaries of Use Districts, be, and the same hereby is, AMENDED
to read as follows:
Sec. 21.14.020. Boundaries of Districts --Use District Map
Adopted.
That the following -described parcel of real property in Salt
Lake City, Utah presently zoned Residential "R-2" is hereby
rezoned Commercial "C-1" and the Use District Map is amended
accordingly:
Beginning at a point being the northwest corner of Lot
36 of Sixth East Subdivision; thence east 118 feet more
or less to the northeast corner of Lot 36 of said
subdivision; thence south 450 feet more or less to the
southeast corner of Lot 27 of Sixth East Subdivision;
thence west 118 feet more or less to the southwest
corner of Lot 27 of said subdivision; thence north 450
feet more or less to the point of beginning.
SECTION 2. CONDITIONS. The above rezoning shall not become
effective until the following conditions have been satisfied:
A. The petitioners have applied for and obtained, subject
only to the effectiveness of this rezoning, a building permit for
the construction proposed in petition No. 400-893-91; and
B. The petitioners have voluntarily deposited in the City's
Housing Trust Fund $16,000 in compensation and mitigation of the
housing to be demolished pursuant to construction allowed by this
rezoning.

SECTION 3. EFFECTIVE DATE. This ordinance shall become
effective on the date of its first publication and shall be
recorded with the Salt Lake County Recorder. The City Recorder
is instructed to not record or publish this ordinance until the
Mayor certifies that the conditions specified in Section 2 above
have been complied with. In the event that such conditions are
not satisfied within one year from the date of this ordinance the
Mayor may, by written certification, extend the time for
compliance with the conditions an additional year. In the event
that the conditions have not been satisfied within the first year
or the subsequent extension this ordinance shall be null, void
and of no effect and the City recorder is instructed to not
publish it.
