028 of 1988 - Amending Section 21.78.060 of Code Relating to Parking Lots in Residential Districts O 88-1 O 88-5 e SALT LAKE CITY ORDINANCE No. 28 of 1988 (Amending Section 21.78.060 of the Salt Lake City Code relating to Parking lots as nonconforming uses in residential districts) AN ORDINANCE AMENDING SALT LAKE CITY CODE SECTION 21. 78.060 RELATING TO PARKING LOTS AS NONCONFORMING USES IN RESIDENTIAL DISTRICTS. WHEREAS, the City Council of Salt Lake City, Utah, has held public hearings before its own body and before the Planning Commission and has taken into account citizen testimony and other matters as part of its deliberation and pursuant to these deliberations has concluded that a modification of the provisions regarding parking lots as nonconforming uses in residential districts is in the best interests of the City; THEREFORE, the City Council of Salt Lake City, Utah, hereby adopts the following amendment to Section 21. 78.060 of the Salt Lake City Code: SECTION 1. That Section 21.78.060 be AMENDED to read as follows: Sec. 21. 78.060 Parking lots in residential districts. A. Where not otherwise authorized by this title, and not withstanding Section 21.90.040(B)(3) and when in its opinion the best interests of the community will be served thereby, the Planning Commission, following an informal hearing, may permit, temporarily or permanently, the use of land in a residential district for a parking lot, provided that in such cases: 2. 9e �Y 3. * 4. 5. 6. All parking is to be kept back of the setback building line by barrier unless otherwise specifically authorized by the Planning Commission; 7. *** 8. There may be imposed such other conditions as may be deemed necessary by the Planning Commission to protect the character of the residential district, including, but not limited to increased landscaping and yard areas. B. If the proposed parking lot is associated with an adjacent nonconforming use, the Planning Commission may not approve the parking lot unless it specifically finds: 1. That the parking lot is needed to solve existing parking and traffic problems; 2. That approval of the parking lot would lessen the congestion on the streets and in the neighborhood; 3. That the parking lot will not contribute to increased use of the nonconforming use and is of such a size and design so as not to encourage any future expansion of any nonconforming activities on the adjacent property; and 4. That the proposed parking facilities will overcome existing problems in the neighborhood and will contribute to the stability of the neighborhood. Prior code §51-6-7 -2- SECTION 2.
