003 of 1996 - Enacting new Section 3.24.220 of the Salt Lake City Code, and amending Sections 3.24.050 and 3.24.100 96-1 0 96-3 SALT LAKE CITY ORDINANCE No. 3 of 1996 (Enacting new Section 3.24.220 of the Salt Lake City Code, and amending Sections 3.24.050 and 3.24.100, relating to small purchases of supplies.) AN ORDINANCE ENACTING SECTION 3.24.220 OF THE SALT LAKE CITY CODE, FOR THE PURPOSE OF (1) AUTHORIZING PURCHASES OF SUPPLIES UNDER $500 TO BE MADE, AT THE DISCRETION OF A DEPARTMENT DIRECTOR, EITHER (A) THROUGH THE OFFICE OF THE CHIEF PROCUREMENT OFFICER ON BEHALF OF SUCH DEPARTMENT, OR (B) DIRECTLY BY SUCH DEPARTMENT, AND (2) ELIMINATING CERTAIN PROCEDURAL REQUIREMENTS WITH RESPECT TO SUCH SMALL PURCHASES; AND AMENDING SECTIONS 3.24.050 and 3.24.100 OF THE SALT LAKE CITY CODE TO MAKE CONFORMING CHANGES. Be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. The following new Section 3.24.220 of the Salt Lake City Code is hereby enacted, to read as follows: 3.24.220. Small Purchases. A. Authorization of Direct Small Purchases. Notwithstanding any provisions of this Chapter 24 to the contrary, any small purchase of supplies or equipment required for a department may be made, at the discretion of the director of such department, either (a) through the office of the chief procurement officer, as authorized above in this Chapter 24, or (b) directly by such department pursuant to poLicies and procedures established by the chief procurement officer and without regard to the requirements of this Chapter 24; provided that: (i) the provisions of Sections 3.24.010 (A) (relating to public purpose), 3.24.080 (relating to prohibition of interest), and 3.24.210 (relating to subdividing purchases) shall apply to small purchases, and (ii) each director authorizing small purchases shall assure that all department employees making small purchases shall be informed of the requirements of Sections 3.24.010 (A), 3.24.080 and 3.24.210, and the policies and procedures for small purchases established by the chief procurement officer. B. Definition. For purposes of this Section 3.24.220, "small purchase" means a purchase of supplies or equipment, by purchase order or otherwise, which does not exceed $500. SECTION 2. Section 3.24.050 shall be amended to read as follows: 3.24.050. Chief procurement officer - Defined - Duties. A. "Chief procurement officer" means the procurement official or officials as designated by the mayor or an authorized designee of such procurement official or officials. B The city's chief procurement officer shall order and purchase supplies and contractual services needed by the city or any of its departments or divisions, including the office of the mayor, in accordance with city ordinance and such policies and procedures adopted by the chief procurement officer for the internal management and operation of such purchasing function. Notwithstanding the foregoing, the chief procurement officer shall establish policies and procedures governing small purchases under Section 3.24.220, and such small purchases shall be the responsibility of the authorizing department director. Any purchase order or contract made contrary to the requirements of this Chapter and all applicable policies and procedures shall be void and not binding against the city. SECTION 3. The Section heading for Section 3.24.100 is hereby amended to read as follows: Section 3.24.100. Telephone quotations . SECTION 4. This Ordinance shall take effect upon its first publication.
