AN ORDINANCE CLOSING A PORTION OF HUBBARD AVENUE NEAR 367
EAST AND A PORTION OF 400 EAST NEAR ITS INTERSECTION WITH HUBBARD
AVENUE, PURSUANT TO PETITION NO. 400-95-93.
WHEREAS, the City Council of Salt Lake City, Utah, finds
after public hearing that the City's interest in the public
streets described below is not necessary for use by the public as
streets, and that closure of said streets will not be adverse to
the general public's interest nor divest the City of title to the
property without subsequent documents of transfer.
NOW, THEREFORE, be it ordained by the City Council of Salt
Lake City, Utah:
SECTION 1. That the portion of Hubbard Avenue near 367 East
and the portion of 400 East near its intersection with Hubbard
Avenue, which are the subject of Petition No. 400-95-93 and which
are more particularly described below, be, and the same hereby
are, CLOSED and declared no longer to be needed or available for
use as public streets, with the title remaining with the City
until subsequent sale for market value.
Said streets are more particularly described as
follows:
Area along 400 East to be vacated:

Beginning 33.00 feet West and 289.10 feet South of the

near its intersection with Hubbard Avenue,
pursuant to Petition No. 400-95-93)
AN ORDINANCE CLOSING A PORTION OF HUBBARD AVENUE NEAR 367
EAST AND A PORTION OF 400 EAST NEAR ITS INTERSECTION WITH HUBBARD
AVENUE, PURSUANT TO PETITION NO. 400-95-93.
WHEREAS, the City Council of Salt Lake City, Utah, finds
6 after public hearing that the City's interest in the public
I11 streets described below is not necessary for use by the public as
streets, and that closure of said streets will not be adverse to
(d the general public's interest nor divest the City of title to the
property without subsequent documents of transfer.
NOW, THEREFORE, be it ordained by the City Council of Salt
C Lake City, Utah:
SECTION 1. That the portion of Hubbard Avenue near 367 East

J Avenue, which are the subject of Petition No. 400-95-93 and which
are more particularly described below, be, and the same hereby
are, CLOSED and declared no longer to be needed or available for
use as public streets, with the title remaining with the City
until subsequent sale for market value.
Said streets are more particularly described as
follows:
Area along 400 East to be vacated:
Beginning 33.00 feet West and 320.10 feet South of the
Northeast Corner Lot 11, Block 20, Five Acre Plat
"A", Big Field Survey, and running thence North
89°56' 39 " East 1.25 feet; thence South 00°02' 18 " East
44.00 feet; thence South 89°56'39" West 1.25 feet;
thence North 00°02'18" West 44.00 feet to the point of
beginning. Containing 0.0013 acres (55 sq ft).
Area along Hubbard Avenue to be vacated:
Beginning 33.00 feet West and 351.10 feet South of the
Northeast Corner Lot 11, Block 20, Five Acre Plat
"A", Big Field Survey, and running thence South
00°02'18" East 13.00 feet; thence South 89°56' 39 " West
166.25 feet; thence North 00°02'18" .West 13.00 feet;
thence North 89°56'39" East 166.25 feet to the point
of beginning. Containing 0.049 acres.
Second area along Hubbard Avenue to be vacated:
Beginning 197.98 feet West and 351.26 feet South of the
Northeast Corner Lot 11, Block 20, Five Acre Plat
"A", Big Field Survey, and running thence South
00°02' 1.8 " East 13.00 feet to a point of curve, radial
line bears North 00°02'18" West; thence Northwesterly
13.40 feet along a curve concave to the North, having a
radius of 17.07 feet to the beginning of a reverse
curve concave to the South having a radius of 17.07
feet which radial bears North 00°02'18" East; thence
Northwesterly 13.40 feet along said curve; thence South
89°56' 39 " West 17.13 feet; thence North 00°02'18" West
3.00 feet; thence North 89°56'39" East 41.25 feet to
the point of beginning. Containing 0.0046 acres (244
sq ft).
SECTION 2. RESERVATION AND DISCLAIMERS. The above closure
is expressly made SUBJECT TO all existing rights -of -way and
easements of all public utilities of any and every description
now located on and under or over the confines of the property and
also SUBJECT TO the rights of entry thereon for the purposes of
maintaining, altering, repairing, removing or rerouting said
utilities, including the City's water and sewer facilities, and
all of them. Said closure is also SUBJECT TO any existing
rights -of -way or easements of private third parties.

SECTION 3. EFFECTIVE DATE. This ordinance shall become
effective on the date of its first publication and shall be
thereafter recorded with the Salt Lake County Recorder.
