AN ORDINANCE RECOGNIZING THE ADOPTION OF AMENEMENT 5(A) TO
THE MASTER ANNEXATION POLICY DECLARATION; EXTENDING THE LIMITS OF
SALT LAKE CITY TO INCLUDE THE "CALDER ANNEX" , ZONING THE SAME
"C-1" , BY AMENDING THE USE DISTRICT MAP AS ADOPTED BY SECTION
51-12-2 OF THE REVISED ORDINANCES OF SALT LAKE CITY, UTAH, 1965
AS AMENDED; AMENDING SALT LAKE CITY COUNCIL DISTRICT AND SCHOOL
PRECINCT BOUNCARY MAPS ; AND SPECIFYING CONDITIONS PRECEDENT TO
SAID ANNEXATION.
WHEREAS, a petition has been filed with the City Recorder of
Salt Lake City, Petition No. 400-274, together with a plat
showing the tract of land to be annexed and hereafter known as
the "Calder Annex" , requesting that the contiguous, irregularly
shaped parcel of approximately 2. 75 acres, more or less, of
unincorporated territory lying in the Brickyard Area of Salt Lake
County, lying approximately near 3130 South Highland Drive, be
taken within the limits of Salt Lake City Corporation to extend
the city' s limits; and

WHEREAS, the petition was signed by a majority of the owners co
of real property and the owners of more than one-third in value
of all the real property as shown by the last assessment rolls ,

situated in the tract hereinafter described; and ►ice
WHEREAS, in order to facilitate the orderly extension of the
city' s boundaries , the City has a Master Annexation Policy
Declaration adopted June 20, 1979. The proposed annexation lies
within Study Area No. 5 of said declaration and is the specific
subject of Amendment 5 (A) of said declaration which was approved
after favorable Planning Commission reviews ; and
WHEREAS, the City Council of Salt Lake City, after examining
the petition and having the petition favorably reviewed by
various departments of the City and the Planning Commission, and
having considered the circumstances thereof at a publicly
advertised hearing held April 7 , 1987, after_ finding said
proposed annexation to be consistent and in keeping with the
City' s Master Annexation Policy Declaration for Study No . 5 and
Amendment 5(A) , said Council voted by two-thirds or greater vote
of its membership, in favor of said annexation; and
WHEREAS, no objection or contest to such annexation or
amendment has been filed by law or is presently pending;
NOW, THEREFORE, be it ordained by the City Council of Salt
Lake City, Utah:
SECTION 1. AREA. That the city limits of Salt Lake City,
be , and the same hereby are, enlarged and extended so as to

SECTION 2. ZONING. Be it further ordained and declared
that the tract above described in Section 1, is hereby zoned
Commercial "C-1" . The Use District Map as adopted by Section
51-12-1 of the Revised Ordinances of Salt Lake City, Utah, 1965
as amended , relating to the boundaries of Use Districts , be , and
the same is, amended by addition of the tract of land described
in Section 1, zoned to the "C-1" classification as set forth
above.
SECTION 3. CITY COUNCIL AND SCHOOL DISTRICT MAPS. The Salt
Lake City Council District and School Precinct boundary is hereby
amended to include the parcel specified in Section 1 of this
ordinance in Council District 7 and School Precinct 7 as
specified on such map.
SECTION 4. GENERAL JURISDICTION. Be it further. ordained CP

and declared that the tract of land described above in Section 1
shall thenceforth be within the corporate limits of Salt Lake

City Corporation. Said tract of land shall be zoned as provided
in Section 2. All ordinances , jurisdictions, rules and obligations
of or pertaining to Salt Lake City are extended over and made
applicable and pertinent to this tract of land; and the streets ,
blocks, alleys , and public ways of said tract shall be controlled
and governed by the ordinances, rules, and regulations of Salt
Lake City in that behalf. The monuments of the City Engineer
shall thenceforth be taken therein as the standards of location
and distances of said land .
SECTION 5. CONDITIONS PRECEDENT. Prior to acceptance of
the annexation and publication of this ordinance , the petitioners
shall dedicate a 15 foot wide strip of their property, commonly
known as 3130 South Highland Drive , along Miller Avenue and a 28
foot wide strip of property along Woodland Avenue as right of way
for street expansion. Petitioners shall also construct on the
same property curb , gutter, sidewalk and street improvements
along Highland Drive, Miller Avenue and Woodland Avenue according
to the Salt Lake City Engineering specifications and paid for
entirely by the owner or developer of the petitioner's property .
The streetscape improvements to be constructed on Miller Avenue

shall align with existing improvements west of the petitioner' s
property.

SECTION 6. FILINGS AND NOTICE. Upon the passage and
publication of this ordinance, the Recorder of Salt Lake City is CAD

hereby directed to file with the County Recorder of Salt Lake

County , a copy of the approved annexation plat or map, duly
certified and acknowledged , together with a certified copy of
this ordinance. The City Recorder is further directed to provide
notice to the Utah State Tax Commission pursuant to the provisions
of Section 11-12-1 , Utah Code Annotated , 1953 as amended .
SECTION 7. PUBLICATION AND EFFECT. This ordinance shall
take effect upon the date of its first publication. The City
Recorder is instructed not to publish this ordinance until an
annexation plat prepared by a registered professional engineer or
surveyor at the developer' s expense has been submitted to the
City meeting all City standards for such a document and has been
signed by the Mayor. Further , this ordinance shall not be
published until the Mayor certifies that the dedications
specified in Section 5 above have been made to the City in a form
approved by the City Attorney; and further, that the improvements
required in Section 5 above have either been completed as
certified by the City Engineer or a performance bond sufficient
to insure their completion has been posted and approved by the
City Attorney. If the above conditions have not been met within
one year this ordinance shall be vo id .
