004 of 1986 - Closure of Public Way Old VA Hospital Site Corrected 2/20/86 A ���� - ' � ���'� ����t �D P 85-259 a t � . � RECORDER'S OFFICE EXTENDED BY Bill #2 of 1987 SALT LAKE CITY ORDINANCE No. 4 of 1986 (Clos ure of Public Way Old VA Hospital Site) AN ORDINANCE CLOSING A 20-FOOT PUBLIC ALLEY RUNNING THROUGH BLOCK 186, PLAT D, SALT LAKE CITY SURVEY, CLOSING A 5-FOOT ALLEY LOCATED IN BLOCK 179, PLAT "D" , SALT LAKE CITY SURVEY, AND CLOSING AN 80-FOOT ROAD EASEMENT RUNNING THROUGH BLOCKS 179 AND 186, PLAT "D" , SALT LAKE CITY SURVEY. WHEREAS, the City Council of Salt Lake City finds, after a public hearing , that the City' s interest in the two alleys and the road easement described below which are platted within Blocks 179 and 186, Plat "D" , Salt Lake City Survey, which are the subject of Petition 295 of 1980, submitted by the LDS Church, et al. , are no longer necessary for use as public ways and that the closure of said public ways, rather than the vacation of the same , as described below will not be adverse to the interests of the general public ; and WHEREAS, it is the City' s intention, upon closure of said street and alleys , to transfer to the petitioner , under separate document, the underlying property interests currently held by the City, subject to certain terms and conditions, reservation of appropriate easements, and conditions subsequent. NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. ALLEY CLOSURE. An alley located within the Panorama Subdivision, Plat "D" , Salt Lake City Survey, which runs south between 13th and 14th Avenues parallel to C and D Streets, (329. 5 feet) , and more particularly described below , be , and the same hereby is CLOSED and declared no longer to be needed or available for use as a public alley or public way : BEGINNING at the Southwest corner of Lot 1, of the Panorama Subdivision of Block 186, Plat "D" , Salt Lake City Survey; thence running West 20 feet, more or less, to the Southeast corner of Lot 2; thence North along the East lot lines of Lots 2 through 14 330 feet, more or less, to the Northeast corner of Lot 14 ; thence West 20 feet, more or less, to the Northwest corner of Lot 15; thence South along the rear lot lines of Lots 15 through 26 and Lot 1 for 330 feet, more or less, to the Southeast corner of Lot 1 of said subdivision ; thence West 20 feet, more or less, to the point of BEGINNING. Said closures are expressly made SUBJECT TO all existing rights of way and easements of all public utilities of any and every description now located on , in, under or over the above-described property, and also SUBJECT TC the rights of entry thereon for the purpose of obtaining , altering , replacing , removing , repairing or rerouting said utilities and all of them. Said closures are also SUBJECT TO any existing rights of way or easements of private third parties. CONDITIONS SUBSEQUENT. This ordinance , after passage , shall be published but shall not becane effective until the petitioners pay to the City fair market value or other equitable considera- tion for the property being closed . SECTION 2. EFFECTIVE DATE. This ordinance , after the date of its first publication, shall not beccane effective until recorded with the Recorder of Salt Lake County. However , the Salt Lake City Recorder is instructed not to record this ordi- -3- nance until the Mayor receives verification that the conditions subsequent have been satisfied or provided for by executed agreement. Upon verification of satisfaction, the Mayor may transfer the property to the petitioner and instruct the Recorder to record the ordinance concurrently with the transfer documents. However, if the foregoing conditions are not completed within 12 months from the date of passage, this ordinance shall be null, void and of no effect and no recording thereafter shall be allowed. I-y SECTION 2. EFFECTIVE DATE. This ordinance , after the date of its first publication, shall not become effective until CJt recorded with the Recorder of Salt Lake County. However, the Salt Lake City Recorder is instructed not to record this ordi- -3- nance until the Mayor receives verification that the conditions subsequent have been satisfied or provided for by executed agreement. Upon verification of satisfaction, the Mayor may transfer the property to the petitioner and instruct the Recorder to record the ordinance concurrently with the transfer documents. However , if the foregoing conditions are not completed within 12 months from the date of passage, this ordinance shall be null , void and of no effect and no recording thereafter shall be allowed .
