of the Salt Lake City Code pertaining to design standards)
An ordinance amending Section 21A.37.020 of the Salt Lake City Code pertaining to design
standards pursuant to Petition No. PLNPCM2017-00921.
WHEREAS, On November 2, 2017, Salt Lake City Mayor Jacqueline Biskupski
requested an amendment(Petition No. PLNPCM2017-00921)to Section 21A.37.020,
applicability of design standards,to provide clarity on the application of design standards
regulations; and
WHEREAS,the Salt Lake City Planning Commission held a public hearing on January
24,2018,to consider said petition and voted in favor of transmitting a positive recommendation
to the Salt Lake City Council; and
WHEREAS, the Salt Lake CityCouncil finds, after holdingapublic hearingon this
matter,that adopting this ordinance is in the city's best interests.
NOW, THEREFORE,be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. Amending the Text of Salt Lake City Code Section 21A.37.020. That Section
21A.37.020 (Zoning: Design Standards: Applicability) of the Salt Lake City Code shall be and
hereby is amended to read as follows:
21 A.37.020: APPLICABILITY:
The design standards identified in this chapter apply to all properties in the zoning districts
listed in Section 21A.37.060 of this chapter and pursuant to the following:
A. Change in Use: A change in use shall be exempt from this chapter, provided that it does
not result in alterations of existing design elements regulated by the standards of this
chapter.
B. Additions: When an addition to an existing structure is made, only the addition is subject
to this chapter, provided that no existing design element regulated by these standards is
altered in other portions of the existing structure.
C. Repair, Maintenance or Alterations: Structures may be repaired, maintained or altered,
except that no such work shall create a noncompliance or increase the degree of an
existing noncompliance. If a design element of an existing structure complies with this
chapter, the design element shall not be altered such that the structure becomes
noncompliant.
D. Certificate of Appropriateness: All new construction, additions, exterior building work,
structure work, and site work on property in an H Historic Preservation Overlay District
or a landmark site remains subject to a certificate of appropriateness as required in
Subsection 21A.34.020E of this title.
SECTION 2. Effective Date. This Ordinance shall become effective on the date of its first
publication.
