Agricultural A-1 to Industrial M-lA —. : pursuant to Petition No. 400-523-87) LULH_" �3 OF FICE AN ORDINANCE AMENDING SECTION 51-12-2 OF THE REVISED ORDINANCES OF SALT LAKE CITY, UTAH, 1965, AS AMENDED, RELATING TO ZONING AND FIXING OF BOUNDARIES OF USE DISTRICTS. WHEREAS, in response to Petition No. 400-523-87 pertaining to zoning, the City Council of Salt Lake City,Utah, has held public hearings before its own body and before the Planning Commission, and has taken into account citizen testimony and filings, demographic details of the area and all other matters. Pursuant to these deliberations, the Council has concluded it is appropriate to rezone certain of the properties located at 5600 West and 700 South from Agricultural "A-l" to Industrial "M-lA" for the development of the community in the area. THEREFORE, the City Council of Salt Lake City, Utah, hereby adopts the following amendment to the Use District provisions of Title 51. Be it ordained by the City Council of Salt Lake City Utah: SECTION 1. That the Use District Map, as adopted by Section 51-12-2,Revised Ordinances of Salt Lake City, Utah, 1965, as amended, relating to the fixing of the boundaries of Use Districts, be, and the same hereby is AMENDED as follows: Sec. 51-12-2. Boundaries of Use Districts. That the below-described parcel of real property in Salt Lake City, Utah, presently zoned Agricultural "A-l" lying at approximately 5600 West and 700 South is hereby rezoned to Industrial "M-lA" classification, and the Use District Map is amended accordingly. Beginning at the Northeast Corner of Section 11, T. 1 S., R. 2 W., S.L.B.&M.; thence S89°54'13"E, 1650 feet; thence SO°01'17"W, 1320 feet more or less to the north boundary of the Union Pacific Railroad property; thence Northeasterly 1695 feet, more or less, along the north y boundary of the Union Pacific Railroad property to the north boundary of said Section 11; thence North 0°01'17" East, 981.45 feet along said section line to the point of beginning. SECTION 2. Conditions Precedent. Petitioner has agreed that the rezoning provided in this ordinance shall not take effect until petitioner has entered into a development agreement approved by the City requiring: (1) Dedication of rights-of-way of petitioner's property as specified on the City's Major Street Plan for 5600 West, 700 South and 6000 West, including a dedication of a deceleration lane on 5600 West frontage for access onto petitioner's property; (2) Petitioner's installation or posting of a bond sufficient to guarantee installation for the street on 700 South contiguous to the rezoned portions of the property; (3) That petitioner agrees to install City approved water and sewer systems and post a bond sufficient to insure their completions; (4) That petitioner provides professionally engineered landscape plans which shall be subject to review and approval by the Planning Commission; (5) That petitioner submits professionally engineered drainage plans for the property to be approved by the City Engineering Department; (6) That petitioner agrees to a waiver of protest for any future special improvement districts to install facilities for streets, sewer lines, water lines, curb, gutter, sidewalk installation, site drainage systems or other infrastructure systems pertaining to the property. SECTION 3. EFFECTIVE DATE. This ordinance shall be effective immediately upon publication. The City Recorder of Salt Lake City is instructed not to record this ordinance until the Mayor certifies that the conditions in Section 2 above have been met. In the event such conditions are not met within one (1) year, the Mayor may, for good cause, extend the period for compliance with the conditions in Section 2 for an -2- additional year. If the conditions have not been met within the time specified above or any extensions thereof, this ordinance shall be null and void and Recorder is instructed to not record it.
