MA — SALT LAKE CITY ORDINANCE No. 48 of 1996 (Vacating a portion of and closing another portion of an alley pursuant to Petition No. 400-95-94) AN ORDINANCE VACATING A PORTION AND CLOSING ANOTHER PORTION OF AN ALLEY, PURSUANT TO PETITION NO. 400-95-94. WHEREAS, the City -Council of Salt Lake City, Utah, finds after public hearing that the City's interest in a portion of an alley, located between 800 West and Grant Street and between 500 and 600 North, described below, is not necessary for use by the public as an alley and that vacation and closure of portions of said alley will not be adverse to the general public's interest. NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That a portion of that certain alley, which is the subject of Petition No. 400-95-94 and which is more particularly described below, be, and the same hereby is, VACATED and declared no longer to be needed or available for use as an alley. Said portion of the alley is more particularly described as follows: Commencing at the northeast corner of Lot 22; Block 2 of the Wilkes Subdivision, a subdivision of Block 86, Plat C, Salt Lake City Survey, located in the northeast quarter of Section 35, T.1N., R.1W., S.L.B.&M.; thence south 300 feet to the southeast corner of Lot 31; thence east 15 feet to the southwest corner of Lot 4; thence north 270 feet to the northwest corner of Lot 12; thence west 7.5 feet to the centerline of an alley running north/south; thence north 30 feet along the centerline of said alley; thence west 7.5 feet to the point of beginning SECTION 2. That a portion of that certain alley, which is the subject of Petition No. 400-95-94 and which is more particularly described below, be, and the same hereby is, CLOSED and declared surplus and no longer to be needed or available for use as an alley. Said portion of the alley is more particularly described as follows: 2 Commencing at the northeast corner of Lot 18; Block 2 of the Wilkes Subdivision, a subdivision of Block 86, Plat C, Salt Lake City Survey, located in the northeast quarter of Section 35, T.1N., R.1W., S.L.B.&M.; thence south 120 feet to the southeast corner of Lot 21; thence east 7.5 feet to the centerline of an alley running north/south; thence south 30 feet along the centerline of said alley; thence east 7.5 feet to the southwest corner of Lot 13; thence north 150 feet to the northwest corner of Lot 17; thence west 15 feet to the point of beginning. SECTION 3. RESERVATIONS AND DISCLAIMERS. The above vacation and closure is expressly made SUBJECT TO all existing rights -of -way and easements of all public utilities of any and every description now located on and under or over the confines of the property and also SUBJECT TO the rights of entry thereon for the purposes of maintaining, altering, repairing, removing or rerouting said utilities, including the City's water and sewer facilities, and all of them. Said vacation is also SUBJECT TO any existing rights - of -way or easements of private third parties. SECTION 3. EFFECTIVE DATE.
