049 of 1994 - Adopting Sections 21.80.290 through .296 providing for a density bonus for elderly housing0 94-1 P 94-103 SALT LAKE CITY ORDINANCE No. 49 of 1994 (Adopting Sections 21.80.290 through .296 providing for a density bonus for elderly housing) AN ORDINANCE ENACTING SECTIONS 21.80.290 THROUGH .296, SALT LAKE CITY CODE, PROVIDING FOR A DENSITY BONUS FOR ELDERLY HOUSING. WHEREAS, the City Council of Salt Lake City, Utah, has held public hearings before its own body and before the Planning Commission and believes it appropriate to adopt an ordinance providing for a "density bonus" reducing the required lot size per housing unit occupied by persons over the age of fifty-five on the grounds that such housing units require less space and parking; NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That Sections 21.80.290 through .296 be, and the same hereby are, adopted to read as follows: 21.80.290 Elderly housing density bonus. Pursuant to the provisions of Sections .291 through .296, elderly housing in districts zoned Residential "R-2A", "R-3A", "R-5", "R-6" and "R-7" shall be given a density bonus from normally applicable lot area per dwelling unit requirements. 21.80.291 Definitions. For the purpose of this ordinance the following definitions are applicable: A. "Elderly housing" means housing restricted to occupancy only by persons over fifty-five years of age and where all of the dwelling units in the project are less than 600 square feet in gross floor area measured from the inside walls of the unit including all internal spaces. B. "Density" means the number of units allowed by the size of the lot as calculated pursuant to the area requirements of the applicable zone. 21.80.292 Density bonus. Elderly housing shall be entitled to a density bonus calculated by multiplying the otherwise allowable density by 1.25 and rounding down the resulting product to the nearest whole number of units. 21.80.293 Parking requirements. Elderly housing constructed with a density bonus shall comply with the off street parking requirements of Chapter 21.84 or may apply for an alternative parking requirement pursuant to the provisions and processes specified in Chapter 21.84 as a "unique residential population". 21.80.294 Occupancy limitation. Multiple unit elderly housing constructed with a density bonus pursuant to this ordinance shall have a maximum average unit occupancy of 1.5 persons. 21.80.295 Deed restriction. The City shall record with the Salt Lake County Recorder's Office in the chain of title for each elderly housing project constructed with a density bonus pursuant to this ordinance a stipulation and deed restriction that the property shall not be used for any other purpose or type of occupancy for fifty years 2 from the date that any such building obtains a certificate of occupancy. 21.80.296 Change of use. Housing constructed with this density bonus shall not be used for any other purpose without prior approval of the City after a remodelling or reconfiguration of the property and structures to bring the changed use into compliance with applicable density and parking requirements. SECTION 2. This ordinance shall take effect immediately upon the date of its first publication.
