AN ORDINANCE PROVIDING FOR THE CLOSURE OF THAT PORTION OF
FOOTHILL DRIVE LOCATED BETWEEN NINTH SOUTH STREET AND HUBBARD
AVENUE RETAINING THE CITY'S INTEREST IN THE UNDERLYING PROPERTY.
WHEREAS, the Foothill-Sunnyside Neighborhood Council in
Petition No. 319 of 1981 requests the redesign of the street
system in the area of Foothill Drive from Sunnyside Avenue to
2100 East Streets to promote neighborhood safety, eliminate
devisive physical barriers, and enhance public street improve-
ment amenities, and
WHEREAS, an integral but controversial element of said
proposal contemplates the closure of Foothill Drive between
Ninth South Street and Hubbard Avenue; and
WHEREAS, notwithstanding a contrary recommendation from
the Planning Commission regarding this element, after lengthy
consideration at two public hearings, a unanimous vote of all
members present, the City Council finds that the praiseworthy
goals of the petition may be most likely to succeed if the
alternative plan of closure is implemented. It is the Council's
finding to that end that the goal of safety and reduced speed is
most enhanced by eliminating the potential for straight passage
of commuter traffic as a short cut to avoid nearby arterial
highways, and
WHEREAS, in balancing competing interests in the use of
the streets between neighborhood residents and commuter through
traffic, the Council concludes that the benefits from changing
traffic circulation by the closure to the neighborhood outweigh

any negligible impacts to commuter traffic which should becn

WHEREAS, the City Council concludes that closure of the
street is desirable, there is no intention to relinquish the

City's interest in the underlying property, which shall be
retained. It is anticipated that such land shall be utilized
for creation of a neighborhood public minipark to be con-
structed in coordination with street improvements through a
special improvement district.
Therefore, be it ordained by the City Council of Salt
Lake City, Utah;
SECTION 1. That that portion of Foothill Drive located
between Ninth South Street and Hubbard Avenue (900-950 South)
in Salt Lake City, Utah, for use as a public street is no
longer necessary. Said parcel, more particularly described
below, is hereby declared to be CLOSED and no longer available
for use as a public street. However, notwithstanding such
closure, the City's interest in the parcel is retained and
reserved by the City for use as it deems appropriate.
Parcel.
Beginning at a point which is South 124.29 feet from
the Northeast corner, Lot 4, Block 13, Sunnyside
Park Subdivision; thence South 126.22 feet; thence
Westerly along the arc of a reverse curve 119.89
feet to a point which is on the North line of
Hubbard Avenue, 34.86 feet East from the Southwest
corner, Lot 2, Block 13, Sunnyside ParkLSubdivision;
thence Northerly along a curve to the left 75.29
feet; thence N 33°15' W 217.00 feet more or less to
the North line of Block 16, Douglas Park Subdivision,
said North line also being the South line of 900
South Street; thence Easterly 44.00 feet more or
less to the Northwest corner, Lot 3, Block 13,
Sunnyside Park Subdivision; thence East 66.51 feet;
thence S 33°15' E 148.62 feet more or less to the
point of beginning.
SUCH CLOSURE IS EXPRESSLY MADE SUBJECT TO THE RESERVATION OF
ALL EXISTING RIGHTS-OF-WAYS AND EASEMENTS OF ALL PUBLIC UTILITIES
OF ANY AND EVERY DESCRIPTION FOUND LOCATED ON, IN, UNDER OR OVER
THE CONFINES OF THE ABOVE-DESCRIBED PROPERTY; AND
SAID CLOSURE IS ALSO SUBJECT TO THE RIGHTS OF ENTRY THEREON
FOR THE PURPOSE OF OBTAINING, ALTERING, REPAIRING, REPLACING,
REMOVING, OR REROUTING SAID UTILITIES AND ALL OF THEM.
