051 of 1997 - Revisions to Zoning Ordinance Regarding Flag Lot Requirements, pursuant to0 97-1 P 97-19 SALT LAKE CITY ORDINANCE No. 51 of 1997 (Revisions to Zoning Ordinance Regarding Flag Lot Requirements, pursuant to Petition No. 400-96-46) AN ORDINANCE AMENDING CHAPTER 21A.24.010 G OF THE SALT LAKE CITY ZONING CODE RELATING TO FLAG LOTS IN RESIDENTIAL DISTRICTS, REQUIRING THAT FLAG LOTS BE APPROVED AS CONDITIONAL USES RATHER THAN AS PERMITTED USES IN RESIDENTIAL DISTRICTS, PURSUANT TO PETITION NO. 400-96-46. WHEREAS, under the terms of the Salt Lake City Zoning Ordinance adopted in April 1995, flag lots in some residential areas were allowed as permitted uses; and WHEREAS, after processing some of these flag lots, it became clear that in many cases flag lots were not in character with the surrounding area; and WHEREAS, after a public hearing, the Salt Lake City Planning Commission has found that: 1. Flag lots can have a negative impact upon the character of certain areas; 2. Consideration of existing property size and development patterns is an important assessment to measure the impacts of flag lots on neighborhood vitality; 3. Consideration of flag lots, where appropriate as a conditional use, supports the Salt Lake City housing policy; and 4. Strict compliance to existing flag lot standards without the discretionary review process would not insure neighborhood compatibility; and WHEREAS, the Salt Lake City Council has determined, after a public hearing, that the interest of the public would be better served by allowing flag lots in residential areas only as conditional uses. NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That Chapter 21A.24.010 G of the Salt Lake City Code shall be and hereby is amended to read as follows: G. Flag Lots in Residential Districts. Flag lots are a permitted use only as part of a new subdivision in the FP, FR-1, FR-2 and FR-3 Districts. Flag lots in all other residential districts, unless being approved through the Planned Development process, may be allowed as a Conditional Use Pursuant to Part V, Chapter 21A.54, Conditional Uses, provided that the Planning Commission finds the flag lot proposal to be compatible with the existing pattern of property development of the surrounding area. The Planning Commission shall also make findings on the standards listed in Section 21A.24.010G 1 through 10 below: 1. In residential districts other than new subdivisions in the FP, FR-1, FR-2, FR-3 2 Districts, flag lots shall be approved only when one flag lot is proposed at the rear of an existing lot, unless being approved through the Planned Development process; 2. Flag lots shall be used exclusively to provide lots for single family residential dwellings; 3. All lot and yard requirements applicable to flag lots shall apply to the main body of the flag lot. For flag lots, the front yard shall begin at the point where the access strip joins the main body of the lot; 4. Except for the special provisions contained in this Section 21A.24.010G, the creation of a flag lot shall not result in a violation of required lot area, lot width, yards or other applicable provisions of this Zoning Ordinance. 5. Flag lots shall have a minimum lot depth of one hundred (100) feet; 6. The flag lot access strip shall have minimum of twenty (20) feet of frontage on a public street. No portion of the flag lot access strip shall measure less than twenty (20) feet in width between the buildable area of the lot and the street right-of-way line. A four (4) foot minimum landscape yard shall be provided on both sides of the access strip. (See illustration in Part VI, Chapter 21A.62, Definitions); 7. Flag lots, including the access strip, shall be held in fee simple ownership; 8. The minimum lot area of a flag lot shall not be less than 1.5 times the minimum lot area of the applicable district; 9. Interior side yards for a flag lot shall conform to the requirements of the applicable 3 district, but shall not be less than ten (10) feet; and 10. All lots resulting from the creation of a flag lot shall have a lot width not less than the minimum lot width of the applicable district and shall be measured at the front yard setback line. SECTION 2. Effective Date. This Ordinance shall become effective on the date of its first publication. SECTION 3. Pending Applications. Any application for a flag lot which has not received final approval prior to the effective date of this Ordinance shall be required to comply with the terms of this Ordinance.
