052 of 1991 - Memorandum of Understanding between Salt Lake City Corporation and American Federation of State, Cou0 91-1 C 91-346 SALT LAKE CITY ORDINANCE No. 52 of 1991 (Superseding Salt Lake City Ordinance No. 38 of 1991 and approving a Memorandum of Understanding between Salt Lake City Corporation and the American Federation of State, County and Municipal Employees (AFSCME) representing the "200 Series" City Employees) AN ORDINANCE SUPERSEDING SALT LAKE CITY ORDINANCE NO. 38 OF 1991 AND APPROVING A MEMORANDUM OF UNDERSTANDING BETWEEN SALT LAKE CITY CORPORATION AND LOCAL 1004 OF THE AMERICAN FEDERATION OF STATE, COUNTY AND MUNICIPAL EMPLOYEES, REPRESENTING THE "200 SERIES" CITY EMPLOYEES, WHICH SHALL BECOME EFFECTIVE ON PROPER RATIFICATION AND SIGNATURE. PREAMBLE On or before June 4, 1991, Local 1004 of the American Federation of State, County and Municipal Employees, as the Certified Bargaining Representative for the "200 Series" City Employees, and the Mayor, agreed to a Memorandum of Understanding, subject to appropriate ratification by the "200 Series" City employees and signature of the parties. On June 4, 1991, the City Council approved the Memorandum of Understanding through Salt Lake City Ordinance No. 38 of 1991. Although the Memorandum of Understanding was approved by the City Council, the Mayor did not sign it pending possible further changes to it. As a result, the Mayor and Local 1004 of the American Federation of State, County and Municipal Employees have agreed to the attached Memorandum of Understanding which is different from the one approved by the City Council on June 4, 1991. Accordingly, the attached Memorandum of Understanding is submitted to the City Council for approval. Section 9(c) of the Salt Lake City Third Amended Labor Bargaining Resolution dated April 10, 1984, provides that no collective bargaining Memorandum of Understanding shall be effective until the City Council approves the Memorandum of Understanding, enacts implementing legislation and appropriates all required funds. The attached Memorandum of Understanding is a two year agreement effective for fiscal years 1991-92 and 1992-93. The City Council has appropriated necessary funds required to implement the provisions of the attached Memorandum of Understanding for fiscal year 1991-92. For fiscal year 1992-93, the Memorandum of Understanding shall be subject to appropriation of funds by the City Council. Accordingly, the City Council wants to approve the attached Memorandum of Understanding between Salt Lake City Corporation and Local 1004 of the American Federation of State, County and Municipal Employees which shall become effective on ratification and signature of the parties. Be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. PURPOSE. The purpose of this Ordinance is to supersede Salt Lake City Ordinance No. 38 of 1991 and approve the attached Memorandum of Understanding which shall become effective on appropriate ratification by the "200 Series" City employees and on signature of the Mayor, as the Chief Administrative 2 Officer for the City and Local 1004 of the American Federation of State, County and Municipal Employees, representing the "200 Series" employees, pursuant to Section 9(c) of the Salt Lake City Third Amended Labor Bargaining Resolution dated April 10, 1984. SECTION 2. The attached Memorandum of Understanding between the City and Local 1004 of the American Federation of State, County and Municipal Employees is hereby approved. SECTION 3. AUTHORIZATION. The Mayor of Salt Lake City, Utah is hereby authorized to act in accordance with the terms and conditions of the attached Memorandum of Understanding when it is properly ratified and executed. SECTION 4. EFFECTIVE DATE. This Ordinance shall be deemed effective on its first publication.
